Please pass on if it is not, Jackie Johnson had negotiated and agreement for the Nelsons with Firestown with some contingencies. I thought the contingencies ( ie having access across a particular parcel ) had already been met and that the agreement accomplished nothing. This information I am sending interoffice shows that the lot owned by Swarts and described in the agreement as "C" is not the lot that the Nelsons already have an easement over since that access is to the west of C and not included in C. Therefore my concerns about the agreement have been resolved and it appears adequate for current access. Lee D. Blake Nelson This is a follow-up to my memorandum dated October 25, 2000. It has been brought to my attention that the north /south access from the existing railroad grade easement is owned by the Town of Firestone. Firestone is utilizing this grade for its trail system and to discourage vehicle traffic. The applicant shall supply documentation from the Town of Firestone to verify that permission has been given to use this existing railroad grade easement for the use proposed in the USR. The Nelson USR plat drawing is showing an access easement from WCR 26. During my site investigation, I could not determine where this access easement should be according to the plat drawing using the dimensions. There is no access road developed at this time. Blake Nelson COLORADO 0CT3 o 2000 RECEIVED The Weld County Public Works Department has reviewed this proposal. This project falls under the purview of the Weld County Use by Special Review Standards. Our comments and requirements are as follows: COMMENTS: There are three accesses to the facility. The access from WCR 26 is designated on the Southwest Study Area Capacity Improvement Needs as a paved rural road, and it requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. The north/south access is from an existing railroad grade easement and can accommodate two-way traffic. It is private with non-county maintenance. Circulation:There appears to be adequate circulation and parking to accommodate pick-up trucks, horse trailers, and stock trailers. Storm Water Drainage: The surrounding property is dry land pasture. The land appears to be flat with some sloping to the southwest at the very southern portion of the property. Drainage appear to disburse prior to reaching the adjacent properties. Any storm water related to animal units, such as corral cleaning or manure storage shall be referred to the Health and Environment Department. Before any buildings are moved or demolished, building permits area required. 2. Building permits are required for any accessory buildings moved onto the property. 3. Separate building permits are required for advertisement signs. Signs shall adhere to Section 42 of the Weld County Zoning Ordinance and Section 2.8 of the Weld County MUD Ordinance as applicable. Engineering may be required. 4. Electrical permits are needed for any site lighting or any other electrical work done on the property. Electrical work shall conform to the 1999 National Electrical Code (NEC). All electrical work in public areas shall be performed by a licensed Colorado electrical contractor. 5. Complete drawings shall be submitted to the appropriate fire district for review. 6. Additional requirements or changes may be required when building applications or plans are reviewed by the Weld County Building Inspection Department or the Fire District. Blake Environmental Protection Services has reviewed this proposal for a roping arena and recommends approval. We have several recommended development standards and one recommended condition of approval. They are as follows: We recommend the following to be a condition of approval: , 1) The applicant shall submit a manure management plan to the Weld County Department of Public Health&Environment for review and approval. The plan should describe how manure generated on site will be stored,managed,removed, land applied, etc. We recommend the following to be development standards: 1) The applicant shall remove,handle,and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exit or deteriorate to a condition that facilitates excessive odors,flies,insect pests,or pollutant runoff. In no event shall the facility impact or degrade waters of the State in violation of the Confined Animal Feeding Operation Control Regulations(5CCR 1002-19). 2) The facility shall maintain compliance with the Confined Animal Feeding Operation Control Regulations and the Weld County Zoning Ordinance. 3) All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,30-20- 101, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4) No permanent disposal of wastes shall be permitted at this site. 5) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6) Fugitive dust shall be controlled on this site. 7) The maximum permissible noise level shall not exceed the residential limit of 55 db(A)as measured according to 25-12-102, Colorado Revised Statutes. 8) Adequate toilet and hand washing facilities shall be provided for the public. An individual sewage disposal system is required for the proposed Roping Arena and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system shall be designed by a Colorado Registered Professional according to the Weld County Individual Sewage Disposal Regulations. 9) The applicant shall provide bottled water for patrons. Blake Nelson Environmental Health Services has reviewed this proposal for a commercial roping arena. We have no objections to the proposal,however, in reviewing the application we observed that the applicant is proposing no permanent water source. The proposed hours of operation for the roping arena indicates two evening per week from May to September, at approximately 5 hours each evening. Because hand-washing is the single most important step to stopping the spread of infection we believe that a permanent water supply, i.e. community system, well, etc. is necessary. However, should the Planning Commission decide that a permanent Individual Sewage Disposal System/hand-washing facility is not necessary, we would propose that a vault system with a temporary hand-washing set-up (container with warm water, an on/off spigot, soap and paper towels) would be an alternative to serve the sanitary needs of the people using the roping arena.
