Of Planning Services Q Subject: Legal Action Authorization COLORADO The Department of Planning Services staff has scheduled the following violations to be considered at the December 11, 2001 hearing beginning at 10:00 a.m.. The Department of Planning Services staff is requesting that the Board review the individual cases and determine whether or not to authorize legal action to remedy the violations. Weld County Zoning Violation Cases: VI-0100073, Mr. & Mrs. Lloyd Arden Chapter 23, Article 111(3), Division 1, Sections 23-3-20, 23-3-30 and 23-3-30.1 of the Weld County Code. Noncommercial Junkyard consisting of derelict vehicles, wood and miscellaneous debris shall be removed or completely screened from all adjacent properties and the public right-of-way. VI-0100241, Shelton Land & Livestock, LTD do Mr. Ron Shelton Chapter 23, Article 111(3), Division 1, Sections 23-3-20, 23-3-30, 23-3-30.C, 23-3-40, 23-3-40.B.16, 23-3-50 and 23-3-50.D and Article IV(4), Division 8, Section 23-4-710 of the Weld County Code. The property owner shall obtain approval and record a plat for a Use by Special Review or the number of animal units shall be reduced to fall within the guidelines as established through the bulk requirements. Additionally, the facility shall be in compliance with the Colorado Confined Animal Feeding Operation Control Regulations (CAFO Regulations). VI-0100039, Mr. & Mrs. Vernon McFarlin Chapter 23, Article 111(3), Division 2, Sections 23-3-120, 23-3-120.6 and 23-3-120.C of the Weld County Code. Noncommercial Junkyard shall be removed. A Noncommercial Junkyard is not an allowed use in the R-2 (Residential)Zone District. Weld County Combined Zoning and Building Violation Cases: VI-0100212, Mr. & Mrs. Roger Clark Chapter 23, Article 111(3), Division 1, Sections 23-3-20, 23-3-20.P, 23-3-30 and 23-3-30.1 and Article IV, Division 3, Sections 23-4-140 and Chapter 29, Article VII, Section 29-7-10 of the Weld County Code. Noncommercial Junkyard shall be restored, removed or completely screened from all adjacent properties and public right-of-way. Additionally, both the mobile homes shall obtain all necessary temporary permits or be removed. VI-0100133, Mrs. Mary Jane Jones Chapter 23, Article 111(3), Division 1, Sections 23-3-20, 23-3-30 and 23-3-30.1 and Chapter 29, Article 111(3), Section 29-3-10 of the Weld County Code. Noncommercial Junkyard shall be restored, removed or completely screened from all adjacent properties and public right-of-way. Additionally, the semi cab (commercial vehicle) shall be removed. Lastly, a building permit shall be obtained for the structure which has been constructed on the property.
