RESOLUTION
RE: GRANT CHANGE OF ZONE FROM A-AGRICULTURAL TO C-2 COMMERCIAL
FOR ERNEST UNDERDOWN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 5th day of May,
1982, at 2 : 00 o'clock p.m. for the purpose of hearing the appli-
cation of Ernest Underdown, 14228 Weld County Road 100, Nunn,
Colorado 80648, requesting a change of zone from A-Agricultural
to C-2 Commercial for the following described parcel of land,
to-wit:
Attached exhibit "A" is incorporated herein
by reference.
WHEREAS, Section 21. 6. 2 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Plan-
ning Commission, and having been fully informed finds as follows :
1. The applicant has complied with Section 21. 7 et seq of
the Weld County Zoning Ordianance regarding the applica-
tion requirements for a change of zone.
2. The subject property is located within the Nunn Referral
Area and the request has been recommended for approval
by the town of Nunn.
3. It is the opinion of the Planning Commission that the
applicant has shown compliance with Section 21. 5. 1 of
the Weld County Zoning Ordinance as follows :
a) It is the opinion of the Planning Commission that the
applicant has adequately demonstrated that the proposal
is consistent with the policies of the Weld County
Comprehensive Plan.
b) The uses which would be allowed on the subject property
by granting the change of zone will be compatible with
the surrounding land uses.
c) Adequate water service will be provided by the town of
Nunn as indicated in the attached letter from the Mayor
of Nunn.
d) A letter from the Weld County Health Department indicates
there is an adequate means for sewage disposal.

e) A letter from the State Division of Highways indicates
that street and highway facilities providing access to
the subject site are adequate in size to meet the require-
ments of the proposed zone district.
f) The proposed site is not located within any Overlay Dis-
trict area.
g) The proposed site is not known to contain any commercial
mineral deposits.
h) There are no known soil conditions which would limit
development on the proposed site.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of Ernest
Underdown, for a change of zone from A-Agricultural to C-2 Commercial,
on the above referenced tract of land be, and hereby is, granted.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 5th day of
May, A.D. , 1982.

The following business was transacted:
I hereby certify that pursuant to a notice dated March 29 , 1982 , duly
published April 1 and April 22 , 1982 in the Johnstown Breeze, a
public hearing was held on the request of Ernest R. Underdown for
-a Change of Zone, from Agriculture to Commercial 2 . Mr. Underdown
was present and reviewed his request on said 4 .18 acres more or less.
If this request is approved the Moose Lodge will purchase said site
and construct their facility. No one in attendance at the hearing was
opposed to the granting of _said Change of Zone from Agriculture to
Commerical 2 . After all the testimony was received, Commissioner C.
Carlson made a motion to approve this request. Commissioner N.
Carlson seconded the motion and it carried unanimously. The Planning
Commission' s recommendation on said Change of Zone was favorable.
The next request presented to the Board by the Planning Staff was
Recorded Exemption #541 for Mr. and Mrs. Ernest Underdown. This
property contains approximately 119 . 14 acres , more or less . The
applicants wish to sell 4 . 18 acres , more or less, of the farm land
to the Moose Lodge #2280 and retain 114 . 96 acres , neither of which
contain any improvements . The 114 . 96 acres , more or less , will
continue to be farmed and the 4 . 18 acres , more or less , will contain the
Commercial Commercial 2 Zone. The Planning Staff recommended that this request
be granted. Commissioner Steinmark made a motion to approve Recorded
Exemption #541. Commissioner N. Carlson seconded the motion and it
carried unanimously.

STAFF COMMENTS:
The Weld County Health Department has expressed an interest in reviewing
any proposed food service facilities.
The State Division of Highways has expressed a concern that the historical
surface runoff from the subject site be maintained following construction
of the lodge and other site improvements.

acres of land from Ernest Underdown of Nunn, Colorado. The land is just
North of the Community of Nunn, Colorado and West of Highway 85.
We are requesting that the Zoning of said property be changed. This re-
quest is made to you asking the change and the following statements
are submitted:
1 . The zoning change is contiguous with the Weld County
Comprehensive Plan.
2. A change is be requested to rezone from Agricultural to

proceedural guide , the members and officers of Moose Lodge
#2280 make the following statement:
"In rezoning the 4.18 acres of ground as shown on Joseph A.
Suprenant' s Survey to allow the lodge to erect a building
on said property we will be doing the surrounding area a
fraternal service.
Our lodge will provide the sparsely settled area residents
to become members of the fraternity, and will allow them
a place of convenience for meeting and conducting civic
affairs programs, as allowed for the communities as prescribed
in the Moose By-Laws. We have chosen property that is as
close to the community of Nunn, Colorado as we can find. The
location is just off of Highway 85 and Weld County Road 100 ,
thereby, granting us easy access without disturbing more
agricultural ground. We are also taking only a small portion
of the area that is now zoned agricultural .
With the erection nd occupancy of this building by our mem-
bers we are anticipating being able to serve the nearby
communities should the growth of our county become a reality
as projected.

Dear Mr. Oxenfeld:
We have reviewed the Ernest Underslown appli-c-ations for -a recorded exemption
and rezoning to allow construction of a Moose Lodge. Our main concern relates
to vehicular access.
This property is bounded by County Road 100 on the south and U.S. Highway _85
on the east. There is a 20-font access opening in the U.S. 85 right of way
for Lot 'A' as shown on the survey map. This -access was 'permitted at the
time of highway construction to accommodate the land use at that time.
The State Highway Access Code, as applied to this portion of U.S. 85,
indicates that private, direct access is not to be permitted, except when
the property has no other reasonable access to the general street system.
We support the abandonment of the existing 20-foot _access to U.S. 85 and
the creation of a -new access to County Road 100 as a means to bring about
conformance with the Access Code. If the 'property _owner will initiate a
request to this effect, the District IV Right-of-Way Section will 'prepare
the necessary documents to delete this access.
We would also appreciate a -consideration of surface runoff from this
site since it does slope slightly to the southeast. The historical runoff
rate should bemnaintained following _construction of the lodge and other site
improvements so that there will not be an increase in the amount of water
which reaches the highway right of way.
