HomeMy WebLinkAbout20010870 HEARING CERTIFICATION DOCKET NO. 2001-24 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1314 FOR A BUSINESS (KNIFE GRINDING SHOP) IN THE A (AGRICULTURAL) ZONE DISTRICT - BRIGHTON INDUSTRIAL NORTH, LLP A public hearing was conducted on April 11, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem Commissioner William Jerke Commissioner David Long Commissioner Robert Masden - EXCUSED Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 23,2001,and duly published March 28,2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Brighton Industrial North, LLP, for a Site Specific Development Plan and Use by Special Review Permit #1314 for a Business (knife grinding shop) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Lockman gave a brief description of the location of the site and surrounding uses. She stated the City of Brighton did not respond,and she has received no comments from the surrounding property owners. Ms. Lockman stated the Planning Commission expressed concern with the lack of water for use by the business and recommends a condition that allows a cistern and portable toilet for employees and clients. Responding to Chair Geile, Ms. Lockman stated improvements on the property include a residence and the subject shop for the business. She explained all of the employees live on site with the exception of the delivery man who will be required to use the portable system. She further stated the home has a permitted well, and it is unlikely that the applicant will be required to upgrade it to a commercial well. Trevor Jiricek, Weld County Department of Public Health and Environment, stated the Planning Commission authorized the use of a portable toilet; however,that does conflict with the County Code which requires permanent facilities. Don Carroll, Department of Public Works, stated Weld County Road 10 is a local road requiring 60 feet of right-of-way. He stated the right-of-way does exist and the road is maintained by the County. He further stated the road is paved,and the most recent traffic count indicated an average of 100 vehicles use the road per day, which is considered to be a low-medium traffic volume. f e /4 /f4 (E/O, ,GU 2001-0870PL1 04 HEARING CERTIFICATION - BRIGHTON INDUSTRIAL NORTH, LLP (USR#1314) PAGE 2 Steve Webb represented the applicant and stated the company purchased a Port-a-Potty,and has also contracted with Slim's Sanitation, Inc., to service and maintain the unit. He stated the water district expressed concern with using the residential well for the business. He stated they have purchased a portable container that holds 300 gallons of water which will be used for coolant of the grinding machines. Responding to Commissioner Long, Mr. Webb stated this operation will not be expanded beyond the limits of this permit. He added the property is for sale so he does not want to invest any unnecessary funds because they may have to relocate. Responding to Commissioner Vaad, Mr. Webb stated the Port-a-Potty is located on the north side of the property and it will be screened from the public right-of-way. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Brighton Industrial North, LLP, for a Site Specific Development Plan and Use by Special Review Permit#1314 fora Business(knife grinding shop)in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Jerke, and it carried unanimously. This Certification was approved on the 16th day of April 2001.
