HomeMy WebLinkAbout830861.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 597 - JAMES AND JOANN OAKLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 597, being the property of James and Joann Oakley, described as part of the Northwest a, Section 32 , Township 3 North, Range 68 West of the 6th P . M. Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, does not come within the purview of the defi- nition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the hereinabove described parcel of land owned by James and Joann Oakley be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) The applicant meet all requirements for site access on to Weld County Road #28 as prescribed by the Weld County Engineering Department; and 2) that the applicant submit a mylar plat to the Department of Planning Services ' Office to be recorded in the office of the Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations . The parcel of land on which this request is being made is described as part of the NW4f Section 32, T3N, R68W of the 6th P.M. , Weld County, Colorado. The property is located approximately 2.75 miles east of the town of Longmont adjoining the northeast corner of the Union Reservoir on Weld County Road 28. Applicant is requesting a recorded exemption to facilitate the creation of one additional legal parcel to be used for a single family dwelling site. The parcel, as it now exists, can have only one single family dwelling building per- mit issued. The recorded exemption will create two legal par- cels and allow the issuance of one more single family dwelling building permit. 2. The Weld County Comprehensive Plan has designated this area as agricultural. The five acre parcel which is the subject of this application, although it has always been zoned and treated as agricultural property, has not in recent years been used as farm land. The subject five acre parcel has approximately 800 to 1,000 feet of lake frontage along Union Reservoir. This lake frontage makes the subject property ideal for homesites . Creation of one additional homesite on this five acre parcel of land in an agricultural zone is not in- consistent with the Weld County Comprehensive Plan of promoting urban development near local municipalities. 3. The district in which the property is located is agricultural. Creation of one more legal parcel along lake front property will be consistent with the intent of the district. 4. Anticipated use of the new parcel is a single family dwelling. Recorded exemptions have been granted in this area for similar purposes and thus the use will be compatible with that of surrounding properties. 5. The only use to which the property is to be put is that of a single family residential dwelling unit. Current pro- jections for future use of surrounding properties indicate that development will proceed in the area of rural residential. The lake front properties are particularly suited for development of single family dwellings. 6. The creation of one more single family dwelling site within this five acre parcel will have no effect at all on the development of the area. The projected long term development of the area would have to be characterized as rural residential. The one acre residential site which is to result from this re- corded exemption is consistent with this development plan. The existing parcel and the proposed one acre parcel within it, both have access by an existing county road and electrical service is available to the site. This proposed recorded ex- emption will enhance the efficient development of the area. 7. The subject property is not within an overlay dis- trict. Oakley Case No. RE-597 O Co. Phnom ""rmmission Gentlemen: We have your February 25 , 1983 letter requesting a referral on the above case. Please be advised that Union Reservoir Company is opposed to the approval of the proposed recorded exemption. Union Reservoir Company finds the septic type sewer system unac- ceptable since effluent may drain into the reservoir because the natural slope of the land is towards the reservoir. The Company does realize that in the past it has not opposed the septic sewer systems , but the Company has recently had to take a stand to oppose this type of system as more and more owners are dividing up their land and building houses around the reservoir. The Company has recently opposed the sewer system of Mountain Shores Subdivision, proposed for north of the reservoir, since it proposed to discharge treated effluent into the reservoir and there was the possibility of failure of the sewer system and untreated effluent might be discharged into the reservoir. The County acknowledged the concerns of Union Reservoir Company and Mountain Shores Subdivision was directed to plan a system whereby the effluent would be piped around Union Reservoir. If effluent is allowed to drain into the reservoir, the Company has been informed that the current recreation lessee of the reservoir will terminate the lease. The Company must take every appropriate step in order to keep the recreation lease , which is the major source of income for the Company. By allowing recreation use of Union Reservoir, the Company considers it is helping to meet the increasing demand for recrea- tion areas and feels the County should take a position consistent with the modern demands for facilities providing recreation. The Company would therefore request that this application for recorded exemption be denied. Subject property is within the St. Vrain Valley Planning Area. The City has had no problem with Recorded Exemption that dealt with .family farms and agricultural activities. This clearly is not such a case. As stated by the applicant, they want to subdivide a parcel that is currently smaller than allowed by the zoning district for purposes of constructing a new dwelling. The test for evaluating an exemption to a code should be the uniqueness of the situation that clearly distinguishes the particular case. In other words, if an exemption is granted, what other properties in similar situations could apply for the same consideration. In the proposed case, we do not see the uniqueness between subject property and any other substandard parcel in any other zoning district.
