Morrison Planning Department Representative, Michael Mullen The following business was transacted: I hereby certify that pursuant to a notice dated April 18, 1984, and duly pub- lished April 19, 1984 and May 10, 1984, in the La Salle Leader, a public hearing was conducted to consider the application of Orville W. and Billie Jean Smith, for a Change of Zone fran R-5 (Mobile Home Park) and A (Agricultural) to C-4 (Commercial Four) . Lee Mbrrison, assistant County Attorney, read this request into the record and stated that, since this hearing had been continued from June 6 to allow the applicant to prepare and submit a revised plat, it would not be necessary to read the recommendation of the Planning Commission at this hear- ing. Mike Mullen, Planning Department representative, presented the Board with revised copies of the plat. Mr. Smith came forward to answer questions of the Board. Discussion was held about the changes which had been made in this re- quest. Mr. Mullen stated that the Planning staff is satisfied with the present application. Art Rebovich, a resident of the mobile home park opposed . to the re- zoning of the property, came forward and made ciuunents concerning the safety, security and health of the residents of the mobile home park. After considerable discussion, Commissioner C. Carlson moved to approve the Change of Zone from R-5 and A to C-4 for Orville W. and Billie Jean Smith. Commissioner Brantner seconded the motion. Mr. Mullen stated that the Planning Department recommended that Condition number 1 be amended to state, "Prior to recording the Change of Zone Plat, the applicant shall provide evidence of purchase of three (3) residential taps from the Left Hand Water Supply Company." Discussion was held about the conditions recuumended by the Planning Commission. Mr. Mullen stated that Condition number 3 has been satisfied and does not need to be included as a con- dition at the present time. Commissioners C. Carlson and Brantner agreed to amend the motion to include the amendment of Condition number 1 and the deletion of Condition number 3. DETERMINATIONS TO BE MADE BY THE BOARD OF COUNTY COMMISSIONERS ON CHANGE OF ZONE REQUESTS 21.6.2 The Board of County Commissioners shall hold a public hearing to consider the application and to take final action thereon. In making a decision on the proposed change of zone, the Board shall consider the recommendation of the Planning Commission, and from the facts presented at the public hearing and the information contained in the official record, which includes the Department of Planning Services case file, the Board of County Commissioners shall approve the request for the change of zone unless it finds that the applicant has not met one or more of the standards or conditions of Sections 21.6.2 and 21 . 7 (application requirements) . The applicant has the burden of proof to show that the standards and conditions of Sections 21.6.2 and 21. 7 (application requirements) are met. The applicant shall demonstrate: 21.6.2. 1 That the proposal is consistent with the policies of the Weld County Comprehensive Plan; if not, then that the zoning of the property under consideration is faulty, or that changing conditions in the area warrant a change of zone. 21.6.2.2 That the USES which would be allowed on the subject property by granting the change of zone will be compatible with the surrounding land USES. 21.6.2.3 That adequate water and sewer service can be made available to serve the site. If the rezoning is approved, the applicant shall demonstrate, prior to issuance of building permits on the site, that the water and sewer services are available at the site and are adequate and appropriate to meet the DEVELOPMENT requirements. 21.6.2.4 That STREET or highway facilities providing access to the property are adequate in size to meet the requirements of the proposed zone district. In the event that the STREET or highway facilities are not properly sized and are planned to be properly sized in the future, in conformance with the Weld County Thoroughfare Plan or in conformance with the MASTER PLAN of affected municipalities, the applicant may either wait to secure the rezoning until the improvements are made by the appropriate unit of government or the applicant may express a willingness to upgrade the STREET or highway facilities at his own expense in order to secure approval of the requested change of zone. In the latter event, it will be necessary for the applicant to either construct the necessary improvements before building permits are issued, or submit suitable performance guarantees to Weld County to ensure construction of the required STREET or highway facility improvements. No rezoning shall he finally approved by the Board until the applicant has submitted an Improvements Agreement or Contract approved by the Board which sets forth the form of improvements guarantees. Any such Agreement or Contract shall he made in conformance with the Weld County Policy on Collateral for Agreements. 21.6. 2.5 That, in those instances where the following characteristics are applicable to the rezoning request, the applicant had demonstrated compliance with the applicable standards: 21.6.2.5. 1 If the proposed change of zone is located within any Overlay District identified by maps officially adopted by Weld County, that the applicant has demonstrated compliance with the Weld County regulations concerning Overlay Districts. Compliance may be demonstrated in a previous public hearing or in the hearing concerning the rezoning application. 21.6.2.5.2 That the proposed rezoning will not permit the USE of any area known to contain a COMMERCIAL MINERAL DEPOSIT as defined by Colorado Statutes in a manner which would interfere with the present or future extraction of such deposit by an extractor to any greater extent than under the present zoning of the property. 21.6.2.5. 3 If soil conditions on the site are such that they present moderate or severe limitations to the construction of STRUCTURES or facilities proposed for the site, the applicant has demonstrated that such limitations will be addressed by the applicant, the applicant's successors or assigns prior to DEVELOPMENT of the property. Improvements on the property include a twenty-two (22) space mobile home park with a residence and three (3) garages. Twenty-one (21) mobile homes, four (4) motor homes and one (1) travel trailer occupy the mobile home park; one (1) of the motor homes and the travel trailer were connected to utilities. Three (3) access points serve the mobile home park: two (2) from State Highway 52 and one (1) from County Line Road (a paved road) . The Smith property is relatively flat. As you described it, the tract measures 150ft. by 700ft., extends north from Highway 52, and adjoins property already zoned for mobile homes. This tract lies on high- quality but relatively thin flood-plain gravels , as shown on our aggregate • resources map of the Erie quadrangle. A number of gravel pits have operated along this stretch of Boulder Creek, both to the southwest and to the northeast of this property. Due to the very small size of this tract and the awkward configuration, I do not believe the underlying sand and gravel could be feasibly extracted. The property-line setbacks for the pit alone would reduce the already small acreage to an unminable amount. Therefore, I would not consider the tract to represent a commercial mineral deposit as defined bj State statute. I hope this information will meet your needs.
