The water permit will be dealt with when the new property owner applies for a building permit. A private well will have to be drilled into the Fox Hills Aquifer. b. This property is located in the Henrylyn Irrigation District and at this time,approximately 3 acre ft of water rights per year would transfer with this property. 2. SEWAGE DISPOSAL This parcel of land will require an individual septic system. There is no building permit being applied for at this time. It is being sold as vacant land. The future owner will apply for a septic system permit through the Weld County Health and Environment. We have contacted Alpha Engineering to survey the property and do the necessary reports pertaining to these issues once the application has been accepted by Weld County Planning& Zoning. 3. PROPERTY USAGE At this time almost 140 irrigatable acres are being farmed with rotating irrigation crops. Their is an old home on a small acreage on this 1/4 section of ground that is currently raising livestock. This small farm is owned by someone else and has been there for many years. It is on a private well and septic system. Their farm is approximately 10 acres. There is a long strip of ground on the north side of the 140 irrigatable acres that doesn't get as much water as the rest of the crops and the soil is extremely sandy in this area. Most years, this long section of crops ends up being plowed back into the ground. This is where the proposed 10 acre lot will be. 4. PROPOSED EXEMPTION RATIONAL The reason this land has been chosen for the exemption application is because this parcel doesn't do as well as the rest of the acreage for raising crops. It does not produce well and would be better suited for another use. This soil would be better for raising a little native grass or hay for livestock such as cattle or hones. The proposed buyer plans on raising hones and hopes to grow some native grass. 5. DESCRIPTION OF PROPOSED NEW LOT The proposed lot would run most of the width of the north side of the irrigated 1/4 section of land. The proposed lot would run 1500+/- acres on the North along Weld County Road 20 and 290+/-on the East and West sides of the property. The property would start on the East side at the edge of the 1/4 section. There is already electricity and an entrance on Weld County Road 20 on the East end of the property. 0 6. UNIQUE PHYSICAL CHARACTERISTICS The property is sandy and has water rights at this time. There is electrical power available at the property. The property would be long and narrow. 7. SETBACK AND OFFSET REQUIREMENTS There are no existing structures on the property. The proposed property is being split off and sold as vacant land. The future owner will have to comply with Weld County and be issued a building permit and the structures will have to meet the requirements set by Weld County. 8. CONSERVATION EASEMENT A conservation easement is not applicable to this application. The land will be sold to another party who will determine how the land will best fit his or her needs. 9. BUILDING ENVELOPE Due to the limited entrances to the ground, a building envelope would be hard to establish without interfering with taking up prime farm ground. 10. CONSISTENCY W/WELD COUNTY ZONING AND MUNICIPAL PLANS The proposed exemption is consistent with the Weld County goal to preserve farmland for agriculture purposes, which foster the economic health and continuance of agriculture. The land is not well suited for irrigation crops because of circumstances beyond the owner's control and can be converted into a property more suited for the type of conditions on that particular area of land. This land can be far more beneficial than it is now if it is sold as a livestock, horse, and small farm property. The soil is more conducive to Hay or grazing grass than rotating irrigation crops. The creation of the proposed lot can provide an agriculture/rural lifestyle for a single family and an opportunity for youth 4-H ag/livestock involvement and projects. 11. COMPATIBILITY WITH EXISTING SURROUNDING LAND USES There is a livestock farm on Weld County Rd 20 across from the proposed parcel and there is a livestock farm on Weld County Rd 59 just across a few acres from the Southwest corner of the proposed lot. These three properties would all be consistent with each other. 12. CONSISTENCY WITH WELD COUNTY SUBDIVISION ORDINANCE This proposal preserves the land as agricultural and promotes its most beneficial use...agriculture, agrarian, livestock, pastures, alfalfa, pastures, etc.... 13. SOILS/LIMITATIONS : The soils found on this parcel are classified as Olney loamy sand on 1-3% slopes . This is a deep, well drained soil having moderate permeability. Water holding capacityis moderate and plants will root to 60 inches . This soil has minor limitations for building construction but has moderate to severe limitations for septic systems due to restricted permeability. Cut banks will have a tendency to cave . PRIME FARMLANDS : The Olney loamy sand soil is not considered "prime" even when irrigated. SOIL EROSION POTENTIAL: Runoff is slow with a low potential for water erosion but there is a high potential for wind erosion. This soil should not be left bare during the critical wind erosion periods, Nov 1 through May 1 .
