RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING SPECIAL
REVIEW PERMIT#768 FOR A RECREATIONAL TRAIN FACILITY IN THE A
(AGRICULTURAL) ZONE DISTRICT - BEVERLY HOBDAY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 16th day of April, 2001, a Probable Cause Hearing was held before
the Board to consider setting a Show Cause Hearing to determine whether or not Beverly
Hobday, 140 South Wood Dale Road #106, Wood Dale IL 60191, is in compliance with certain
Conditions of Approval and Development Standards contained in Use by Special Review Permit
#768 for a Recreational Train Facility in the A (Agricultural) Zone District, and
WHEREAS, the issues of noncompliance are said to be occurring on property described
as part of the SE1/4 of Section 30, and part of the E1/2 E1/2 of Section 31, all in Township 2
North, Range 65 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, after hearing testimony from the Planning Department, an other parties
directly involved in this matter, the Board deems it advisable to continue this matter for two
months to allow all concerned parties to come to agreement regarding ownership of said
property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Probable Cause Hearing regarding Use by Special Review
Permit#768 issued to Beverly Hobday, be, and hereby is, continued to June 18, 2001, at 9:00
a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 16th day of April, A.D., 2001.
