HomeMy WebLinkAbout840822.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 712 - EUGENE AND ELWIN HAGANS WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 712 , does not come within the purview of the definition of the terms , "sub- division" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 712 was sub- mitted by Eugene and Elwin Hagans for property which is located in Part of the SWa, Section 12 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado , being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , the request is to divide the property into parcels estimated to be approximately 138 acres and 1 acre in order to allow the applicants to sell the larger parcel. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the hereinabove de- scribed parcel of land be, and hereby is , exempt from the defi- nition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a revised mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The parcel of land on which this request is being made is described as part of the SW14, Section 12, T2N, R66W of the 6th P.M. , Weld County, Colorado. The property is located 5 miles northeast of Fort Lupton on Weld County Road 22. The property contains approximately 138.973 acres of Class IIe (prime) IIIe IVe and Vie irrigated and IVe VIe nonirrigated soils. The parcel of land under consideration is not the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 137.97 acres and 1.003 acres, more or less. The applicants propose to separate their residence from the farmland. They propose to sell the farmland and the other residence for financial reasons. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1 . The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The request complies with Section 9-2E. of the Subdivision Regulations as follows: The 138.973 acres, more or less, under consideration will be compatible with the existing surrounding land uses and with future development of the surrounding area as permitted by the existing Agricultural Zone. The proposal is also consistent with the intent of the Agricultural Zone District in which it is located. /- JJ�� tt ?; Board of County Commissioners Page 2 - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from Weld County Road 22. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a revised mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. Our father, Vern Hagans, acquired the farm in 1940 and in 1954 created a three way partnership with Elwin and Eugene, his sons. A two way partnership was formed in 1975 after we purchased the farm from our parents. We are requesting the following divisions of our family farm due to economical situations, health and ages of ourselves and our parents, who have a life estate in the original farmstead dwelling. We own the southwest quarter and the southeast quarter of Section 12, T2N, R66W of the 6th P.M. , Weld County, Colorado. The divisions are: 1. The area west of the Speer Canal has been determined a legal split from the remainder by virtue of ditch separation. 2. The SE4 of said Section 12 will be marketed separately. The remainder of the SW4 contains the dwellings of our parents and each of ourselves, which we would like to divide as follows: 1. Our two dwellings on two parcels containing one to two acres each. 2. The dwelling of our parents will remain with the farm. The marketing of the parcel west of the Speer. Canal and the SE quarter will help our financial situtation and the parcels do not contribute to nor take away from the function of the remaining parcel which is partially irigated. Our homes are currently supplied by a domestic well and each have their own septic systems as per county health department standards. Our parents home is on a separate domestic well and septic system.
