RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST LOU SPILMAN FOR VIOLATION OF THE WELD COUNTY
ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Lou Spilman, VI #9900339, is allegedly in violation of the Weld County
zoning Ordinance, and
WHEREAS, on the 13th day of February, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Mike Spilman and Madeline Hall, representatives, were present at said
hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until May 13, 2001, to allow adequate time for the property owner to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said VI #9900339 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Lou Spilman to remedy the violation of the Weld
County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until May 13, 2001, to
allow adequate time for the property owner to bring the subject property into compliance.

The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties .

Dear Mrs. Spilman:
The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code,
Specifically Chapter 23:

Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.F "MOBILE HOME subject to the additional requirements of Article IV, Division 3 of this Chapter."

Chapter 23,Article IV, Div 3 "Mobile Homes"
Section 23-4-130 "No MOBILE HOME may be located or relocated in the County after August 25, 1981,except in
accordance with this Division,including the issuance of any zoning permit which may be required by this Section. Each
MOBILE HOME located or relocated in the County after said date must have a BUILDING permit for a MOBILE HOME
issued pursuant to Chapter 29 of this Code. An application for any zoning or building permit for a MOBILE HOME
required by this Division shall include the following:"
After reviewing your faxed copy of the Zoning Permit for a Mobile Home "ZPMH" application with Wendi
Inloes, Planning Technician II, it was determined that the present state of your application is unacceptable.
Wendi has highlighted the items that need to be specifically presented in order for your application to be
accepted. Unfortunately, for this to occur we would recommend that you present the whole and complete
packet in person to ensure no future misunderstandings. Also please be advised that since these "Medical
Hardships"are reviewed annually and currently the only letter that we have in our file from your doctor is dated
October 4, 2000, it would be in your best interest to go ahead and have your doctor submit a current letter.
Please also be advised that this does NOT change the already scheduled violation hearing for February 13,2001
at 10:00 a.m. The hearing is indeed still scheduled to be heard before the Board of County Commissioners.

Dear Mrs. Spilman:
The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Zoning Ordinance. Currently your property is in violation of the following Section(s) of the Weld
County Zoning Ordinance:
31.3.9 "Noncommercial Junkyard"consisting of derelict vehicles, wood, metal,scrap iron,appliances,derelict trailers,
tires, trash,and miscellaneous debris.
Definitions:
DERELICT MANUFACTURED (MOBILE) HOME: A MANUFACTURED (MOBILE) HOME that is partially or totally
damaged by fire, earthquake,wind, or other natural causes,or is in a state of general dilapidation,deterioration,or
decay resulting from improper lack of maintenance, vandalism, or infestation with vermin or rodents. Any such
DERELICT MANUFACTURED (MOBILE) HOME shall be returned to and maintained in the condition as originally
established on site and as inspected by the Weld County Building Inspection Department,or it shall be removed from
the site.
To bring your property into compliance with the Weld County Zoning Ordinance:
The"Noncommercial Junkyard"must be removed or screened from all adjacent property owners and public rights-of-way.
The derelict mobile home shall be removed or restored to its original condition,if you choose to restore the mobile home •
an additional building permit and a zoning permit must be obtained. Please be advised that I am sending this 30(thirty)
day extension based on a request from your daughter. As I informed her, this will be the last extension that I will be able
to grant.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;however, we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from , December
26,2000,to correctthis zoning violation. Failure to do so will result in this office scheduling the violation before
the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office
for legal action.

The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Zoning Ordinance. Currently your property is in violation of the following Section(s)of the Weld
County Zoning Ordinance:
31.3.9 "Noncommercial junkyard"consisting of derelict vehicles,scrap iron,metal,appliances,2 derelict trailers,wood, ,TALL
tires and miscellaneous debris.
32.6.2.1 OneMOBILE HOME,MANUFACTURED HOME,OR SINGLE FAMILY DWELLING per LEGAL LOT. TheMOBILE
HOME, MANUFACTURED HOME, OR SINGLE FAMILY DWELLING shall be connected to and served by a PUBLIC
WATER system and a PUBLIC SEWER system. This requirement does not apply to any LEGAL LOT created prior to the
enactment date of this Ordinance.
Definitions:
DERELICT MANUFACTURED (MOBILE) HOME: A MANUFACTURED (MOBILE) HOME that is partially or totally
damaged by fire, earthquake, wind, or other natural causes, or is in a state of general dilapidation, deterioration, or
decay resulting from improper lack of maintenance, vandalism, or infestation with vermin or rodents. Any such
DERELICT MANUFACTURED (MOBILE) HOME shall be returned to and maintained in the condition as originally
established on site and as inspected by the Weld County Building Inspection Department,or it shall be removed from
the site.

43.1.1 "No mobile home may be located or relocated in Weld County after August 25, 1981,except in accordance with
Section 43,Mobile Homes.of this Ordinance,including the issuance of any zoning permit which may be required by that
Section. Each mobile home located or relocated in Weld County after the effective date of this Section must have a
Building permit for a mobile home issued pursuant to the Weld County Building Code Ordinance. An application for any
zoning or building permit for a mobile home required by Section 43 shall include the following:"
43.2.4.1 "A zoning permit for the temporary use of a mobile home during a medical hardship on a lot in the A
(Agricultural) District, in addition to the principal dwelling unit,may be issued by the Department of Planning Services
upon a determination that:"...

Lou Spilman is in our clinic today requesting a letter addressing the issue below.
Mrs Lou Spilman is an 80 year old patient of Brighton Medical Clinic since 1995.
Medical conditions consist of Hypertension, CAD, Parkinson's Disease, Hypothyroidism.
She currently lives in Fort Lupton. Her son, Mike Spilman, is helping Mrs Spilman care
for the house, the land, and Mrs Spilman herself. In doing so, Mr. Mike Spilman's
Mobile Home is parked in the patient's land of residence.

The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.

to the Weld County Individual Sewage Disposal
2. Prior to recording the plat:
A. In accordance with Weld County Public Works Ordinance #180, Lot A shall be granted one
residential/agricultural access. Lot B shall utilize the existing residential/agricultural access point. No circle
drives or additional accesses shall be granted. The access will be placed in such a location to have
adequate sight distance in both directions and not below the crest of a hill or where physical obstructions
are present These roads will be graded and drained to provide all weather access.
B. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County
Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage
culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger
culvert, please contact the Public Works Department to adequately size your culvert.
C. The applicant shall attempt to address the requirements of the Platte Valley Soil Conservation District as
stated in a referral response received September 29, 1999.
D. WCR 35 is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of
right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld
County.

The plat shall be delineated to show 30 feet right-of-way from center line.All derelict vehicles located on the property must be in running condition with current license plates, or be
screened from all adjacent properties and public rights-of-way, or be removed from the property. All other
items considered to be a part of a noncommercial junkyard must also be removed from the property or
screened from all adjacent properties and public rights-of-way. The property is in violation of the Weld
County Zoning Ordinance. The applicant shall schedule a final inspection with Vickie Brown, Weld County
Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with the Weld
County Zoning Ordinance.

•F.N The applicant shall submit evidence to the Department of Planning Services verifying that the occupant of
the mobile homes permitted by MHP-993 and ZPMH-748 (2nd Accessory to the Farm) for temporary
accessory farm use is principally employed at or engaged in the farming operation on the subject property,
in accordance with Section 43.2.3 of the Weld County Zoning Ordinance. The evidence shall consist of
tax records, employment agreements or other documentation as determined suitable by the Department
of Planning Services. Failure to submit the required documentation may result in cessation of the allowance
of the mobile home for temporary accessory farm use.
G. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (Ordinance 89, as amended),the required setback is measured from the
future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3) Prior to the issuance of a building permit on Lot A of the recorded exemption, the applicant for the
building permit shall be required to submit to the Department of Planning Services, evidence that
the lot(s) has (have) an adequate water supply of sufficient quality, quantity and dependability.
4) Prior to the release of building permits on Lot A or B, the applicant will be required to submit a
recorded deed describing the lot upon which the building permit is requested with the building permit
application. The legal description on such deed shall include the lot and recorded exemption
number.
5) Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant to Ordinance 169A. -
6) All mobile homes as accessory farm uses are temporary. Allowance of the mobile homes shall be
extended only if the use continues to be in conformance with the criteria set out in Section 43.2.3.1.1
of the Weld County Zoning Ordinance. The mobile homes shall be removed from the property upon
the cessation of the use of the mobile home as an accessory farm use or at any such time as the
mobile home is used for other than the allowed use.
7) RIGHT TO FARM COVENANT
Weld County is one of the most productive agricultural counties in the United States. The rural
areas of Weld County may be open and spacious, but they are intensively used for agriculture.

Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural
activities will generate off-site impacts, including noise from tractors and equipment; dust from
animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and
manure; smoke from ditch burning;flies and mosquitoes; the use of pesticides and fertilizers in the
fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved"out of
the way" of residential development without threatening the efficient delivery of irrigation to fields
which is essential to farm production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware)
with more than 3,700 miles of state and county roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is based on
responses to complaints more than on patrols of the county and the distances which must be
traveled may delay ail emergency responses, including law enforcement, ambulance, and fire. Fire
protection is usually provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed,will not provide the same
kind of surface expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow
removal for roads within subdivisions are of the lowest priority for public works or may be the private
responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to
municipal services,

center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and

The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code,
Specifically Chapter 23:

Chapter 23,Article IV, Div 3 "Mobile Homes"
Section 23.4130 "No MOBILE HOME may be located or relocated in the County after August 25, 1981,except in
accordance with this Division,including the issuance of any zoning permit which may be required by this Section. Each
MOBILE HOME located or relocated in the County after said date must have a BUILDING permit for a MOBILE HOME
issued pursuant to Chapter 29 of this Code. An application for any zoning or building permit for a MOBILE HOME
required by this Division shall include the following:"
After reviewing your faxed copy of the Zoning Permit for a Mobile Home "ZPMH" application with Wendi
Inloes, Planning Technician II, it was determined that the present state of your application is unacceptable.
Wendi has highlighted the items that need to be specifically presented in order for your application to be
accepted. Unfortunately, for this to occur we would recommend that you present the whole and complete
packet in person to ensure no future misunderstandings. Also please be advised that since these "Medical
Hardships"are reviewed annually and currently the only letter that we have in our file from your doctor is dated
October 4, 2000, it would be in your best interest to go ahead and have your doctor submit a current letter.
Please also be advised that this does NOT change the already scheduled violation hearing for February 13, 2001
at 10:00 a.m. The hearing is indeed still scheduled to be heard before the Board of County Commissioners.

1 . I understand that mobile home will meet all of the following. Please initial each statement
indicating that you have read and will comply with the following:

use in the Agricultural Zone District.

in the Agricultural Zone District requires a zoning permit to be approved by
the Department of Planning Services or the Board of County Commissioners.
I understand that all zoning permits for mobile homes are temporary. I also
understand that the mobile home shall be removed from the property upon
cessation of the use of the mobile home as an accessory to farm use.
d. The mobile home is necessary for the effective and economic operation of
the use and/or protection of the associated agricultural use;
e. The mobile home will not be used as an income source by the applicant for
rental to persons not principally employed by the applicant;
f. The mobile home will be serviced by an adequate water and sewage
cisposal facility;
g. The mobile home used an accessory to farm is not the first dwelling unit on
the parcel of land;
J h. The mobile home as accessory farm use is temporary. The mobile home will
be removed upon the cessation of the use of the home as an accessory farm

must comply with the Weld County Uniform Building Code.
