RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST DAVID AND TRACEY BUTLER FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, David and Tracey Butler, VI #0000203, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 20th day of March, 2001, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, David and Tracey Butler were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
as hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against David and Tracey Butler to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.

November 2, 2000 Letter sent to property owner indicating that the violation
case was scheduled before the Board of County Commissioners.
The is a violation of Section 83 of the Weld County Building Ordinance. Septic,
electric, plumbing, permanent meter, final approval, and certificate of occupancy
remain to be completed. To close this violation, inspections need to be
completed.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

Dear Mr. & Mrs. Bulter:
The property located at 39553 WCR 51 remains in violation of the Weld County Building Code Ordinance. Your
property is in violation of Section 83 of the Weld County Building Ordinance. I have scheduled a meeting with the
Board of County Commissioners on November 14, 2000 at 10:00 a.m., to consider the violations occurring on the
property. This meeting will take place in the County Commissioners' Hearing Room, first floor, Weid County
Centennial C enter,915 Tenth Street, Greeley, Colorado. It is recommended that you and/or a representative be in
attendance to answer any questions the Board of Commissioners might have concerning this violation. This hearing
would give you an opportunity to explain all issues regarding this violation. By making contact with me prior to this
hearing to acknowledge your willingness to comply with this matter, we will not proceed with the hearing. If no
contact is made, we will proceed with the hearing.
The Department of Planning Services'staff will be recommending the Board of County Commissioners authorize the
County Attorney to proceed with legal action to remedy the violation if you and/or a representative are not available.
Our records Indicate that you were made aware of the nature of this violation, the action necessary to correct the

The building official has determined that the property at 39533 WCR 51 is in violation of Sections 70.5.1
and 83 of the Weld County Building Ordinance. Certificate of Occupancy and expiration of Permit
inwhich every permit issued by the building official under the provisions of this code shall expire by
limitation and become null and void if the building or work authorized by such permit does not
commence within 180 days from the date of such permit, or if the building or work authorized by such
permit is suspended or abandoned at any time after the work is commenced for a period of 180 days. The
Weld County Building,Ordinance requires that all building permits be completed within 180 days after
the permit is issued or continuation of work be conducted during the 180 day period. Permit
BC-9600472 expired August 20, 1998.
- It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter. If you fail to correct this violation by August 13, 2000, it
will be scheduled for a hearing before the Board of County Commissioners to consider whether to refer
this violation to the County Attorney's office for legal action.

of any assistance in clarifying or answering questions concerning this matter. Please call or write the

I am writing this letter in reference to building permit BC-9600472 that has been issued to you. Our
records indicate that there has not been any work activity within the last 180 days since the last inspection.
This is a friendly reminder that all permits issued by the building official under the provisions of Secion 83
of the Building Code Ordinance, are required to be have regular inspections conducted within 180 days of
issue or from the time of your last inspection. Your building permit has exceeded the time period allowed
and if not completed in a timely manner, a violation will be issued for this permit. in which it may be
scheduled for a hearing with the Board of County Commissioners, and if necessary,referred to the County
Attorney's Office to proceed with legal action. We encourage you to complete all necessary inspections or
contact our office with a status of completion on your building permit before 4/19/2000 to avoid receiving
a violation. We also ask that you please call us regarding any difficulties you may encounter with
completing all necessary inspections.
It is not necessary for you to contact me personally to schedule the inspection(s) when ready. Our 24 hour
inspection request line number is 356-8016 or 1-800-234-2534. If you call before 4:00 P.M. You may
schedule the inspection(s)for the next working day. Please make reference to your name,building permit
