HomeMy WebLinkAbout20010256.tiff HEARING CERTIFICATION DOCKET NO. 2001-09 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1308 FOR A KENNEL IN THE A (AGRICULTURAL) ZONE DISTRICT - ROSE ZESCHIN A public hearing was conducted on February 21, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tern Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Robert Anderson Health Department representative, Pam Smith Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated February 2, 2001, and duly published February 7, 2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Rose Zeschin for a Site Specific Development Plan and Use by Special Review Permit#1308 for a Kennel in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Robert Anderson, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Anderson gave a brief description of the location of the site, which is 4.68 acres in size. He stated improvements on the site include a single family dwelling, outbuildings, pens, fencing, and mature landscaping. He further stated surrounding uses are agricultural in nature and include a small irrigation pond, ditch, utility substation and U.S. Highway 85. Mr. Anderson stated four referral agencies responded with concerns, and five indicated no conflicts. He further stated staff and the Planning Commission recommend approval for the reasons listed in the Planning Commission Resolution. Responding to Chair Geile, Mr. Anderson clarified his verbal presentation should have indicated the new references from the Weld County Code. Responding to Chair Geile, Mr. Morrison stated Exhibit 19 should be removed from the file because it does not pertain to this case. Mr. Anderson added the referral response from the Town of Platteville expressed no concerns. Mr.Carroll stated the main access is from Weld County Road 28 which is a local gravel road. He stated the traffic count conducted on August 12, 1999, indicated 103 vehicles per day on Weld County Road 28. He further stated there are two existing driveways, and staff recommends both driveways be utilized as one-way ingress and egress. Mr. Carroll explained there is a mature cedar grove located between the driveways,and he recommends the applicant use the western driveway as an entrance, and use the gravel driveway as an exit because it has a better sight distance. He stated these issues are addressed by Conditions of Approval #3.A and #3.B. 2001-0256 PL1472 PC'. PL HEARING CERTIFICATION - ROSE ZESCHIN (USR #1308) PAGE 2 Rose Zeschin, applicant, stated she and the operator of the proposed dog kennel have done a lot of work and have met almost all of the conditions, so they are ready to start. Responding to Commissioner Jerke, Ms. Zeschin stated they will be a boarding facility only, no breeding will be allowed at the site. Responding to Chair Geile, Ms. Zeschin stated there is a barn that will only house 25 to 30 dogs; however, in order to board more than 30 dogs,as indicated in the application, they will be required to build an additional structure. Mr. Morrison stated the Use by Special Review Permit allows the applicant 50 animals and additional structures will only require the necessary building permits. However, if the operation exceeds 50 animals, the applicant will be required to amend this permit. Responding to Chair Geile, Ms. Zeschin stated she has reviewed and agrees with the Conditions of Approval and Development Standards. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Rose Zeschin for a Site Specific Development Plan and Use by Special Review Permit #1308 for a Kennel in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Jerke, and it carried unanimously. This Certification was approved on the 26th day of February 2001.
