HomeMy WebLinkAbout20011565 RESOLUTION RE: APPROVE CORRECTION TO PLANNED UNIT DEVELOPMENT PLAT, S #591 - CENTER FOR ATHLETIC PERFORMANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 11th day of June, 2001, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of the Center for Athletic Performance for a correction to the Planned Unit Development Plat for the First Filing, Vista Commercial Center, S #591, to relocate a drainage and utility easement, on the following described real estate, to-wit: Lots 3, 4, 13, 14, and Outlot D, Block 2, Vista Commercial Center being part of the S1/2 of Section 8, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, Section 27-8-40.D of the Weld County Zoning Ordinance describes the procedure for correcting a Planned Unit Development Plat, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Department and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: a. Section 27-7-40.D.2.a --The proposed Planned Unit Development Final Plan is consistent with all the applicable chapters of the Weld County Code. The proposed relocation of a drainage and utility easement does not substantially change the subdivision. Comments made by the Mountain View Fire Protection District refer to the proposed use of the lots and not the relocation of the drainage and utility easement. Mountain View's comments are addressed in Site Plan Review#332 for the proposed athletic training center. Further, the site is not influenced by any intergovernmental agreements. b. Section 27-7-40.D.2.b—The uses which will be allowed in the proposed Planned Unit Development will conform with the performance standards of the Planned Unit Development Zone District contained in Article II, Chapter 27 of the Weld County Code. The proposal does not affect the performance standards as approved by the Board of County Commissioners for the original Vista Commercial Center Final Plan. c. Section 27-7-40.D.2.c--The uses which will be permitted will be compatible with the existing or future development of the surrounding area as permitted by the existing zoning, and with the future development as projected by Chapter 22 of the Weld County Code or master plans of affected municipalities. The Towns of Frederick and Firestone did not respond to the referral request. The Town of Mead reviewed this proposal and indicated no conflicts. The City of Longmont did not comment on the relocation of the utility and drainage easement; however, it did voice objection to the proposed athletic facility to be constructed on the site. A note on the plat has been required to indicate the existing composting facility and landfill as requested by City of Longmont planners. The proposed recreational facility is currently being reviewed under Site Plan Review#332. d. Section 27-7-40.D.2.d -- Adequate water and sewer service will be made available to the site to serve the uses permitted within the proposed Planned Unit Development in compliance with the performance standards in Article II, Chapter 27, of the Weld County Code. The site will be serviced by the Left Hand Water District and St. Vrain Sanitation District. e. Section 27-7-40.D.2.e -- Street or highway facilities providing access to the property are adequate in functional classification, width, and structural capacity to meet the traffic requirements of the uses of the proposed Planned Unit Development Zone District. The proposal does not affect transportation facilities. f. Section 27-7-40.D.2.f— In the event the street or highway facilities are not adequate, the applicant shall supply information which demonstrates the willingness and financial capacity to upgrade the street or highway facilities in conformance with the Transportation Sections of Chapters 22, 24, and 26, if applicable. The proposal does not affect transportation facilities. g. Section 27-7-40.D.2.g — Issues regarding overlay districts, commercial mineral deposits, and soil conditions were addressed during the original Final Plan, S #408. h. Section 27-7-40.D.2.h —The proposed PUD Final Plan uses are compatible with the criteria listed in the developmental guide. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a correction to Planned Unit Development Plat for the First Filing, Vista Commercial Center Planned Unit Development Final Plan, S #591, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording the Planned Unit Development Final Plat: A. The applicant shall submit a digital file of all drawings associated with the Final Plat application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are .shp (Shape Files), Arclnfo Coverages and Arclnfo Export files format type is .e00. The Final Plat is conditional upon the following and each shall be placed on the Final Plat as notes prior to recording: A. Lot owners should be informed that the City of Longmont has an existing composting facility east of Vista Commercial Center. The facility occasionally emits odors that are within State and County guidelines, but that may nevertheless be found offensive. B. Lot owners should be informed that the City of Longmont owns a landfill directly south of Vista Commercial Center. C. Installation of utilities shall comply with Section 24-9-10 of the Weld County Code. D. The site will be serviced by the Left Hand Water District and St. Vrain Sanitation District. E. The applicant shall obtain a Storm Water Discharge Permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment, if required. Silt fences shall be maintained on the down gradient portion of the construction phase of the project. F. During development of the site, all land disturbance shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Department of Public Health and Environment, a Fugitive Dust Control Plan must be submitted. G. In accordance with the Regulations of the Colorado Air Quality Control Commission, any development that disturbs more than 5 acres of land must incorporate all available and practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. 1) If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a Fugitive Dust Control Plan, submit an Air Pollution Emissions Notice, and apply for a permit from the Colorado Department of Public Health and Environment. H. Effective December 1, 1999, Building Permits issued on the lots will be required to adhere to the fee structure of the Southwest Weld Road Impact Program Area 1. This would place Outlot D between Lots 2 and 3, and Lots 14 and 15 of the captioned subdivision. Lots 5 and 12 are not affected by the resubdivision. Outlot D is owned by the developers of Vista Commercial Center and is considered common open space, satisfying the open space requirements agreed upon by the developer and Weld County Commissioners. I understand that the Planning Department encourages the vacation of the lot lines between the subject lots thus creating one large lot. The owners would prefer not to do this for the following reasons: 1. They would like to maintain the same number of lots in case for some reason the Center for Athletic Performance does not become a reality. 2. In the event that in the future the Center is relocated, the owners have the option to dismantle the structure and parking lot and sell the lots individually. The owners feel that selling one large lot may be more difficult than selling six smaller lots. The only way the owners would agree to platting the six lots into one large lot is with the understanding that they would be allowed to replat and change it back to six lots in the future if they so desired. An original and 24 copies of the final plat application form is submitted with this packet. 2. A copy of the title commitment is included with this packet. 3. Vista Commercial Center, Filing 1, was filed August 1997 under Reception No. 2566006 of Weld County Records. Filing 1 is comprised of 76.2 acres and is located between Weld County Roads 5 and 3%2. Its intended use is I-1 and C-3 under Weld County's PUD approval. The lots to be used for the Center for Athletic Performance (Lots 3, 4, 5, 12, 13, and 14, of Block 2) are a part of this subdivision. The uses intended are compatible with the uses in the Weld County MUD. 4. The concerns identified in the preliminary plan application process for Vista Commercial Center were addressed prior to approval by the Board of County Commissioners. Any concerns identified in the Center for Athletic Performance (CAP) were addressed by RNL Design's submittal dated December 26, 2000, a copy of which is included. 5. The number of lots proposed by the 2"d replat is four lots, Lots 3, 4, 13, and 14, Block 2, plus Outlot D. The area for each lot remains the same. The only reason for this replat is to move Outlot D to the east side of Lots 3 and 14, Block 2. Outlot D does not belong to the owners of the CAP. It was designed to satisfy the green belt requirements and is therefore retained by the Owners of the development. Consequently, in order to build their facility on the six lots that they own, Outlot D needs to be moved. 6. Our replat does not change the circulation system established in Vista Commercial Center, Filing 1, nor does it change: sidewalk widths, road widths, type and depth of road surface, curb and gutter, valley pan, width and depth of borrow ditches, and/or the vehicle parking arrangement. 7. No on-street parking is proposed nor will it be permitted. 8. Vista Commercial Center, Filing 1, contains approximately 9 acres of common open space. The primary location is along Highway 119. Much of the landscaping is complete. As previously stated, the outlots located in each block are also designated as open space. In the south center there is an existing pond and park area. The pond will act as an irrigation reservoir to irrigate green belt areas. No school site was required as Vista Commercial Center is non-residential. 9. Vista Commercial Center is a subdivision which provides detention for the entire subdivision located along its northern boundary adjacent to Highway 119. Therefore, individual lot owners are not required to provide detention on their property,but are to collect and convey their stormwater to the side ditches of the adjacent roadways. In this case, Vista View Drive is the destination of your stormwater runoff as your site plan indicates. It appears that the 10-year storm and the 100-year storm peak runoff rates will be 34.7 cfs and 54.8 cfs, respectively. This reflects the total runoff from your site which will be conveyed in more than one location according to the site plan. Upon development of the final grading plan we will provide specific recommendations for the adequate conveyance of this stormwater runoff to the aforementioned roadside ditches. Upon my review and understanding of your site plan,and since we will be developing construction documents for this project,we are certain that stormwater will be conveyed adequately according to the developments requirements. The applicant proposes to build an athletic facility on six lots at Vista Commercial Center on the south side of SH 119. The City of Longmont feels this proposal is contradictory to multiple sections of the Longmont Area Comprehensive Plan(LACP). The specific sections will be noted as applicable in the following concerns. The City of Longmont Composting Facility is located just east of Vista Commercial Center. The facility occasionally emits odors that are within State and County guidelines, but that may nevertheless be found offensive. Policy 23.4 of the LACP recommends minimizing exposure to unpleasant odors. Because the applicant did not reply to the City's comment regarding potential odors, the City would recommend adding a note to the Final Plat acknowledging the proximity of the composting facility and the potential for odors to be emitted, The City of Longmont would also like the applicant to be aware that the City owns a landfill, located just south of Vista Commercial Center, that is no longer in operation. As Weld County is aware, the City completed work in 2000 to contain any methane gas that may be generated from the landfill. The City understands this will be a 139,000 square foot air supported structure that is 95 feet in height at its peak. The City remains concerned with the visual impact it will have on the surrounding area. The sheer size will dominate the commercial center, and will be a prominent feature along SH 119 and the entryway to Longmont. The structure will be taller than any other building in the City of Longmont. The City feels the architecture of the structure is objectionable and incompatible with the surrounding commercial center's architectural style. RPR.25.2001 12:54PM N0.632 P.3 n n Strategies 3.11 and 3.13 of the LACP advise the City to promote high-quality development while encouraging developers to address aesthetic considerations in designing and planning their projects. Goal 7 of the LACP promotes an attractive appearance and quality urban design in Longmont. This goal is supported by Strategies 7.11 and 7.14 that commit to developing an urban design program that establishes the scope of the City's efforts to improve its appearance and prioritizes areas in need of attention, encourages and sponsors programs that promote the beautification of the City. The City understands that the uniqueness of the structure's shape and size is exactly what makes it more valuable to its proponents. The City is concerned about the visual impact it will have on the entrance corridor to the City as well as the City's image. LACP Policy 31.2 encourages the establishment and maintenance of urban-shaping open space buffers in strategic areas surrounding the City to maintain the community's separate identity. While the facility will be located in Weld County, it will inevitably be said to be part of Longmont as it is located along the City's entrance corridor. The LACP addresses entrance corridors in strategies 7.20 and 7.21 as well as 31.41 through 31.44. The plan encourages designation of scenic entrance corridors and implementation of the corridors through techniques such as landscaping, limited access, increased setbacks, and sign regulations. Additionally,development regulations can be modified in order to implement methods to develop scenic entrance corridors. Finally, scenic entrance corridors should be implemented while coordinating with other jurisdictions. Longmont's scenic entrance corridor will be significantly impacted by the presence of this structure. A representative of the project has boasted of the structure's ability to act as"a landmark for pilots flying into DIA." The structure's size is clearly being used to create an attraction rather than to serve the needs of the local population. MINUTES OF THE WELD Cu LINTY UTILITIES ADVISORY COMMITTED A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday, April 26, 2001, at 10:00 a.m., in the Conference Room of the Weld County Planning Department at 1555 N. 17th Avenue, Greeley, Colorado. LOCATION: South of and adjacent to Vista View Drive and north of and adjustment to Skyway Drive, 810 feet east of WCR 3.5. Sheri Lockman, Planner presented Case S-591 and read the utility providers into the record. Ms. Lockman also stated that there are no existing utilities in the proposed easement at this time. Don Carroll asked if the drain under Vista View Drive had a culvert already. Arthur Uhrich, applicant, stated there was a culvert. The applicant stated there wasn't much drainage into the easement. The outlot D was originally developed to satisfy the green space requirement and it is owned by Horizon, LTD. Don Carroll asked how the drainage was to be handled. Arthur Uhrich stated the drainage would outlet from the parking area and the building area. The rest would drain into the barrow ditch and into the culvert. Don Carroll verified this site lies directly west of the post office. The applicant stated there is an existing easement and swail in between the post office property and this property. Mark Peterson stated that the Center for Athletic Performance have paid their sewer tap fees. Don Carroll stated there would be no need for internal lot line changes since the lots have only easements along the front instead of the 15 foot perimeter usually required. Mr. Uhrich, stated that the plat was noted without any back easement lines for this express purpose. Don Carroll asked if anyone else on the board had any other concerns. None were stated. Don Carroll moved to accept the plat. Douglas Dalton seconded. Motion passed unanimously. Gary Sandau, La Salle F.P.D. listened to the tapes and reviewed the material at 4:00 p.m. on April 26,2001 and gave his approval as well. Nominations and Voting for Chair and Vice-Chair.
