RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST VON AND DIANE HONNECKE FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Von and Diane Honnecke, VI #0000192, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of January, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Von and Diane Honnecke, property owner(s), were represented by
Kathleen James at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until March 9, 2001, to allow adequate time for the property owner(s)
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000192 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Von and Diane Honnecke to remedy the violation of
the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until March 9, 2001, to allow adequate
time for the property owner(s) to bring the subject property into compliance.

compliance the property owner shall submit an amended "Site Plan Review" showing
the current status of the property or the property shall be restored to the
original condition when the Site Plan Review (SPR-274) was approved. The
"Recreational Vehicle" shall obtain a "Accessory" Zoning Permit for a Mobile
Home.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

was asking more details regarding the 5 day letter
that they had received. She asked about the "wood".
She said that there is a tenant who makes pallets. I
told her that was fine as long as they screened it
(with a wooden fence). I advised her that any other
type of screening requires a letter of intent. She
said she would pass on all of the information to the
Honnecke's and then asked to be transferred to Kim
Ogle. I transferred her. (I also explained that I
would be sending a 30 day Notice letter next week. I
asked her to call me when the property was cleaned up)

Zoning Violation aspect. She ended with "so mainly

and/or screened." and I said yes. I also told her

today.

possible extension. She asked to have it extended at
least to the 14th of August, but would prefer to the
24th of August. I will speak it over with Kim Ogle,
Planner in charge of this case.

she was not aware but one of the tenants was indeed
storing some derelict vehicles on the property. She
stated that they are in the process of being removed.
She asked if she would need to attend the violation
hearing. I informed her that we always recommend that
someone attend the Violation Hearing in case the
Board has questions. She said that someone would
attend. She is also going to be in touch with me to
schedule a meeting between herself, Kathleen James,
Kim Ogle and myself to discuss the Site Plan
(Amendment that is needed).

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled
a meeting with the Board of County Commissioners on January 9,2000,at 10:00 a.m.,to consider the violations
occurring on the property. As we discussed the above mentioned property is in violation of the following
Section(s) of the Weld County Zoning Ordinance:
23.1.12 "Any approved Site Plan Review shall be limited to the items shown on the Site Plan Review map. Major
changes from the approved Site Plan Review map shall reaulre the approval of an amendment of the Site Plan Review
map by the Department of Planning Services. The Department of Planning Services is responsible for determining
whether a major change exists. Any changes shall be filed in the Department of Planning Services with the Site Plan
Review file."

33.6.1.9 "Outside storage. Uses in Commercial Districts involving outdoor storage of venicles, equipment, or
materials when permitted shall be screened from public rights-of-way and all adjacent properties."

materials used with the approval of the Department of Planning Services to lessen the noise, light, heat or visual
impacts of a use on surrounding uses.

Recorded Exemption (RE 2750)
Dear Ms. James:
The Department of Planning Services' has determined through the review, that the standards of Section
11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded
Exemption is approved with the following conditions in accordance with information submitted in the
application and the policies of the County. Enclosed are staff comments, as well as the referral from the
Mountain View Fire Protection District.
While in process of referral review,the applicant revised their application via a facsimile transmission received
June 1, 2000 concerning the addition of a separate ingress/ egress drive for access to Lot A. The
Departments of Public Works and Planning Services reviewed this additional access point information and
have approved the location.
The Department of Planning Services'views this Recorded Exemption as a substantial change to the original
Site Plan Review 274. As such,staff is requiring a new Site Plan Review for both Lot A and Lot B of Recorded
Exemption 2750. Enclosed are the appropriate application forms for your use.

Approved with Conditions
The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
• following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. In accordance with Weld County Department of Public Works Ordinance#180, Lot A shall be granted one
access. Direct access from a public road shall be limited to one access per legal parcel, no circle drives
or additional accesses shall be granted.Access will be placed in such a location as to have adequate sight
distance in both directions and not below the crest of a hill or where physical obstructions are present.
The access shall be a minimum of 75 feet from any intersecting County or State roadways.
The new access approach to Lot A shall be hard surfaced with either concrete or asphalt and shall be
graded for positive drainage.
B. Lot B shall utilize the existing access points necessary for commercial operations. No circle drives or
additional accesses shall be granted.
C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County
Department of Public Works to determine if a culvert is necessary at any approved access point. If a
drainage culvert is required,a 15-inch CMP is the County minimum size. If the applicant chooses to place
a larger culvert, please contact the Department of Public Works to adequately size the culvert.
D. Turner Boulevard Extension is designated on the 1-25 Mixed Use Development Area Structural Plan Map
2.2, Structural Transportation Network as a two lane collector road, which requires 80 feet of right-of-way
at full build out. There is presently 60 feet of right-of-way. A total of 40 feet from the centerline of Turner
Boulevard Extension shall be delineated on the plat as right-of-way reservation for future expansion. This
road is maintained by Weld County.
E. The applicant shall attempt to address the requirements of the Mountain View Fire Protection District as
stated in a referral response received May 17, 2000.
F. All vehicles located on the property must be operational with current license plates, or be screened from
all adjacent properties and public rights-of-way, or be removed from the property. All other items
considered to be a part of a noncommercial junkyard must also be removed from the property or screened
from all adjacent properties and public rights-of-way. The property is in violation of the Weld County Zoning
Ordinance. The applicant shall schedule a final inspection with the Weld County Zoning Compliance
Officer and submit a copy of the closure letter indicating compliance with the Weld County Zoning
Ordinance.
G. The applicant shall amend SPR 274 to delineate the revised access to Lot A of Recorded Exemption 2750
and to delineate any modifications to the existing Plan that may be required. Specific elements to be
addressed include, but are not limited to landscape treatment, parking, lighting, etc.
H. The applicant shall provide the Weld County Department of Planning Services with a certificate from the
County Treasurer showing no delinquent taxes for the original parcel (mother parcel) area.
I. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback and offset requirements for the
zone district in which the property is located. Pursuant to the definition of setback in the Weld County
Zoning Ordinance, the required setback is measured from the future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3) Completion of one-half of the typical cross section for the extension of Turner Boulevard across Lots
A and B shall be the responsibility of the Honnecke's, as per the original Improvements Agreement
dated December 7, 1998.
4) Lot A shall indicate on the plat the type of right-of-way/easement for Turner Boulevard Extension and
indicate whether it is dedicated, private or deeded to provide adequate access to the parcel.
5) Prior to the release of building permits for any structure exceeding 3,600 square feet, the applicant
must comply with the requirements of Appendix III-A of the Uniform Fire Code, as recommended
by the Mountain View Fire District.
6) Future Recorded Exemptions on Lot A or Lot B may raise the issue of compliance with the intent
of the Recorded Exemption process. Approval of this Recorded Exemption does not guarantee
approval of future applications.
7) Prior to the release of building permits the applicant shall submit evidence to the Department of
Planning Services that Lot A and Lot B has an adequate water supply of sufficient quality, quantity
and dependability.
8) Prior to the release of building permits, the applicant will be required to submit a recorded deed
describing the lot upon which the building permit is requested with the building permit application.
The legal description on such deed shall include the lot and Recorded Exemption number.
9) Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Ordinance 169A.
10) Effective December 1, 1999,Building Permits issued on the proposed lots will be required to adhere
to the fee structure of the Southwest Weld Road Impact Program area 1. (Ordinance 211)
3. The applicant shall submit a mylar plat to the Weld County Department of Planning Services to be recorded in
the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the
requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty
(60)days from the date of approval by the Department of Planning Services. The applicant shall be responsible
,for paying the recording fees.
4. The Weld County Department of Planning Staffs approval of this recorded exemption is based upon satisfying
the above conditions. Should an applicant be unwilling or unable to meet any one of these conditions,within 60
days of approval,then this case will be forwarded to the Board of County Commissioners with a recommendation
for denial.
