HomeMy WebLinkAbout20010075.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST VON AND DIANE HONNECKE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Von and Diane Honnecke, VI #0000192, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of January, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Von and Diane Honnecke, property owner(s), were represented by Kathleen James at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 9, 2001, to allow adequate time for the property owner(s) to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Prior to recording the plat: A. In accordance with Weld County Department of Public Works Ordinance#180, Lot A shall be granted one access. Direct access from a public road shall be limited to one access per legal parcel, no circle drives or additional accesses shall be granted.Access will be placed in such a location as to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. The access shall be a minimum of 75 feet from any intersecting County or State roadways. The new access approach to Lot A shall be hard surfaced with either concrete or asphalt and shall be graded for positive drainage. B. If the applicant chooses to place a larger culvert, please contact the Department of Public Works to adequately size the culvert. D. Turner Boulevard Extension is designated on the 1-25 Mixed Use Development Area Structural Plan Map 2.2, Structural Transportation Network as a two lane collector road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 40 feet from the centerline of Turner Boulevard Extension shall be delineated on the plat as right-of-way reservation for future expansion. This road is maintained by Weld County. E. The applicant shall attempt to address the requirements of the Mountain View Fire Protection District as stated in a referral response received May 17, 2000. F. All vehicles located on the property must be operational with current license plates, or be screened from all adjacent properties and public rights-of-way, or be removed from the property. All other items considered to be a part of a noncommercial junkyard must also be removed from the property or screened from all adjacent properties and public rights-of-way. The property is in violation of the Weld County Zoning Ordinance. The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with the Weld County Zoning Ordinance. G. The applicant shall amend SPR 274 to delineate the revised access to Lot A of Recorded Exemption 2750 and to delineate any modifications to the existing Plan that may be required. Specific elements to be addressed include, but are not limited to landscape treatment, parking, lighting, etc. H. The applicant shall provide the Weld County Department of Planning Services with a certificate from the County Treasurer showing no delinquent taxes for the original parcel (mother parcel) area. I. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Zoning Ordinance, the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Completion of one-half of the typical cross section for the extension of Turner Boulevard across Lots A and B shall be the responsibility of the Honnecke's, as per the original Improvements Agreement dated December 7, 1998. 4) Lot A shall indicate on the plat the type of right-of-way/easement for Turner Boulevard Extension and indicate whether it is dedicated, private or deeded to provide adequate access to the parcel. 5) Prior to the release of building permits for any structure exceeding 3,600 square feet, the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code, as recommended by the Mountain View Fire District. 6) Future Recorded Exemptions on Lot A or Lot B may raise the issue of compliance with the intent of the Recorded Exemption process. Approval of this Recorded Exemption does not guarantee approval of future applications. 7) Prior to the release of building permits the applicant shall submit evidence to the Department of Planning Services that Lot A and Lot B has an adequate water supply of sufficient quality, quantity and dependability. 8) Prior to the release of building permits, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. The legal description on such deed shall include the lot and Recorded Exemption number. 9) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. 10) Effective December 1, 1999,Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Southwest Weld Road Impact Program area 1. (Ordinance 211) 3. The applicant shall submit a mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60)days from the date of approval by the Department of Planning Services. The applicant shall be responsible ,for paying the recording fees. 4.
