The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 54 is designated on the Transportation Plan Map as a collector status road,which requires an 80-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the
required setback is measured from the future right-of-way line.
WCR 13 is designated on the Transportation Plan Map as a local gravel road,which requires a 60-foot right-of-way
at full build out. This road has been identified in the Johnstown Comprehensive Plan Area as an arterial status
road.
The average daily traffic (ADT) count for WCR 54 is 2,157 vehicles taken in a 24-hour period October 14, 1999.
WCR 13 had an ADT count of 347 vehicles, and it was taken July 28,1999.
REQUIREMENTS:
Future Right-of-Way:The applicant shall reserve an additional 10 feet of property parallel to the WCR 54 right-of-
way for future build out. The applicant shall check with the Town of Johnstown to verify future right-of-way widths
that would involve WCR 13 at this location.
Set Backs: Set backs to the mining operation are measured from future right-of-way lines plus the standard set
back of 20 feet in an agricultural zone to the edge of the gravel pit berms, which is considered a structure.
Traffic Study: The Weld County Public Works Department is reviewing your submittal of the traffic study. We
are conducting an independent Trip Generation study. Diane Houghtaling, Traffic Engineer, will contact you if
revisions are required.
Improvements Agreement: The applicant shall enter into an Improvements Agreement for the Upgrade and
Paving of WCR 13 from the pit entrance north to WCR 54 and any additional intersection improvements
associated with the heavy hauling that may be identified in the traffic study.
Storm Water Drainage: The applicant had indicated that the storm water drainage will be controlled on site by
being routed to the pit floors. All discharge points shall be designated on the plat, and the appropriate routing to
the Big Thompson River shall be indicated as well. This portion of the permit falls under the jurisdiction of the
State of Colorado as it discharges into waters of the United States.
Off Street Parking: The off street parking spaces at the main office parking lot including the access drive shall
be surfaced with asphalt, concrete, or equivalent and shall be graded to prevent drainage problems. There is
adequate sight distance in both directions at the proposed access point.

I have reviewed the Traffic Impact Study for the Loveland Ready Mix site south of WCR 54 on
WCR 13. The study is not acceptable. The following issues should be addressed in the revised
study.
1. Facilities of this kind are not included in the ITE, Trip Generation Mmanual. Without
published trip generation rates, Weld County hasagreed to accept the developer's
estimates. However, we do not accept AM/PM distribution of those trips shown in
your report. Historically, gravel pits have most of the employees arrive, fill the
delivery trucks and leave the site within the first hour of operations. Based on our
research approximately 80 percent of the employee inbound trips occur in the AM
peak hour. In addition, 12 percent of the loaded trucks exit and 8 percent return in the
AM peak hour. By comparison, the trucks return to the site from their last delivery
before 4:00pm. This results in most employees leaving the site before the beginning
of the PM peak hour. Please adjust your site generated traffic projections.
2. WCR 13 is designated as an arterial. Based on that, the estimated 190 vpd you have
estimated for this road in 2005 and 420 vpd you have estimated for 2015 is low.
Weld County has estimated approximately 2000vpd on this roadway by 2010. Please
revised the projected background volumes accordingly.
3. There is an existing pit at WCR 15 and WCR 54. Please review the turning lanes
warrants for this intersection.
4. LCR 3 will receive 66% of the traffic from this site. Please evaluate the impact on
this intersection.
5. The existing travel lanes on WCR 54 and WCR 13 are not 12 feet wide. With the
heavy truck movements, widening may be necessary. In addition, the lanes widths
should be modified in the capacity analysis.
6. Do not use PCE's in the capacity analysis. PCE's are used for storage lengths and
threshold calculations. Use the heavy truck adjustment factors as required by the

SUBJECT: USR-1329, Loveland Ready Mix, Inc.
Environmental Health Services has reviewed this proposal for this gravel mining operation and
concrete batch plant. We have no objections to the proposal, however, discussion with Alex
Schatz from Banks and Gesso, indicated that a vehicle maintenance shop will not be located on
the property. Should the applicant decide that a vehicle maintenance shop will be located on the
site, a new review of the application will be required by the Weld County Department of Public
Health and Environment.
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to
the Air Pollution Control Division, Colorado Department of Health and Environment for
emissions of criteria, hazardous or odorous air pollutants. Sources of such emissions
include but are not limited to the following: sandblasting operations, mining, spray paint
booths, dry cleaners, haul road traffic, composting, boilers and incinerators.
2. Submit a dust abatement plan to the Environmental Health Services, Weld County
Department of Public Health& Environment, for approval prior to operation.
3. All septic systems located on the property shall have appropriate permits from the Weld
County Department of Public Health & Environment. The Environmental Health
Division of the Weld County Department of Public Health & Environment was unable to
locate a septic permit for the septic system serving the existing residential structure on the
property. Any existing septic system which is not currently permitted through the Weld
County Department of Public Health& Environment will require an I.S.D.S. Evaluation
prior to the issuance of the required septic permit. In the event the system is found to be
inadequate, the system must be brought into compliance with current I.S.D.S. regulations.

4. An individual sewage disposal system is required for the proposed batch plant/office
building and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
5. The installation of the septic system shall comply with the Weld County I.S.D.S. flood
plain policy.
6. In accordance with the Above Ground Storage Tank Regulations (7 CCR 1101-14) a
spillage retention berm shall be constructed around the tank battery. The volume retained
by the spillage berm should be greater than the volume of the largest tank inside the berm.
Alternative protective measures may be allowed provided they comply with the Above
Ground Storage Tank Regulations.
7. The applicant shall provide evidence that any vehicle washing area will be designed and
constructed to capture all effluent and prevent any discharges from drum washing and the
washing of vehicles in accordance with Rules and Regulations of the Water Quality
Control Commission and the Environmental Protection Agency.
8. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health&
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).
9. The applicant shall provide evidence that the facility has obtained an"adequate" water
supply.
We recommend that the following requirements be incorporated into the permit as "development
standards":
1. The facility shall operate in accordance with the approved dust control plan. The facility
shall have sufficient equipment available to implement appropriate dust control.
Additional control measures shall be implemented as required by the Weld County Health
Officer.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities

Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a"solid waste" in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
5. Fugitive dust shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from
the facility area in a manner that will prevent nuisance conditions.
8. The facility shall utilize the existing public water supply. (Little Thompson Water
District)
9. The operation shall comply with all applicable rules and regulations of the Colorado
Division of Minerals and Geology.
10. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items that
might wash away during flooding shall be securely anchored and adequately flood
proofed to avoid creation of a health hazard.
11. Adequate hand washing and toilet facilities shall be provided for employees.
12. The operation shall comply with the Occupational Safety and Health Act (OSHA).
13. The operation shall comply with the Mine Safety and Health Act (MSHA).
14. Portable toilets may be utilized on sites that are temporary locations of the working face
and portable processing equipment, etc. for up to six months at each location.
15. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum
washing and the washing of vehicles in accordance with the Weld County Code, the
Rules and Regulations of the Water Quality Control Commission, and the Environmental
Protection Agency.

Dear Mr. Anderson:
We have reviewed the above referenced proposal for a gravel mining operation
and concrete batch plant to be located near the Little Thompson River, about 7 miles
east of the Town of Loveland. On page 15 of the submittal, the Use by Special Review
(Mining Operation) Application, in particular item E., states this project will be a dry pit
operation. However, on page 4 of the report by Banks and Gesso, LLC, it is noted in
paragraph 4.2 that "Water demand for operations (i.e., concrete batching, dust control,
etc.) will be met by using groundwater exposed by mining."
This office received on March 26, 2001, a proposed substitute water supply for
the above referenced project. We will forward the plan to our consultant for review and
the process generally takes 2-3 months for review/approval.
This office can not make a recommendation concerning the above referenced
project at this time. Upon completion of the review of the proposed substitute water
supply plan, we can offer an opinion as to the potential of the proposed project and its
impacts to existing water rights.

The Division of Wildlife received the request from you agency for comments concerning
case USR-1329, Loveland Ready Mix Inc. Division of Wildlife biologists Courtney
Crawford and Mille Sherman visited the site and recommend the following.
A major portion of the property in question lies in the flood plain of the Big Thompson
River. Approximately 1000 feet of the Big Thompson River lies adjacent to this proposal
at the east portion of the property. At the present time domestic cattle are heavily grazing
the land.
The gravel mine proposal indicates that surveys have been completed on threatened on
and endangered wildlife species. We recommend that U. S. Fish and Wildlife
representatives be contacted in reference to Preble's Jumping Mouse and Ute Ladies'
Tresses Orchid. Pete Plage(Preble's)and Jan Mckee(Orchid)may be contacted at 303-
275-2370.
Gravel mining activity on this project will have little impact on existing wildlife.
Development of ponds or lakes along with proposed wetland mitigation has the potential
to improve habitat for waterfowl, shorebirds, amphibians and fish. In order to maximize
the site for wildlife and for recreation, reclamation plans for the ponds should include
islands, shallow areas and irregularly shaped shoreline with slopes not greater that 4:1.
According to this proposal a batch plant-office will be constructed near two existing
ponds located in.the Northwest portion of the property. Several, large, mature
cottonwood trees exist at this location and it is not clear from this proposal if the trees
will be removed to make room for the batch plant and adjacent storage piles. The
cottonwoods provide nesting and perching habitat for a variety of birds including raptors
and songbirds. Considering the ample area available for construction at this location, we
recommend that plans be altered so that these cottonwood trees remain in place.

An alternate reclamation plan map indicates that a residential development is at least
being considered along the Southern portion of the property. Some of the lots extend
North into an area that has been designated on another map as wetland enhancement. We •
highly recommend that the lots be configured so that they do not conflict with wetland
enhancement. Wetlands are one of the most important habitat types in Colorado and
should be preserved as open space and not overlap with residential development. Set
backs and buffer zones should be planned so that wildlife disturbance is minimal.
If residential development is approved, covenants should be in place that requires owners
to maintain their property and control domestic pets. Pets running at large are a definite
liability to their owners and to wildlife. Residents of this rural development must be
aware that they are responsible for their property and that accumulation of trash and junk
and outdoor feeding of pets may attract nuisance wildlife such as skunk, raccoon, fox,
and cottontail rabbit.
The extraction plan map indicates that mining activities(cell 4)will take place adjacent
to the Big Thompson River. A small wetland that eventually flows into the Big
Thompson River exists within that cell and it appears that it will be mined out. The
proposal states that a U.S. Army Corps of Engineers-404 permit will be obtained prior to
mining this area. We highly recommend that this be monitored for future compliance.
The extraction plan map also indicates a 110-foot offset between the Big Thompson
River and cell 4. This portion of the river has historically provided valuable resting and
feeding area for ducks and geese. We recommend a minimum of 200 feet offset at this
location and also recommend that vehicle traffic be routed as close to the mining cell as
possible.
The Division of Wildlife appreciates the opportunity to review and comment on this
project proposal. Consideration for wildlife and critical wildlife habitat are essential in
minimizing negative impacts on the resource.

Dear Mr. Anderson,
The Larimer County Engineering Department has reviewed the information sent to us on referral
regarding the above referenced application and offer the following comments.
Larimer County recently completed the processing of a mining application for Lafarge at the Northwest
r^� corner of WCR 13 and Hwy. 392. This application proved to be quite controversial and generated a
significant amount of public interest and comment.
Issues that were of concern to the public were impacts to the flood plain, impacts to the groundwater,
dust, visibility, industrial uses and compatibility. While these were major issues that resulted in Lafarge
having to provide rather extensive studies,the issue that caused the most controversy was the impact of
the additional truck traffic on Hwy 392 and along the entire corridor from I-25 east through the Town of
Windsor.
Because of these concerns, there were some rather significant conditions placed on the Lafarge mining
operation as part of the approval. To begin with,the request to place batch plants at the site was denied.
Additionally,there were tight restrictions placed on the haul routes. Only local deliveries are allowed on
any roads except Hwy. 392 and the portion of WCR 13 between Hwy 392 and the site access.
The following information is an extract of some of the other conditions of approval that the County
imposed upon Lafarge,they are provided for your consideration in the review of this application.
• Applicant agrees to pay all county and Regional Road Capital Expansion Fees. 10%
of this fee shall be held in reserve for application to improvements associated with
Hwy 392. This 10% shall be held for the life of the application and if not used in that
period shall be returned to the overall pool of funds. It shall be used on Hwy 392
projects only if the Town of Windsor participates similarly with fees and EXHIBIT
improvements. /
• The applicant shall construct the raised island design unrestricted right(westbound /
turn lane/acceleration lane with extended taper from CR. 13 to Hwy. 392. The
construction shall be according to plans approved by CDOT. No material shall be
hauled from the site until the improvements are installed and approved by CDOT.
The applicant/operator shall participate in other needed highway improvements along
Hwy. 392 (signalization and CR. 3 climbing lane improvements)based upon a plan

approved by the Board of County Commissioners, the Colorado Department of
Transportation and the Town of Windsor,which comprehensively assigns physical
and financial responsibility to existing and new developments that impact the
highway.
• Haul traffic shall be limited to no more than 20 truck trips(10 in -10 out)per hour
from the site between the hours of 7:00 am and 8:00 am. The County Engineering
Department shall monitor the tracking of material onto the County Road and
Highway. If it is determined by the County Engineering Department that material
tracking is a problem the applicant shall install either anti-tracking devices or vehicle
washing systems at all exit locations to the pit to limit the amount of material tracked
on to WCR 13 and Hwy. 392.
• The applicant shall perform initial dust testing prior the commencing operation to
establish baseline conditions. The applicant shall conduct monitoring during the
initial phase of operations to insure that the air quality modeling is accurate.
• The applicant shall prepare driver education information for use at the pit.This can
include pamphlets and signs,which clearly indicate the agreement the applicant has
entered into with the County and the HOA's. Specifically, this information needs to
include the travel restriction on WCR 13 and CR. 32E, The prohibition of use of the
CR. 3 acceleration lane for climbing purposes, the request to limit the use of"Jake
Brakes", and the state requirement for covered loads.
Due to this recent experience we strongly recommend that the applicant hold at least one neighborhood
meeting and that the notice area be extensive enough to include all of the nearby and adjacent
subdivisions. We also recommend that the applicant take a close look at the other issues mentioned above
as they pertain to their site.
In addition to the above comments,we strongly recommend that the applicant and Weld County pursue
coordination in a cooperative planning effort with the Cities of Johnstown and Loveland, along with
Larimer County and CDOT,regarding both the short and long-range transportation improvements needed
in the surrounding area. Larimer County is particularly concerned with the impacts on LCR 18 and other
Larimer County roads and bridges in the area. Since the Traffic Impact Study provided by the applicant
noted that 66% of the truck traffic from the site will be using Larimer County roads (headed west-bound
from the site), we would like to request the following items be completed by the applicant:
• A pavement analysis of LCR 18. We believe this road is fundamentally inadequate
both structurally and functionally for this type of traffic. Please provide information
regarding the ability or inability for LCR 18 to handle the proposed increase in heavy
trucks. If inadequate,what sort of improvements to LCR 18 should to be completed
by the applicant?
• Include Larimer County roads and intersections in the Traffic Impact Study. The
submitted TIS also failed to discuss key intersections in Larimer County(such as
LCR 18/SH 402 and I-25).
• A set of construction plans showing the proposed east-bound right turn deceleration
lane on LCR 18/WCR 54 and WCR 13 that will be built by the applicant.

1. Required vertical clearance shall be 13'6". There shall be no grade greater than
6%on open streets and no grade greater than 4%in intersections.
2. This project shall comply with fire flow requirements of the 97 UFC, Appendix
III-A and B.
3. Hydrant installation details are required to be submitted to the Fire District prior
to project start up.
4. Hydrant location shall be located no more than 150' from structures and 300'
spacing.
5. Fire safety during construction shall comply with section 8704 of the"97' UFC.
i-. 6. When construction of new buildings starts Addresses, Street Names, and Signs
shall be posted.
7. The Johnstown Fire Protection District requires all buildings be provided with
proper and adequate vehicle access constructed of permanent all-weather surface,
which is capable of supporting the weight of emergency apparatus.
8. The Johnstown Fire Protection District shall receive blue prints for all structures
being built on site for our review and approval.
9. The Johnstown Fire Protection District shall receive blueprints of any and all fuel
storage tanks on site for our review and approval.
10. If there is a gate at the main entrance we will need to see drawings on this as well.
This is only a preliminary review. The Johnstown Fire Protection District will need to do
a complete site plan, utility plan,building plan, and fuel storage plan review.
