HomeMy WebLinkAbout20010048.tiff HEARING CERTIFICATION DOCKET NO. 2000-77 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1297 FOR A SINGLE FAMILY DWELLING UNIT, OTHER THAN THOSE PERMITTED UNDER SECTION 31.2.1 OF THE ZONING ORDINANCE IN THE A (AGRICULTURAL) ZONE DISTRICT - BRADLEY AND HEIDI WINDELL A public hearing was conducted on January 3, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem - EXCUSED Commissioner William H. Jerke Commissioner David E. Long Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Robert Anderson Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated December 18, 2000, and duly published December 21, 2000, in the South Weld Sun, a public hearing was conducted to consider the request of Bradley and Heidi Windell for a Site Specific Development Plan and Use by Special Review Permit #1297 for a Single Family Dwelling Unit, other than those permitted under Section 31.2.1 of the Zoning Ordinance in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chair Geile advised Bradley Windell, applicant, that he has the option of continuing this matter to a date when the full board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Vaad will listen to the record and make the determining vote. Mr. Windell indicated he would like to proceed today. Robert Anderson, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He gave a brief description of the location of the site, which is approximately 21 acres. Mr. Anderson stated there are two stick-built buildings, some out buildings, and mature landscaping. He further stated the site is neat and orderly, and there are no apparent violations. Mr. Anderson described the surrounding uses, and stated four referral agencies indicated no conflict, and four responded with comments. He further stated several letters of concern have been received regarding the request for multi-family dwellings. Mr. Anderson stated the Department of Planning services recommends approval as indicated in the Administrative Review. In response to Chair Geile, Ms. McConnellogue stated the septic systems exist and are permitted. Responding further to Chair Geile, Don Carroll, Department of Public Works, stated there are two existing accesses. He further stated there are no traffic counts on this portion of road; however, he estimated the traffic load to be less than 100 vehicles per day. Brad Windell, applicant, had no further comments and requested approval. No public testimony was offered concerning this matter. Commissioner Jerke moved to approve the request of Bradley and Heidi Windell for a Site Specific Development Plan and Use by Special Review Permit #1297 for a Single Family Dwelling Unit, other than those permitted under Section 31.2.1 of the Zoning Ordinance in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Masden, and it carried unanimously. This Certification was approved on the 8th day of January 2001.
