HomeMy WebLinkAbout20011074.tiff HEARING CERTIFICATION DOCKET NO. 2001-23 RE: FINAL PLAN FOR SKYLARK RANCH MINOR SUBDIVISION, S #586 - ROBERT PARSONS A public hearing was conducted on April 25, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tern Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Pam Smith Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 23, 2001, a public hearing was conducted on April 11, 2001, to consider the request of Robert Parsons for a Final Plan for Skylark Ranch Minor Subdivision, S #586. At said hearing on April 11, 2001, the Board deemed it advisable to continue said matter to April 25, 2001, to allow the Tri-Town Farmer and Miner additional time for publication of a corrected legal notice dated April 6, 2001, and duly published on April 11, 2001. Lee Morrison, Assistant County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Lockman gave a brief description of the location of the site and the surrounding uses. She stated 11 referral agencies responded favorably or proposed conditions, three did not respond, and she did not receive any correspondence from the surrounding property owners. In response to Chair Geile, Pam Smith, Department of Public Health and Environment, stated the proposed lots are adequate for septic systems. Diane Houghtaling, Department of Public Works, stated the applicant has almost completed the access road leading to his house, and it will be built to County standards; however, he does still need to submit the plans. Robert Parsons, applicant, stated he intends to make one minor change to the Covenants which will require a 40-foot setback for side yards and for accessory buildings. Responding to Chair Geile, Mr. Parsons stated, with exception to the change he just proposed, the Covenants are complete, and he reviewed the size of homes that will be built. He further stated the Covenants indicate that any resident will comply with Weld County Health requirements, the soil bores taken from the site have been acceptable, and the Homeowners' Association will do all of the internal road maintenance and snow removal. In response to Commissioner Jerke, Mr. Parsons stated the homes will have fire sprinklers to meet the concerns of the Poudre Fire Authority, and the three hydrants are in place. Responding to Commissioner Masden, Mr. Parsons stated he has received numerous discounts or reductions on his insurance policy due to having sprinklered homes,nearby fire hydrants, and security systems. In response to Commissioner Jerke, Mr. Parsons stated the property is served by the North Weld County Water District. He explained they originally proposed 2001-1074 , PL , 43 , 4L PL1413 HEARING CERTIFICATION - ROBERT PARSONS (S #586) PAGE 2 an engineered six-inch pipeline to be installed as a secondary line to supply the nearby water storage towers. He stated he paid for the six-inch and hydrants; however, the District installed an eight-inch, with a 24-inch pipe along Highway 14. Commissioner Jerke commented it was to the property owners advantage that the site is located near an existing water service infrastructure. In response to Commissioner Vaad, Mr. Parsons stated Howard Ramsdell, surrounding property owner, initially expressed concern with water availability and drainage; however, those concerns have been addressed by the Engineering Report. Responding to Chair Geile, Mr. Parsons stated he has reviewed and agrees with the Conditions of Approval and Development Standards. In response to Chair Geile, Mr. Morrison stated the Covenants are reviewed administratively and the Board does not need to include the change in setbacks as part of the Conditions of Development Standards. Mr. Morrison added there is a nearby Use by Special Review Permit for a dairy which had opponents that indicated the Right To Farm did not provide adequate protection to residents. He clarified that the Right To Farm is included under Condition #2.G.1 of this permit, and in the past it has not been the intent of the Board that the Right To Farm does distinguish between a Use by Special Review and a Use by Right. Commissioner Vaad commented for the record that the Board has always made an effort at helping to sustain agricultural efforts regardless of whether the use is allowed by right or by a permit, and Commissioner Long concurred. Mr. Parsons stated the Right To Farm is currently included on the plat. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Robert Parsons for a Final Plan for Skylark Ranch Minor Subdivision, S #586, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Long, and it carried unanimously. This Certification was approved on the 30th day of April 2001.
