RE: ACTION OF BOARD CONCERNING SUBSTANTIAL CHANGE HEARING #17 ON A
PARCEL OF LAND WHICH HAD PREVIOUSLY HAD A LAND USE APPLICATION
DENIED - SIEGRIST COMPANIES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 10th of
January, 2001, at the hour of 10:00 a.m. in the Chambers of the Board, on behalf of Siegrist
Companies, c/o Michael Siegrist, 875 West 64th Avenue, Denver, Colorado 80221, for the
purpose of considering whether or not there has been a substantial change in the facts and
circumstances regarding the application for Change of Zone #528, which was denied by the
Board of County Commissioners by Resolution #992212, dated January 26, 2000, and a
corrected Resolution #2000-2317, dated September 27, 2000, and
WHEREAS, said action was taken concerning property described as:
Part of Section 35, and part of the W1/2 of
Section 36, Township 3 North, Range 68 West of
the 6th P.M., Weld County, Colorado
WHEREAS, said applicant was represented by Laverne Nelson, and
WHEREAS, said hearing was conducted pursuant to the Board's policy concerning
applications for land use for property previously denied, as set forth in the Weld County
Administrative Manual, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and, having been fully informed, finds that said
request to apply for a Substantial Change shall be approved for the following reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has
demonstrated that a substantial change in facts and circumstances has
occurred.
a. As stated by the applicant, a requirement by Weld County for a roadway,
classified as an arterial (4-lane with a painted median), and its connecting
link to the relocated CDOT service road, through the property, thus
requires construction of a major roadway by the property owner in a
location undesignated in the original application. The required roadway
will necessitate a redesign of a significant part of the proposed
development area to match the new road location and serve the
development in an effective manner. The required roadway was not a

condition of review and approval in the original application. The
realignment of Weld County Road 9.5 does present a substantial change,
as evidenced by the letter from the Department of Public Works, dated
September 29, 2000, stating this alignment presents a substantial
change to the entire region. The alignment of this road will also affect
many other land owners in the area and the decision will allow for orderly,
efficient development in the area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that there has been a substantial change in the facts and
circumstances regarding the application of Siegrist Companies, c/o Michael Siegrist for a
Substantial Change.
BE IT FURTHER RESOLVED by the Board that the request of Siegrist Companies, c/o
Michael Siegrist to apply for a Substantial Change be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of January, A.D., 2001.
