RE: GRANT REQUEST TO SET A HEARING DATE FOR THE FOURTH REPLAT OF
GILBAUGH'S APPALOOSA ACRES, S #539 - IVAN AND JOANNE GILBAUGH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 6th day of
December, 2000, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of
hearing the application of Ivan and Joanne Gilbaugh, 20085 Weld County Road 74, Eaton,
Colorado 80615, for the Fourth Replat of Gilbaugh's Appaloosa Acres, being a replat of Lots
15-C, 16, and 17 as shown on the Third Replat of Gilbaugh's Appaloosa Acres on the following
described real estate, to-wit:
Lots 15-C, 16, and 17, Third Replat of Gilbaugh's
Appaloosa Acres, located in the W1/2 of the
SW1/4 of Section 33, Township 7 North, Range 65
West of the 6th P.M., Weld County, Colorado
WHEREAS, at said hearing on December 6, 2000, the Board deemed it advisable to
continue the matter to June 6, 2001, to allow the applicants adequate time to establish a
Homeowners' Association for the maintenance of Appy Road, and
WHEREAS, the Board has received a request from Ivan and Joanne Gilbaugh to set a
new hearing date for the application for the Fourth Replat of Gilbaugh's Appaloosa Acres prior
to June 6, 2001, and
WHEREAS, after study and review the Board deems it advisable to grant said request,
with the hearing date to be set as February 14, 2001, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request from Ivan and Joanne Gilbaugh to set a new hearing
date for the application for the Fourth Replat of Gilbaugh's Appaloosa Acres prior to June 6,
2001, be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said
request be, and hereby is, set as February 14, 2001, at 10:00 a.m.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of January, A.D., 2001.

COLORADO SUBJECT: Request to Set Hearing Date
Ivan and Joanne Gilbaugh have submitted a request that the application for the Fourth Replace of
Gilbaugh's Appaloosa Acres, S #539, be heard prior to June 6, 2001, as previously set by the
Board. If you wish to approve this request, a hearing before the Board on February 14, 2001, will
allow adequate time for advertising.

Dear Esther:
Following our telephone conversation this afternoon, we are now
requesting that a hearing before the Weld County Commissioners
regarding Case S-539 be rescheduled as soon as possible, in com-
pliance with all the things that need to be done.
We had requested and received a continuance until June 6 , 2001
because we were hopeful to have some issues regarding Road Main-
tenance resolved by that time, which might have impacted our
application.
Jay Gale Moody, who now owns Lots 16 and 15C, Gilbaugh' s Appaloosa
Acres has a buyer for Lot 16 and would like to bring this to a
conclusion as soon as possible.
We realize that this is not an ideal situation as far as your
usual agenda is concerned, and we apologize for being unsure of
what should be the next step for us ! However, we plan to have
this completed, pending approval, exactly as it was first presented.
