RE: ACTION OF THE BOARD CONCERNING CONDITION OF APPROVAL #3 OF USE BY
SPECIAL REVIEW PERMIT#1346 -WESTERN MOBILE, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated October 10, 2001, the Board did approve Use by
Special Review Permit#1346 for an Open Pit Sand and Gravel Mining Operation, including the
conveyance of excavated sand and gravel, importation of sand and gravel materials,
processing and sale in the A (Agricultural) Zone District, issued to Western Mobile, Inc., and
WHEREAS, at said hearing on October 10, 2001, the Board deemed it advisable to
approve Use by Special Review Permit#1346, with Condition of Approval #3 scheduling a
hearing on November 14, 2001, to allow the applicant additional time to come to an agreement
with the mineral owners stipulating the oil and gas activities have adequately been incorporated
into the design of the site, and
WHEREAS, at said hearing on November 14, 2001, the Board moved to delete
Condition of Approval #3 as the operator, surface owner, mineral lessee, and mineral owner
have indicated that there is an "agreement in principle," and there is evidence that the applicant
has incorporated the oil and gas activities into the design of the site.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Condition of Approval #3 of Use by Special Review Permit#1346
for Western Mobile, Inc., be, and hereby is, deleted.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 14th day of November, A.D., 2001.
