As you will recall from the clarification we received during the Planning Commission hearing, Condition 2A requires Asphalt Paving Company to submit trip tickets to the Department of Public Works so that they may verify that turn lanes are not warranted at the project entrance. Trip tickets were forwarded to Diane Houghtaling on September 21' and a copy of that transmittal is enclosed for your reference. Condition 2B requires a letter from the mineral rights owner to be on file, stating that the proposal adequately incorporates oil and gas facilities into all plans. A mineral rights letter dated September 21, 2001 was sent to the County under its own cover; a copy of that letter is enclosed for your records. Please schedule the AmUSR-921 case for a hearing before the County Board when you have had a chance to speak with Diane Houghtaling in Public Works. Summary Sheet of Randomly Selected Trip Tickets, Perry Pit site 2. Trip tickets for Perry Pit site (15 days) At the Planning Commission hearing for the Perry Pit Amendment on September 4'h, we clarified the Public Works Department's needs under USR Condition 2A. This condition states that the Public Works Department requires additional information regarding traffic generated by the sand and gravel operation. Specifically, the County requires data that show turn lane improvements at the entrance to the site are not necessary due to the actual traffic levels being far below the level at which turn lanes and other improvements are warranted. Enclosed are trip tickets from the Perry Pit site for a randomly selected set of 15 days (5 days in each of the summer months). As discussed during the Planning Commission hearing, these tickets should be sufficient to provide the documentation needed for traffic engineering purposes. You will find that these tickets are consistent with the determination that actual trips generated by the Perry Pit site are far below the level which warranted improvements in the previous Traffic Study for Weld County Road 6. Avenue Greeley, Colorado 80631 Attn: Robert Anderson RE: SPECIAL REVIEW CASE USR-921 Dear Mr. Anderson: I am writing to you as owner of the property immediately south of Weld County Road 6 and immediately east of the incorporated Town of Wattenberg, currently under review by your Department as an Amendment to Weld County Use by Special Review Case USR-921. The surface estate at this property is currently the site of a sand and gravel mine for Asphalt Paving Co. and the mineral and oil and gas estate are in the ownership of Asphalt Paving Co. The County is requiring a statement from the mineral owner at this property that oil and gas drilling have been adequately incorporated into the design of the site. In this case, the Amended Use by Special Review will not displace any oil and gas facilities, nor will the plan interfere with future access to the site for the purposes of oil and gas development. Currently, we have leases with M.E. III Corp. and Patina, for oil and gas extraction on the property and we intend to maintain the viability of these leases as part of our interest in the mineral rights at the subject property. You will note that the plans submitted to Weld County in the current case specifically provide for continued access to, and working space around, the M.E. III well at the western edge of the site. Please place this correspondence in the appropriate file for Case AmUSR-921. In response to those Conditions of Approval, I would like to submit the following comments in the order that the conditions were addressed on the resolution recommended by the Planning Commission. Condition 1: Development Standards The list of Development Standards for this Special Review Permit have been added to Final Plat and the completed plat will be submitted to the Department of Planning Services upon approval of the Board of County Commissioners. Former Condition 2A: Supplementary Traffic Information The Public Works Department required additional information on traffic generated by Asphalt Paving's operation. The purpose of this data is to demonstrate that turn lane improvements at the entrance to the site are not necessary. Trip ticket information was sent to Diane Houghtaling on September 27, 2001. This information successfully shows that the trips generated by this site are well below the level that which necessitated improvements in the previous Traffic Study for Weld County Road 6. This condition has been satisfied by virtue of the scheduling of the Board of County Commissioners Hearing. Former Condition 28: Mineral Rights Letter A letter dated September 21, 2001 from Jeff Keller of Asphalt Paving (mineral property owner)was sent to the Weld County Department of Planning Services. The letter states that all oil and gas activities have been sufficiently incorporated into the design of the 2 EXHIBIT site and that adequate measures have been taken to mitigate the concerns of the mineral rights owners. This condition has been satisfied by virtue of the scheduling of the Board of County Commissioners Hearing. Condition 2A: Department of Wildlife Concerns Banks and Gesso, LLC responded to the Colorado Division of Wildlife's referral response of July 11, 2001. A response letter to DOW addressing the Division's requirements and concerns, was forwarded on August 24, 2001. A copy of this letter was also sent to Weld County Planning Services. The DOW was concerned that the change in end use from two ponds to one large one would cause a reduction in shoreline habitat. The DOW was assured that the minor reduction in shoreline would be reciprocated with an increase in aquatic habitat. Also, Asphalt Paving is in the process of amending its 404 Permit (with the Army Corps of Engineers) and expects the new mitigation program to provide for an enhanced wildlife habitat. Condition 2B: Discharge Points Delineation All discharge points and appropriate routing to the South Platte River will be shown on the final plat and permitted by the State of Colorado. Modified discharge points are shown on the revised Weld County USR Extraction Plan and Reclamation Plan and copies of these revised plans will be included in the final submittal. Condition 2C: 80' Right of Way for Weld County Road 6 Since Weld County Road 6 is classified as a collector status road, 80 feet of right-of-way is required at full build-out. To accomplish this, the northern permit boundary has been moved 10' to the south to allow for 40' of Right of Way from the centerline of Weld County Road 6. The new boundary line is shown on the revised Extraction and Reclamation Plans that are to be included in the final submittal. Condition 2D: Landscape and Buffer Plan The Landscape and Buffer Plan is in progress to show how impact to adjacent property owners and public rights of way will be mitigated. A draft of this plan will be submitted to Planning Services as soon as possible. Condition 2E: Dust Abatement Plan The Fugitive Dust Plan was approved and issued under State Permit Number 93WE1382F. The existing Fugitive Dust Plan was updated on 11/2/98 and will be valid until 11/2/03. This permit will not need amendment, as there will be no change in equipment used and the annual production rates will not change. A copy of the Dust Abatement Plan is included with this letter. Condition 2F: APEN and Emissions Permit The existing APEN was updated on 11/2/98 and will be valid until 11/2/03. No significant change in emissions or production will result from the activities generated by this amendment. The additional 10 acres of mine that will be mined under this amendment will not affect annual production rates. Therefore, the APEN will not need renewal until its expiration date in 2003. Condition 2G: CDPS Permit The original CDPS Permit was effective on 6/9/93 and renewed on 9/30/97. The current permit will be valid until 9/30/02. This information was obtained from Nathan Moore at the Water Quality Control Division at the Colorado Department of Public Health and Environment. There is no need to amend the permit because mining of the additional 10 acres will not begin until a slurry wall has been installed. Condition 2H: Waste Handling Plan The Waste Handling Plan has been sent to the Weld County Department of Public Health and Environment. A copy is being forwarded to the Department of Planning Services with this letter. There are two scenarios depicted in these plans, one for mining only, and one for mining with asphalt production. Condition 21: Potable Water Supply Intent to use bottled or containerized water on site is stated in letter sent to the Weld County Health Department. A copy of this letter is included with this submission. Condition 2J: Groundwater Monitoring Plan Asphalt Paving Company intends to continue its current monitoring program. Monitoring results of the current program are included. The only change to the hydrology of the area will happen when the slurry wall is installed. Once this is constructed, water depletion will not be an issue. Monitoring program information will continue to be sent to the Weld County Department of Health & Environment and the latest update has been forwarded to them. Condition 2K: Protected or Endangered Species In the Planning Commission Hearing of September 4, 2001, the Applicant was asked to submit documentation that the Perry Site is not suitable habitat for Protected or Endangered Species. The U.S. Geological Survey is currently conducting a study entitled "Understanding and Mapping the Relationship between Habitat for the Preble's Meadow Jumping Mouse and Aggregate Resources". According to this study, the Preble's Mouse is predominantly located along waterways that have well-developed riparian vegetation. Vegetation along Lupton Bottoms Ditch is not well-developed and widely scattered. Also, the soil types on this site are too gravelly and sandy to support the proper type of hydrophytic vegetation necessary for Preble's Meadow Jumping Mouse habitat. A trapping survey for Preble's Jumping Mouse was conducted on a property directly one mile north of the Perry site. This property is nearly identical to the Perry Site in topography and environment. Lupton Bottoms Ditch bisects both of these sites. The trapping survey included more than 750 trap nights in June of 1999. No Preble's Jumping Mice were found during the duration of the survey. A survey for Ute Ladies' Tresses was conducted in August of 1995 and the site was found to be an unsuitable habitat for this orchid. A copy of this study is included. Condition 2L & 2M: Temporary Substitute Supply Plan A new Substitute Supply Plan was approved on September 27, 2001 and a copy is included with this submission. The current Substitute Supply Plan is valid through December 31, 2001. Applegate Group, Inc. is currently processing a renewal of this plan and it will be executed before the expiration date. A referral response from the Assistant State Engineer was received by Weld County Planning on August 16, 2001. This letter stated that the Substitute Supply Plan would need to be amended to cover the additional depletions to the stream system caused by the expansion. However, there will not be any additional depletions from the stream system after the slurry wall installation. A Temporary Substitute Supply Plan will not need amendment in the future because the created lake will no longer be tied to the stream system. Instead, it will be it's own self-sufficient water basin. Condition 2N: Greater Brighton Fire District A site plan map has been sent to Kris Krengle of the Greater Brighton Fire Protection District for his review and to satisfy the District's requirements. When the Fire District approves the plan, evidence of such will be forwarded to you. In conclusion, the Applicant is confident that all of the Planning Commission's Conditions of Approval have been met, with one exception. The updated Landscape and Buffer Plan has not been submitted. This Plan will be promptly forwarded to Weld County Planning as soon as it is completed. Water Division 1,Water District 2 Dear Mr. Nguyen: We have received your letter of June 13, 2001, requesting renewal of the above referenced substitute water supply plan to cover depletions caused by an existing gravel mining operation. The required fee of$217 for the renewal of this substitute supply plan was submitted with a March 31, 2000 renewal request Additional Information pertinent to this request was submitted in a letter dated October 26, 2000. The substitute supply plan accounts for a variable amount of exposed lake surface that increases from 6.6 acres in April 1998 to 12.0 acres in June 2001. The entire lake surface was exposed after December 31, 1980. Consumptive use of water at the property consists of evaporation from the pond surface area and water lost in product as shown in the attached table entitled Glover Analysis Input. The delayed impacts to the river are determined using a Stream Depletion Factor of 30 days. We agree with the calculations in this table. The ultimate plan for the source of replacement water is recharge ponds that will be operated through an agreement with the Brighton Ditch Company. The recharge ponds, or sumps,were used to recharge water during 1998 and 1999 using water diverted when there was no call on the river. The accretions to the river that resulted from the recharge were calculated using a Stream Depletion Factor of 280 days. Those accretions are shown in the attached table entitled Stream Depletion Analysis Using Stream Depletion Factors. We agree with the calculations in this table. Currently no water is being recharged pending a final agreement with the Brighton Ditch Company. Until the agreement is finalized, an additional source of replacement water will be leased Warrior Ditch water from the Bear Creek Development Corporation during the summer. During the winter, additional replacements will be made by reusable effluent leased from the City of Greeley. To replace the depletions that are not replaced by accretions from past recharge the water leased from the City of Greeley is In the amount of 6.7 acre-feet. This is to replace depletions during the months of January 2001 through April 2001 and November 2001 through 'December 2001. The water leased from the Warrior Ditch Is In the amount of 22 acre-feet. This Is to replace depletions during the months of May 2001 through October 2001. The permit allows a maximum appropriation of 14.74 acre-feet and limits the water surface area to 3.5 acres. This permit is no longer valid for the current uses. I hereby approve this substitute water supply plan, in accordance with Section 37-80- 120, C.R.S., (1991), subject to the following conditions: 1. A new well permit must be obtained for the current use and exposed pond surface area of the gravel pit. The provisions of Colorado Revised Statute 37-90-137(2)prohibits the issuance of a permit for a well to be located within 600 feet of any existing well, unless the State Engineer finds that circumstances so warrant after a hearing held in accordance with the procedural rules in 2CCR402-5. This hearing may be waived if you are able to obtain statements from the owners of all wells within 600 feet, verifying that they have no objection to your use of the proposed well. Should a new well permit be denied for reasons of 600 foot spacing, or any other legitimate reason, approval of this substitute supply plan will be canceled. 2. The total area of pond surface exposed and the total amount of water to be appropriated shall not exceed that amount listed on the attached table for each month. Should the actual values exceed the amounts in the tables, an amendment will need to be filed with this office. 3. The water commissioner responsible for the administration of this plan is Mr. Bob Stahl, 9378 WCR 25, Ft Lupton. CO 80621, phone no. (303) 857-0742. Adequate records of diversions, replacements, and amounts of water used for particular uses must be provided to the Division Engineer and the Water Commissioner on a monthly basis or other interval acceptable to both of them on a form approved by them. 4. All releases of replacement water must be sufficient to cover all out of priority depletions and be made under the direction and/or approval of the Water Commissioner. The replacement may be aggregated to maximize beneficial use. The Water Commissioner and/or Division Engineer shall determine the rate and timing of an aggregated release. 5. The replacement water,which is the subject of this plan cannot be sold or leased to any other entity. As a condition of subsequent renewals of this substitute water supply plan, the replacement water must be appurtenant to this site until a plan for augmentation is obtained. Should a request for renewal of this plan be needed, such renewal request must be submitted to this office 45 days prior to the expiration date of this plan_ 11. Should this substitute water supply plan expire without renewal or be revoked prior to adjudication of a permanent plan for augmentation, all use of ground eater must cease immediately. 12. Box 758 Greeley, CO 80632 Dear Mr. Seheitinga, As a follow-up to our phone conversation yesterday, this is a written memorial of our progress on traffic related issues at a couple of Use by Special Review sites. Briefly, with regard to the Green/Croissant project (USR-1329) on the county line, we are planning to meet at Weld County Public Works on November 14th to discuss implementation of intersection improvements. You suggested a meeting time of 2:00 p.m. on the 14`h, but Roxann Hayes of Larimer County Public Works requested that we change the time to 3:00 p.m. to better coordinate with her schedule. Please let me know if this presents a conflict. Our most recent discussions have covered the Perry Sand and Gravel Mine (AmUSR- 921) in somewhat more detail, with the Board of County Commissioners hearing scheduled for this week. I believe our conversation yesterday reflects the understanding that was arrived at during the Planning Commission hearing on September 4th. The trip tickets you reviewed were submitted to the Public Works Department to insure that the Traffic Study contains current information; because intersection improvements have already occurred at U.S.H. 85 and WCR 6, the only item for which additional improvements are in question, as we discussed yesterday, is a left turn bay at the entrance to the Perry mine site. This improvement would not be warranted given the current level of traffic, far below the threshold of 10 vehicles per hour (refer to the Banks and Gesso, LLC transmittal dated September 21). At the Planning Commission hearing on September 4`h, Don Carroll and Diane Hougtaling concurred that all traffic and traffic improvement related conditions in the Use by Special Review process would be satisfied if the Applicant substantiated that the current level of traffic is below the turning warrant. I believe our recent correspondence and conversations reflect the resolution envisioned by the Planning Commission and County staff. As you noted, the relevant provision of the current draft USR resolution is item 3A, which stipulates that "prior to commencing operations, the upgrade and paving, and any additional intersection improvements associated with heavy hauling that may be identified in the requested information. shall [ ,I, EXHIBIT I Traffic Follow-up. Since, as Public Works is aware, all other required traffic improvements have occurred under the existing USR, 3A is triggered only if westbound traffic entering the mine site rises to the warrant level of 10 vph (or the even more unlikely event that eastbound traffic on WCR 6 turning right into the site attains a level greater than 25 vph). The present USR Amendment does not modify the production rate resulting in the current trip tickets, making it unlikely that traffic into and out of the site will ever reach the warranted level. To put this issue of item 3A to rest, I am sending a copy of this letter to the Department of Planning Services, to be placed in the AmUSR-921 file. The Applicant concurs with your understanding that no left turn bay will be required unless traffic turning into the site reaches the warranted level (as identified in the original Traffic Study). In the event that traffic problems do occur on Weld County Road 6 as a result of a high volume of haul traffic turning into the site, the Applicant will defer to the recommendations of the original Traffic Study regarding installation of a left turn bay.
