HomeMy WebLinkAbout20010655.tiff HEARING CERTIFICATION DOCKET NO. 2001-19 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1310 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (EQUINE FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - REVA BARRETT A public hearing was conducted on April 4, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 16,2001,and duly published March 21,2001, in the Tri-Town Farmer and Miner,a public hearing was conducted to consider the request of Reva Barrett for a Site Specific Development Plan and Use by Special Review Permit #1310 for an Agricultural Service Establishment (equine facility) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light gave a brief description of the location of the site, and stated the applicant has changed the request from six mobile homes down to four. She explained that due to the intensity of the use, staff felt it was more appropriate for the applicant to go through the Use by Special Review process, rather than apply for four separate Accessory to the Farm permits. Ms. Light stated the Use by Special Review process was initiated as a result of a violation on the site, which will be resolved once this permit is approved. She stated there are indoor/outdoor riding arenas, various outbuildings, and a single family dwelling on the property,and she gave a brief description of the surrounding uses. Ms. Light stated four referral agencies did not respond,five offered comments,two responded with concerns, and two surrounding property owners submitted letters of concern. She stated the Conditions of Approval and Development Standards should address or mitigate any concerns. In response to Commissioner Vaad, Ms. Light stated the surrounding property owners who submitted letters were at the Planning Commission hearing and were mailed copies of the Planning Commission Resolution indicating their concerns will be addressed. Responding to Chair Geile, Ms. Light stated the site is allowed 300 animals as a use by right,and added this lot was created in conjunction with a Subdivision Exemption and there is a residence on both lots. She further stated the four mobile homes will be used for employee housing. 2001-0655 PO: PLIPIA-L f1LlFP) PL1479 HEARING CERTIFICATION - REVA BARRETT (USR#1310) PAGE 2 Don Carroll, Department of Public Works, stated Weld County Road 24 is a paved,collector status road,which should have 80 feet of right-of-way at full build out; however, there is currently only 60 feet of right-of-way. He stated the most recent traffic count at the intersection of Weld County Roads 24 and 19 indicated there is approximately 1,342 vehicles per day on the road. He indicated the location of the main and secondary accesses, and added there is a third access east of the home which the applicant has agreed to close. In response to Commissioner Jerke, Mr. Carroll stated the applicant will be required to reserve an additional 20 feet of right-of-way for the future build out of Weld County Road 24, which is addressed in Condition of Approval#2.J. Responding to Chair Geile, Trevor Jiricek, Weld County Department of Public Health and Environment, stated because the number of animals will not exceed the amount allowed as a use by right,the applicant is only required to comply with the Best Management Practices, which require control of manure and wastewater on the property, and prohibits discharge from the property. George Nichols, attorney, represented the applicant and stated he started representing the applicant in October 2000, because Ms. Barrett's prior representative was injured. He reiterated that the applicant is reducing the request from six mobile homes down to four. Responding to Commissioner Jerke, Mr. Nichols stated there are currently 80 horses at the site, and there will be an additional 30 foals this spring. He explained one of the employees monitors the animals, two do all of the feeding duties, and the fourth maintains all of the machinery and grounds. He further stated the existing septic system will be reviewed by the person who designed and installed it in addition to determining what will be needed for the four mobile homes. He stated the necessary applications have been filed with the Health Department and the systems will need to be in place before the mobile homes are occupied. Responding to Chair Geile, Mr. Nichols stated the applicant is planning on placing three mobile homes,with the option of one more in the future, and added the campers have been removed and no overnight camping will be allowed. In response to Commissioner Masden, Mr. Nichols stated the manure is spread on the 60 acres of pasture owned by the applicant, and any excess is removed and hauled to a waste management or composting facility. Mr. Jiricek stated the number of animals does not require any soil testing; however, the applicant is aware of the effects of nitrogen on the soil. No public testimony was offered concerning this matter. Responding to Chair Geile, Mr. Nichols stated he and the applicant have reviewed and agree with the Conditions of Approval and Development Standards. Commissioner Vaad moved to approve the request of Reva Barrett for a Site Specific Development Plan and Use by Special Review Permit#1310 for an Agricultural Service Establishment (equine facility) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.
