RE: APPROVE AMENDMENT TO ST. VRAIN SANITATION DISTRICT SERVICE PLAN,
INCLUDING A BOUNDARY CHANGE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to the provisions of Title 32, Article 1, Part 2, C.R.S., the Board of
County Commissioners of Weld County, Colorado, held a public hearing to consider proposed
amendment to the Service Plan of the St. Vrain Sanitation District on the 25th day of July, 2001,
and
WHEREAS, notice of the hearing was duly published three times in the Tri-Town Farmer
and Miner, on July 4, 11, and 18, 2001, as required by law, and notice was forwarded to the
petitioners, to the Division of Local Government, and to the governing body of each municipality
and special district which has levied an ad valorem tax within the next preceding tax year and
which has boundaries within a radius of three miles of the proposed service area, and
WHEREAS, the hearing was open to the public, a record of the proceedings was made,
and all interested parties, as defined in Section 32-1-204, C.R.S., were afforded an opportunity
to be heard, and
WHEREAS, no interested parties appeared personally or presented written objections,
and
WHEREAS, the Board has considered the proposed amendment to the Service Plan
and all other testimony and evidence presented at the hearing, and
WHEREAS, the proposed amendment to the Service Plan proposes to amend St.
Vrain Sanitation District Service Area Plan Map and legal description to exclude the following
area:
Part of the E1/2 of Section 21, all of the N1/2 and parts of the
S1/2 of Section 22, all of the N1/2 of Section 23, and part of the
N1/2 of Section 24, all in Township 3 North, Range 68 West of the
6th P.M., Weld County; and all of the SW 1/4 of Section 6, all of
the N1/2 and part of the SE1/4 of Section 7, and part of the
SW1/4 of Section 8, Township 2 North, Range 68 West of the 6th
P.M., Weld County;
and that the following area be included:
The N1/2 and SW1/4 of Section 18, Township 2 North, Range 67
West of the 6th P.M., Weld County; part of the SE1/4 of
Section 13, parts of the NE1/4 and SW1/4 of Section 24, part of
the W1/2 of Section 24, and parts of the W1/2 and SE1/4 of
Section 36, all in Township 2 North, Range 68 West of the 6th
P.M., Weld County; all of Sections 2, 3, 11, and 15, all of the

W1/2 and parts of the E1/2 of Section 1, all of the W1/2 and part
of the NE1/4 of Section 12, parts of the NE1/4, SE1/4, and SW1/4
quarters of Section 10, part of the NW1/4 of Section 13, all of the
W1/2 and part of the E1/2 of Section 14, part of the E1/2 of
Section 16, part of the NW1/4 of Section 21, and part of the N1/2
of Section 22, all in Township 1 North, Range 68 West of the 6th
P.M., Weld County, and
WHEREAS, the proposed amendment to the Service Plan also proposes to allow the
District to increase its maximum plant capacity to 4.5 MGD, and to eliminate the requirement
currently in the Service Plan to consider the establishment of a Metropolitan District, and
WHEREAS, although the proposed amendment to the service plan submitted by the
District contains details regarding the District's desire to be involved with and a part of a
proposed Drainage Authority to effectively manage storm water drainage throughout the
District, the District has submitted a letter to the Board asking that the Board consider such
details as "information only," rather than as a formal request for the Board to amend the Service
Plan to address such desire.
NOW, THEREFORE, HE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado:
Section 1. The Board of County Commissioners of Weld County, Colorado (the
"Board") does hereby determine that all of the requirements of Title 32, Article 1,
Part 2, C.R.S., relating to the filing of the amendment to the Service Plan for the
St. Vrain Sanitation District have been fulfilled and that notice of the hearing was
given in the time and manner required by law.
Section 2. The Board hereby finds and determines that:
a. There is sufficient existing and projected need for organized
service in the amended service area to be serviced by the District.
b. The existing service in the amended area which may be served by
the District is inadequate for present and projected needs.
c. The District is capable of providing economic and sufficient
service to the amended service area within its proposed
boundaries.
d. The area to be included in the District has and will have the
financial ability to discharge the proposed indebtedness on a
reasonable basis.
e. Adequate service is not or will not be available to the amended
service areas through the County, other existing municipal or

quasi-municipal corporations, including existing special districts,
within a reasonable time on a comparable basis.
f. The proposal is in substantial compliance with a master plan
adopted pursuant to Section 30-28-108, C.R.S.
g. The proposal will comply with the 208 Area Wide Wastewater
Management Plan.
h. The amendment to the service area will be in the best interests of
the area proposed to be served.
Section 3. The proposed amendment to the Service Plan of the St. Vrain Sanitation
District is hereby approved, as follows:
a. That the St. Vrain Sanitation District Service Area Plan Map and legal
description is amended to exclude the following area: Part of the E1/2 of
Section 21, all of the N1/2 and parts of the S1/2 of Section 22, all of the
N1/2 of Section 23, and part of the N1/2 of Section 24, all in Township 3
North, Range 68 West of the 6th P.M., Weld County; and all of the
SW 1/4 of Section 6, all of the N1/2 and part of the SE1/4 of Section 7,
and part of the SW1/4 of Section 8, Township 2 North, Range 68 West of
the 6th P.M., Weld County.
b. That the St. Vrain Sanitation District Service Area Plan Map and legal
description is amended to include the following area: The N1/2 and
SW1/4 of Section 18, Township 2 North, Range 67 West of the 6th P.M.,
Weld County; part of the SE1/4 of Section 13, parts of the NE1/4 and
SW1/4 of Section 24, part of the W1/2 of Section 24, and parts of the
W1/2 and SE1/4 of Section 36, all in Township 2 North, Range 68 West
of the 6th P.M., Weld County; all of Sections 2, 3, 11, and 15, all of the
W1/2 and parts of the E1/2 of Section 1, all of the W1/2 and part of the
NE1/4 of Section 12, parts of the NE1/4, SE1/4, and SW1/4 of
Section 10, part of the NW1/4 of Section 13, all of the W1/2 and part of
the E1/2 of Section 14, part of the E1/2 of Section 16, part of the NW1/4
of Section 21, and part of the N1/2 of Section 22, all in Township 1 North,
Range 68 West of the 6th P.M., Weld County.
c. That the Service Plan is amended to allow the District to increase its

Section 4. A certified copy of this Resolution shall be filed in the records of Weld County
and submitted to the petitioners.
