GORDON JOHNSON, AND CHANGE OF ZONE#464 FROM THE A(AGRICULTURAL)ZONE DISTRICT TO THE PUD (PLANNED UNIT DEVELOPMENT)ZONE DISTRICT GRANTED TO CHARLES EASTON- ROBERT EASTON A public hearing was conducted on August 8, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tern - EXCUSED Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Monica Daniels-Mika Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated July 20, 2001, and duly published July 25, 2001, in the Tri-Town Farmer and Miner,a public hearing was conducted to consider the request of Robert Easton for Revocation of both Change of Zone#374 from the A (Agricultural)Zone District to the PUD (Planned Unit Development) Zone District granted to Charles and Evelyn Easton and H. Gordon Johnson, and Change of Zone #464 from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District granted to Charles Easton. Lee Morrison, Assistant County Attorney, made this a matter of record. Monica Daniels-Mika, Department of Planning Services Director, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Mika submitted a letter from the applicant, marked Exhibit E, requesting the Board proceed with its consideration of the matter, although the applicant was not in attendance. Ms. Mika explained the applicant is requesting the change of zoning be revoked. She gave a brief chronological summary of the various land use changes which have taken place on the property since 1982. She stated the property has also been divided through court action; however, it was determined that all of the property should be reverted back to the original agricultural zoning. Ms. Mika stated the applicant has requested the County recognize the existing airport, which has existed since 1966 therefore, staff did approve a nonconforming use for the airport. She stated the applicant understands that any future subdivision of the property will require a new application. In response to Commissioner Jerke, Ms. Mika stated three Recorded Exemptions were created through court decree, with the condition that the land be zoned agriculture. She further stated action from the Board on this matter will clean up the zoning of the property and allow the Recorded Exemptions to be completed. She further stated revocation of a Change of Zone does not require a new plat and will be effective upon signature of the Resolution. 2001-2097 �pCn : ,% N ec Pi() PL0382/PL0857 HEARING CERTIFICATION - ROBERT EASTON (REVOKE COZ#374 AND COZ#464) PAGE 2 (Clerk's Note: See Minutes for August 8, 2001, for motion concerning vacation of USR#960.) Chair Geile clarified the applicant is not present,as indicated in Exhibit E. No public testimony was offered concerning this matter. Commissioner Masden moved to approve the request of Robert Easton for Revocation of both Change of Zone #374 from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District granted to Charles and Evelyn Easton and H. Gordon Johnson, and Change of Zone #464 from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District granted to Charles Easton, based on the recommendations of the Planning staff and the Planning Commission. The motion was seconded by Commissioner Long, and it carried unanimously. Following discussion, Commissioner Jerke moved to indicate the Board concurs with the administrative decision to establish Non-Conforming Use, NCU #345. Commissioner Masden seconded the motion, which carried unanimously. This Certification was approved on the 13th day of August 2001.
