HomeMy WebLinkAbout20010425.tiff 0 CORRECTED RESOLUTION RE: APPROVE RECORDED EXEMPTION #2870 - ESTATE OF MARIE ETTER, C/O HARROLD ETTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #2870, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for Recorded Exemption #2870 was submitted by the Estate of Marie, do Harrold Etter, 8405 U.S. Highway 34, Windsor, Colorado 80550, for property which is located in part of the W1/2 SW1/4 of Section 30, Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 90 acres and 7 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2870 by the Estate of Marie Etter, do Harrold Etter is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. Prior to recording the plat: A. Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelope shall be delineated on the plat. All building envelopes shall take into consideration setbacks from oil/gas structures as required by Section 23-3-50.E of the Weld County Code. B. The applicant shall submit to the Weld County Department of Planning Services evidence that any existing septic system meets all requirements of the Weld County Department of Public Health and Environment. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead shall require a variance in accordance with the terms of Section 23-6-10.C of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) All construction or improvements occurring in the flood plain, as delineated on Federal Emergency Management Agency Firm Community Panel Map 080266 0608 D, dated September 27, 1991, shall comply with the Flood Hazard Overlay District requirements of Section 23-2-480 of the Weld County Code. 4) The installation of any septic system within the One Hundred Year Flood Plain shall comply with the Weld County I.S.D.S. Flood Plain Policy. In accordance with the State of Colorado I.S.D.S. Regulations, no septic system shall be installed within the floodway. 5) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 6) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot B has an adequate water supply of sufficient quality, quantity and dependability. 7) Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15 of the Weld County Code. 8) All mobile homes as accessory farm uses are temporary. Allowance of the mobile homes shall be extended only if the use continues to be in conformance with the criteria established in Section 23-4-170.A of the Weld County Code. The mobile homes shall be removed from the property if they cannot be legally permitted for an approved use as listed in Section 23-4-170.A of the Weld County Code. 2001-0425 RE2870 • • RE #2870 - ESTATE OF MARIE ETTER, C/O HARROLD ETTER PAGE 4 9) Effective December 1, 1999, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Windsor Service Area Road Impact Program. 10) The text of the Right to Farm Covenant as written in Appendix 22-E of the Weld County Code. 11) A Non-Conforming Use exists on Lot A. The repair shop and mobile homes are documented in the Department of Planning Services Non-Conforming Use file #32. The Non-Conforming Use must follow the regulations listed in Section 23-7-40 of the Weld County Code. 12) The two mobile homes (one of which is residential)without permits are part of the Non-Conforming Use. Replacement of the mobile homes will only be allowed by permitting the structures through required procedures in effect at the time. 3. The applicant shall submit a Mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The plat shall be submitted within sixty (60) days from the date of approval by the Weld County Board of Commissioners. The applicant shall be responsible for paying the recording fee. Masden 2001-0425 RE2870 • RESOLUTION RE: RESCIND RESOLUTION #2001-0200 FOR RECORDED EXEMPTION #2870 - ESTATE OF MARIE ETTER CIO HARROLD ETTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on January 22, 2001, the Board approved Recorded Exemption #2870, for the Estate of Marie Etter, do Harrold Etter, and WHEREAS, due to a clerical error, the Board deems it advisable to rescind Resolution #2001-0200, dated January 22, 2001, and re-adopt the substance of said resolution after revisions. Any existing septic system which is currently not permitted through the Weld County Department of Public Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the required septic permits. In the event the system is found to be inadequate,the system must be brought into compliance with current I.S.D.S.regulations. C. The applicant shall submit evidence that each home is on a separate legal water system. The North Weld County Water District has been notified that the three homes have been sharing one tap. • D. Lot A shall use the existing residential access point. No additional accesses shall be granted. The minimum width of the flag pole access is 30 (thirty)feet. E. Lot B shall use the existing agricultural /oil and gas/ditch road access points necessary for agricultural operations as no additional accesses shall be granted. F. All approved accesses shall be clearly shown on the plat. G. Weld County Road 64.5 is designated on the Windsor Study Area Capacity Improvement Needs as a collector road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 40 feet from the centerline of Weld County Road 64.5 shall be delineated right-of-way reservation for future expansion of Weld County Road 64.5. This road is maintained by Weld County. H. Weld County Road 25 is designated on the Windsor Study Area Capacity Improvement Needs as a paved rural road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 25 shall be delineated on the plat as right-of-way. This road is maintained by Weld County. The applicant shall submit written evidence to the Weld County Department of Planning Services verifying that the occupant of the mobile home permitted byZPMH#568,for temporary accessory farm use, is principally employed at or engaged in the farming operation on the subject property in accordance with Section 43.2.3 of the Weld County Zoning Ordinance. The evidence shall consist of tax records, employment agreements or other documentation as determined suitable by the Weld County Department of Planning Services. Failure to submit the required documentation may result in the cessation of the allowance of the mobile home for temporary accessory farm use. J. Should it be deemed necessary to remove the mobile home permitted by ZPMH#568, Lot A shall be reconfigured to omit the area containing the mobile home. K. The applicant shall provide the Weld County Department of Planning Services with a certificate from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. L. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. (Ordinance 210) 10) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County maybe open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. a'CiG/D hJs a a Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest,and gravel roads; odor from animal confinement, silage, and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient that urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. The site has a non-conforming car salvage and repair business (NCU-32). The non-conforming use also includes two mobile homes. The first is used for storage and the second is a residence. There is also an existing farmhouse built in 1874 along with a mobile home permitted in 1982 for temporary accessory farm use. All three of these residences are on proposed Lot A of Recorded Exemption 2870. Condition of Approval 2.1. requires that the applicant submit written evidence to the Weld County Department of Planning Services verifying that the occupant of the mobile home permitted by ZPMH 568,for temporary accessory farm use, is principally employed at or engaged in the farming operation on the subject property in accordance with Section 43.2.3 of the Weld County Zoning Ordinance. The applicants are requesting that the accessory to the farm mobile home be allowed to stay on the property, however, Lot A will not contain any type of farming operation. Planning Staff is recommending denial of this request. The applicants have three existing residences on a lot where only one should exist. The applicants are also requesting that they be allowed to substitute the accessory to the farm mobile home for the farmhouse. Planning Staff has determined that this is not acceptable. Section 74.3 of the Weld County Zoning Ordinance states "Substitution of Structures. Should such non-conforming structure be moved for any reason, for any distance whatever, it shall thereafter conform to the regulations for the zoning district in which it is located after it is moved." Further Section 71 states "Intent. Within the zoning districts established by this Ordinance or amendments thereto, there exist lots, structures, uses of land or structures, and characteristics of use which were lawful before zoning regulations were passed or amended, but which would be prohibited, regulated, or restricted under the terms of this Ordinance or future amendment. It is the intent of this Ordinance to permit these non-conformities to continue until they are removed or abandoned, but not to encourage their survival. It is further the intent of this Ordinance that non-conformities shall not be enlarged upon, expanded or extended, nor be used as justification for adding other structures or uses prohibited elsewhere in the same zoning district. Non-conforming uses are declared by this Ordinance to be incompatible with permitted uses in the zoning districts involved." Planning Staff has determined that the appropriate application to satisfy the applicants request would be a Use by Special Review Permit for the expansion of a non-conforming use. However, the applicants have requested that the Board of County Commissioners review RE-2870. In 1985, Petitioner owned the Tigges Property as joint tenants with her hursbard. Robert D. Tigges, who was also a sibling of the Decedent. Robert D. Tigges has predeceased Petitioner. 4. Prior to 1985. Decedent discovered that the access road ("Access Road") to the etc: Property and certain improvements erected by Decedent were in fact located on the Tigges Proper } 5. The Decedent approached Petitioner and her husband, and requested that tip quitclaim a portion of the Tigges Property so that the new boundary line would be situated along ;r.e east boundary.ofalhtttttecess road. 6. Dear Mr Drouhard, This letter is in response to your request that Weld County Planning Staff reconsider the third alternate building site proposed for Lot B. Planning Staff has determined that the additional justification for the location of the third building envelope is insufficient for staff approval for the following reasons: 1) The area requested is prime farm ground. Although the first and second building envelopes will also remove prime farm ground, they do not have as large of an impact on the site. 2) The proposed building envelope is located in close proximity to the non-conforming junkyard on Lot A. A residence and the junkyard are incompatible uses. To allow development this close to the junkyard would be inviting conflict with future homeowners. 3) The Lot has already been approved for two alternative locations that are preferable. 4) Placing the improvements in the interior of a lot could cause conflict in the future should future owners wish to divide off improvements. The results of such a division are flag lots that do not conform with orderly and efficient development. Lot A of RE- 2870 is a good example. Planning Staff is willing to consider a different proposal should you wish to submit another alternative. Allowing multiple building envelopes does provide some flexibility for future property owners. Planning Staff is consistent in reviewing building envelope locations. Staff considers such issues as the location of prime farm ground, incompatible uses, flood plain, oil and gas structures, ditches and accesses. We also consider if the site has preferable alternatives that will have less impact on the productiveness of the site now and in the future. The Etter's have operated a farm repair shop on the subject property since the 50's. This mobile home permitted ZPMH#568 has been the home of Stephen Etter, who has worked in the repair shop since the mobile home was approved and placed on the subject property. Both Stephen and Vernon Etter, son and father, have worked and ran the family business all their lives. The County Commissioners granted the mobile home on 3/17/82 for"accessory mobile home for farm use". When granted, both Stephen and Vernon were living in the homes with their primary occupation being the farm repair shop, not farming. They indicated that was their intent when this was approved in 1982. Their farm repair shop is the primary source of income with the farm being secondary. They can provide backup documentation regarding this request. As the Approval Conditions set today, the planning department has conditionally approved two of three residences on Lot A of RE 2870. These two residence's are the mobile home and the older farm house near the shop. Harold Etter's mother lived in the farmhouse last fall/winter prior to her demise. Since her demise,the house has been used for storage and family. This home is in need of major repair which is not feasible, fmancially for either Stephen or Vernon,thus the reluctance to vacate die mobile home and move into the farmhouse. With this knowledge, The Etter's would abandoned (make non-habitable) in exchange for keeping the 2v° mobile home currently lived in by Stephen Etter. The site has a non-conforming car salvage and repair business (NCU-32). The non-conforming use also includes two mobile homes. The first is used for storage and the second is a residence. There is also an existing farmhouse built in 1874 along with a mobile home permitted in 1982 for temporary accessory farm use.All three of these residences are on proposed Lot A of Recorded Exemption 2870. Condition of Approval 2.1. requires that the applicant submit written evidence to the Weld County Department of Planning Services verifying that the occupant of the mobile home permitted by ZPMH 568, for temporary accessory farm use, is principally employed at or engaged in the farming operation on the subject property in accordance with Section 43.2.3 of the Weld County Zoning Ordinance. The applicants are requesting that the accessory to the farm mobile home be allowed to stay on the property, however, Lot A will not contain any type of farming operation. Planning Staff is recommending denial of this request. The applicants have three existing residences on a lot where only one should exist. The applicants are also requesting that they be allowed to substitute the accessory to the farm mobile home for the farmhouse. Planning Staff has determined that this is not acceptable. Section 74.3 of the Weld County Zoning Ordinance states "Substitution of Structures. Should such non-conforming structure be moved for any reason, for any distance whatever, it shall thereafter conform to the regulations for the zoning district in which it is located after it is moved." Further Section 71 states "Intent. The division of land is due to the probate of an estate and an inheritance. The heirs may sell the larger 90-acre parcel of land with no anticipated change in use. Principle use is currently primarily a non-conforming as a salvage yard, automotive repair and secondary agricultural use. Anticipated future use will reduce the amount of non-conforming use by approximately 50%. The automotive garage "Etters Garage and Salvage" was licensed in 1953, opening for business in 1954. Of the 97 acres of the parcel, 62 acres are prime farm ground, with18 acres designated as pasture. The principle, original homestead house was built in 1874, as a stagecoach stop. The Secondary residence, a mobile home was added in 1967, then an addition of a 12'x57' mobile home. That residence subsequently had a 25' x 25' addition built on it. An additional mobile home was placed on the property in 1982. During the years various structures that remain today were placed on the property, these include: a 14'x 65' shed built in 1941, a 12'x 16' shed built in (1982), a 40'x 50' shop built in 1940, a 14'x 32' barn built in 1961, a tractor shed built in 1940, a cattle shed built prior to 1940, 2 storage trailers were placed on the property between 1965 and 1971, along with other miscellaneous shed and granaries (approx. 8) between the years of 1940-1960. The parcel is supplied by irrigation from the Whittney Ditch and other farm ditches, since 1920. There are no oil or gas wells located on the property. 4. The seven-acre parcel will go to one heir; remaining in its current use as (2) residences and farm automotive repair shop. The business has been in operation since 1953 and the associated residence has been on the property since 1967. The 90-acre parcel will be sold off or dispersed to the other heirs pursuant to the last will and testament of the deceased. No change of use is anticipated. 5. This will ensure future conformance of and subdivision plans with the public improvement plans of the County and various municipalities as future growth pressures are placed on the subject property. Application of the recorded exemption and reduction in existing use ensures coordination with future municipal improvement plans and programs. Division of the bulk of the property in its undeveloped, agricultural, use will further safeguard the public interest, protects the interests of the private owner(s) (the estate), and serves to encourage that future development, if any, will be well-planned and will subject future subdividers to adequate standards for design and improvement. Applicants believe that if future subdivision or development is contemplated, modern procedures and standards will apply; therefore equitable handling of subdivision plans will result. The agricultural use will be maintained: agricultural land will therefore be preserved and its most productive agrarian use is promoted. There is no significant wooded in need of protection from injure resulting from fire. Irrigation water currently associated with the agrarian use is necessarily retained for that use. Erosion, sedimentation and other pollution of surface and subsurface water is controlled through the existing use: natural vegetation protection is not an issue. SIP M No additional protections against flood control are applicable, since all existing measures have long been in place through the existing usage of the property. Accordingly, restrictions or building regulation in flood-prone areas is neither necessary nor applicable to this property. Because of the level terrain and agrarian use, there is no foreseeable event, which would result in loss and/or injury from landslides, mudflows or geological disaster. Adequate space for future development of schools and parks to serve the population would be addressed under modern zoning and planning processes if future owners were to contemplate changes of existing use.
