The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40.B.1 through 24-8-40.8.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
The existing septic system located on the larger lot was evaluated in June 2001 and found to be
undersized by 42 percent for the 2 bedroom house. However,due to the date of installation the system
is considered "grandfathered". The department recommends that the system be brought into
compliance with current Weld County ISDS Codes. �- 3-S'40

2. The Applicant has proposed a well as the source of adequate water for Lots A, B and C. Property
owners are advised that the quantity of water available for usage may be limited to specific uses, i.e.,
"Domestic Use Only," etc. Because each situation is unique, the Department of Planning Services
encourages property owners to contact the Office of the State Engineer, Division of Water Resources
(1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581),to discuss each
individual situation.
3. Topographic or physical features of the proposed Lot B, such as ravines, ditches, streams etc. may
limit the area available for a new or replacement septic system. Prior to recording the plat the Weld
County Department of Public Health and Environment recommends that the applicant review the
Weld County Code pertaining to septic systems to assure that any installed septic system will comply
with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size
to allow the installation of a septic system the lot may need to be enlarged.
4. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 1475-13-2 RE 3173
_'B. The applicant shall submit to the Weld County Department of Planning Services evidence that
any existing septic system meets all requirements of the Weld County Department of Public
Health and Environment. The Weld County Department of Public Health and Environment was
unable to locate a septic permit for the septic system located at 3538 Weld County Road 59.
Any existing septic system which is currently not permitted through the Weld County
' Department of Public Health and Environment will require an I.S.D.S. evaluation prior to the
rI�� issuance of the required septic permits. In the event the system is found to be inadequate, the
system must be brought into compliance with current I.S.D.S. regulations.
`C. . The applicant shall submit a sketch of the existing septic system in relation to the proposed lot
J line to the Weld County Department of Public Health and Environment. Evidence of approval

a D. The applicant shall submit a joint ownership,access and/or operation maintenance agreement
11-a J for the shared Well located on Lot A of RE 676. This agreement shall be delineated on the plat
V 1, and an appropriate certificate using the language set forth in the Weld County Code,Appendix
1 I ,/\; 24-F.E shall be included.
E. In accordance with Chapter 8, Article II of the Weld County Code, Lot A and Lot B shall be
granted one residential/agricultural access. Direct access from a public road shall be limited to
one access per legal parcel for residential use, no circle drives or additional accesses shall be
granted. The road shall be graded and drained to provide all weather access. Accesses shall
be placed in such a location as to have adequate sight distance in both directions, shall not be
placed below the crest of a hill or where physical obstructions are present and shall be a
minimum distance of 75 feet from any intersecting County or State roadway.

G. Lot C shall use the existing agricultural /oil and gas/ditch road access points necessary for
agricultural operations as no additional accesses shall be granted.
H. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
Weld County Road 10 is designated on the Weld County Transportation Plan Map as a local
, gravel road,which requires sixty(60)feet of right-of-way at full build out.There is presently sixty
(60)feet of right-of-way. A total of thirty (30)feet from the centerline of Weld County Road 10
shall be delineated right-of-way on the plat. This road is maintained by Weld County.
,,_, J. Weld County Road 59 is designated on the Weld County Transportation Plan Map as a local
paved road, which requires sixty (60)feet of right-of-way at full build out. There is presently
sixty(60)feet of right-of-way.A total of thirty(30)feet from the centerline of Weld County Road
59 shall be delineated right-of-way on the plat. This road is maintained by Weld County.

within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.

wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.

writing to the Weld County Department of Planning Services.
9) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads; odor from animal confinement, silage, and
manure; smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient that urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.

5. The applicant shall submit a Mylar plat and a paper copy of the Mylar plat to the Weld County
Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County
Code. The plat shall be submitted within sixty(60)days from the date of approval by the Weld County
Department of Planning Services. The applicant shall be responsible for paying the recording fee.
6. The Weld County Department of Planning Staffs approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

This letter is in response to Item # 4, B&C of the approval with conditions for RE-3173, for Alan
Burry. We are hereby submitting the Statement of Existing for Septic System permit No.
SE-0100076 issued by the Weld County Health Department on July 3, 2001. The sketch of said
system is on the back of said permit as required by the Health Department. Also attached hereto
is a letter from the Health Department which states that the system is "grandfathered" and will
not require that the system be brought into compliance with current regulations. The current
system is located some distance North of the South property line of proposed Lot B. Here again
the Health Department did a visual check on the system and did not indicate it was to close to
any property line.

Dear Mr.Burry:
On July 3,2001,an evaluation of the existing individual septic disposal system at 3538 County Road 59,
Keenesburg,Colorado, Section 13,Township 01 North,Range 64 West,was conducted by Deborah Blandin,an
environmental specialist of this department.
The existing individual septic disposal system is not of sufficient size and capacity to adequately handle the
proposed load.This evaluation is based on a final treatment capacity for a 2 bedroom residence.
Based on all available data the field is undersized by an estimated 42 percent. Because the system was installed
prior to the adoption of statewide guidelines by the Colorado Board of Health,the County considers this system
to be"grandfathered"and will not require that the system be brought into compliance with current regulations.
The Department recommends that the adsorption field be brought into compliance with current Regulations.
Please be advised that should you decide to repair your system,a repair permit must be obtained and a site
evaluation must be conducted prior to any alterations to the system.
Be advised,neither the County of Weld nor any of its agents or employees undertake or assume any liability to
the owner of the above property,to any purchaser of the above property or to any lending agency making a loan
on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and for
detecting health hazards observable at the time of inspection. This does not constitute a warranty that the system
is without flaw or that it will continue to function in the future. Inspections requested during periods of snow
cover and high soil saturation may be of questionable value to potential buyers due to adverse conditions.
Evaluations based on Statements of Existing(S.O.E.)relies on information the property owner provides,under
oath,indicating current status of the system and representing to the best of his/her knowledge the system is not
failing to function properly.

This letter is in response to Item # 4, D of the approval with conditions for RE-3173, for Alan
Burry. Mr. Burry abandoned his use of the well located on Lot - A of RE-676 in the year 1991
when he drilled his well,permitted as Well Permit Number 159227 with the Colorado Division
of Water Recourses dated January 22, 1991. Mr. Burry has not used said well located on Lot-A
of RE-676 for his home addressed as 3538 WCR 59, Keenesburg Co. or for any other use on his
farm since drilling his well, permit number 159227, located in the SW quarter of the NW quater
of Section 13, T 1N, R 64 W. This permit was submitted with the application as far as we know
and if it wasn't a copy is hereby attached. This is the only well used for Lot B of proposed
RE-3173.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.

has 160.02 acres with his farm instead of the close to 159 we had thought at application time. Mr.
Burry does want to do the three lot exemption instead of the two lot exemption. I am sending the
new sketch you asked for along with this letter. It shows that both lots "A" and"B"will be
located side by side in the Northwest corner of the property as we discussed.

1. Water supply:
(a) Domestic water is currently supplied to proposed Lot"B" by a domestic well as permitted by
the state of Colorado. Domestic water to proposed Lot"A"would be supplied by a domestic
well.
(b) Irrigation water to the farm is supplied with the inclusion of 158 acres in the Henrylyn
Irrigation District.
2. Sewage disposal for proposed Lot"B" is supplied by a septic system currently in place.
Sewage disposal for proposed Lot"A" shall be provided by a I.S.D.S. as permitted by the Weld
county Health Department.
3. The property is currently an operating farm with the exception of the improvements located on
proposed Lot "B". There is a home, garage, outbuildings and corrals located on proposed Lot
"B". The existing building site totals approximately 5 acres. Proposed Lots "A"would be a 5
acre parcel located in the North West area of the property. That would leave approximately 153
acres more or less as Lot"B". The owner feels that by placing Lot "A" in the North West area of
the property this would have less impact on the future placement of a center pivot sprinkler
system on the property, and it also would have less impact on the flood irrigation of the property
as it is now irrigated. The soil types are 79 Weld Loam and 15 & 16 Colby Loam and 40 Nunn
Loam with the main portion of the farm being soils type Colby.
4. The owner is going to continue to farm the land as he has in the past. The owner feels that by
placing Lot"A" where he has, he would not adversely affect the operations of the farm since the
sizes of the Lot has been kept minimal and the land it would occupy is comprised of some non
farm able ground and less productive ground due to alkali conditions. All lots will remain within
the compliance of the Agricultural zoning.
5. The property is located approximately 3.5 miles south of Keenesburg on Weld county Road
59. Weld County Road 10 borders the property on the North. It consists of 159 acres +/-
including the existing home site. The present use of the area is mainly agricultural.

7. To the Owners knowledge all existing structures meet minimum setbacks and offset
requirements and any proposed structures will be required to meet the same per Weld county
Zoning Regulations.

9. A primary building envelope will not be designated on Lot "B" as it has existing
improvements located on it. Lot"A"has already been kept to the size of a normal building
envelope so the owner wishes not to show an envelope on Lot "A".
10. The proposed Lots "A" and"B" are consistent with the Weld County Comprehensive Plan in
that they promote limited growth in the agricultural sector.
11.& 12. The proposed use will still be compatible with the existing surrounding land uses.
There are limited number of small residentiallagricultural tracts in the area surrounding the
parcel. The proposed lots would not adversely affect the agricultural use of the property or the
area.
13. The proposed lots are consistent with the weld County Subdivision Ordinance, section 1.3
because: the lots are not high density development in the Ag zoned sector.
Lots "A" and"B" should promote the health and safety and general welfare of the residents of
Weld County; since fee simple ownership should maintain the sites and any improvements
thereon in a responsible manner. There are no hazards associated with access onto County roads.
The proposed lots should not promote any loss or injury from land slides, mud flows, or other
geological hazards. None of the lots should add expenditures for flood relief and control
projects.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Weld County Recorded Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 10 is designated on the Transportation Plan Map as a loal gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
WCR 59 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the

REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application with concerns on
location of the proposed lot B, being located in the center of lot C creating a double frontage.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present. (Lot B)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately
size your culvert. (Lot B)
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be
granted. (Lot C)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. Prior to the release of building permits on lot A, the lot owners shall verify with
the nearest Town/City or Sanitation District to determine the location of the
nearest sewer line. In accordance with the Weld County Code, if a sewer line
exists within 400 feet of the property and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld County
Department of Public Health and Environment.
Additionally, please note the following:
1) This application is proposing a wells as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
2) The existing septic system located on the larger lot was evaluated in June 2001
and found to be undersized by 42 percent for the 2 bedroom house. However,
due to the date of installation the system is considered "grandfathered". The
department recommends that the system be brought into compliance with current
Weld County ISDS Codes.
3) Topographic or physical features of the proposed lot, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicant
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may be need to be enlarged.

In consultation with the Natural Resources Conservation Service(NRCS),we have reviewed the above
referenced case and have the following comments.
SOILS/LIMITATIONS: The soil found on this parcel of land is somewhat limited for septic tank
absorption fields and shallow excavations. It is not limited for dwellings with or without basements.
Drainage is limited. The soil is generally well suited for windbreak and landscape plantings.
PRIME FARMLANDS: No Prime Farmlands will be taken out of production.
SOIL EROSION POTENTIAL: The potential for erosion by water is moderate.
OTHER: If future land use will include grass establishment and grazing, we would recommend that the
new landowner contact the local NRCS office for guidelines on establishing and maintaining the grass and
grazing management. Additionally,the future landscape plan should address the reduction of water use
with the use of Xeriscape. We also recommend that Ron Broda,Weld County Vegetation Management
Specialist be contacted to assist the landowner in developing a weed management plan. Ron can be

PERMIT TO CONSTRUCT A WELL
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) Approved pursuant to CRS 37-90-105.
3) Water from this well may be used for domestic purposes inside one (1) single family dwelling.
) The maximum pumping rate shall not exceed 15 GPM.
5) The annual appropriation shall not exceed 1.5 acre-feet.
6) The irrigated area shall not exceed 1 acre of lawn and garden.
) This well shall be constructed within 300 feet of the location specified on this permit.
) Water from this well may be used for the watering of livestock on range and pasture.
Production is ii.nited to the Laramie-Fox Hills aquifer, which is located 770 feet below land surface and extends to
a depth of 1050 feet. Plain casing must be installed and sealed to prevent the withdrawal of ground water from
other aquifers and the movement of ground water between aquifers.
Note: Noncompliance with the procedures outlined on the attached information sheet (form GWS-5) may
void your well permit.
