FOR A SINGLE FAMILY DWELLING UNIT, OTHER THAN THOSE PERMITTED UNDER
SECTION 23-3-20.A OF THE WELD COUNTY CODE,IN THE A(AGRICULTURAL)ZONE
DISTRICT - EDWARD AND JANET SCHMIDT
A public hearing was conducted on June 20, 2001, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 1, 2001, and duly published June 6, 2001, in
the Tri-Town Farmer and Miner,a public hearing was conducted to consider the request of Edward
and Janet Schmidt for a Site Specific Development Plan and Use by Special Review Permit#1325
for a Single Family Dwelling Unit, other than those permitted under Section 23-3-20.A of the Weld
County Code, in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney, made
this a matter of record. Robert Anderson, Department of Planning Services, presented a brief
summary of the proposal and entered the favorable recommendation of the Planning Commission
into the record as written. Mr. Anderson gave a brief description of the location of the site, which
is 78.88 acres. He stated improvements on the site include a single family dwelling, outbuildings,
and mature landscaping, and he gave a brief description of the surrounding uses. Mr. Anderson
stated eight referral agencies responded favorably,three indicated no conflict,and he received one
letter of support from the surrounding property owner. Mr. Anderson stated the Planning
Commission recommends approval for the reasons as indicated in its Resolution. In response to
Chair Geile, he stated the Agricultural Zone District only allows one permanent structure per parcel
of land, the applicants are restricted from applying for a Recorded Exemption since one was
recently approved, and they intend to apply for a Recorded Exemption once they are eligible. Don
Carroll, Department of Public Works, stated Weld County Road 49.5 is a local gravel road with 60
feet of right-of-way maintained by Weld County, there are no traffic counts on this one-mile portion
of road, the applicant will use the existing access, and the Department of Public Works
recommends approval.

William Hughes, Attorney, represented the applicant and stated the second residence will be on
2.5 acres and will house their son and daughter-in-law who will help operate the farm. In response
to Commissioner Jerke, Mr. Hughes stated the son and daughter-in-law will pay all construction
costs,and Edward and Janet Schmidt will own the home until a Recorded Exemption is completed,
at which time the son and daughter-in-law will purchase the land. Chair Geile advised Mr. Hughes
that the applicants have the option of continuing this matter to a date when the full board will be
present. However, if they decide to proceed today, it will require three affirmative votes, or in the
case of a tie vote, Commissioner Vaad will listen to the record and make the determining vote. Mr.
Hughes indicated the applicants would like to proceed today.
No public testimony was offered concerning this matter. In response to Chair Geile, Mr. Hughes
stated he and the applicants have reviewed and agree with the Conditions of Approval and
Development Standards.
Commissioner Masden moved to approve the request of Edward and Janet Schmidt for a Site
Specific Development Plan and Use by Special Review Permit#1325 for a Single Family Dwelling
Unit, other than those permitted under Section 23-3-20.A of the Weld County Code, in the
A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record. The motion was seconded by Commissioner Long, and it carried unanimously.
This Certification was approved on the 25th day of June 2001.
