We have conducted an inspection of the partially constructed septic system for the project referenced
above. This inspection was conducted on September 14, 2000. The bed was inspected prior to
placement of the final cover materials.
Based on our observations,the items inspected were in general accordance with the recommendations
described in our report (4510-01-01-01.A, dated August 6, 1998). If you have any questions, feel

Dear Monica, Kim and the Board of Commissioners,
I am coming to you on behalf of our congregation for a temporary certificate of
occupancy. As we have nearly completed all of the requirements for a permanent
certificate and are only waiting to hear from our engineers concerning the okay on our re-
subdivision and site plan mylars. We have completed the improvement agreement and
we will set up a meeting with Kim from the planning department and Greg Thompson,
from the city of Greeley, concerning the landscape as soon as possible. To my
knowledge this is all we need to do to complete our USR.
We are in need of a C.O. to close on our bank loan or we will be penalized several
thousand dollars as a late fee. Our church has worked very hard and diligently this past
year to keep costs down and we are asking for a 30 day temporary certificate of
occupancy to present to the bank and to allow us time to finish getting the needed
documents to you for recording. This would also allow us the ability to utilize our
building for the upcoming holiday season.
We are asking if possible for a speedy response by letter and a phone call to myself on

Dear Mr. Perdew and Ms. Watson
Thank you for providing Staff with a paper copy of the revised Landscape Plan for Faith Tabernacle
Church.
Staff reviewed the preliminary Landscape Plan, dated October 25, 1999, against the revised
Landscape Plan submitted by Mr. Perdew during the week of December 11, 2000. Staff
determined that there are three substantial differences between the two plans.
1. The Fraxinus americana 'Autumn Purple' , American Purple Ash that served as
a street tree at the site perimeter has been removed. In exchange to the eleven
street trees, the applicant proposed to site a Picea pungens'Glauca', Colorado
Blue Spruce in the southeast corner of the property adjacent to 28th Avenue.
2. The overall numbers of the woody, herbaceous and perennial plant material has
substantially been reduced in numbers and in locations. The effect of the
reduction in numbers results in providing additional space for the plant material
to establish and grow to maturity.
3. The overall number of trees located on site has been reduced. As noted in Item
1, street trees at the site perimeter have been completely removed (Tree total
11). Trees in proximity to the physical building were counted at eight on the
Landscape Plan of October 25, 1999. The discrepancy between the number of
trees between the two proposed plans is eight trees.
After review of the submitted documents, it is the opinion of the Department of Planning Services
that the applicant shall provide four street tree plantings north of 28`" Avenue to compensate for
the reduction in numbers of on site tree plantings. This issue has been raised with Bebe Perdew
of Faith Tabernacle Church and designer of the revised Landscape Plan. Staff suggested that the
Colorado Blue Spruce be planted elsewhere on site, and that a deciduous tree with a lacy canopy
be planted adjacent to the street as shown on the Landscape Plan dated December 19, 2000 and
red lined by the Department of Planning Services.
Further, planting within the traffic islands including the island directly south of the main entry into
the Church structure, not delineated on the revised Landscape Plan shall be included in future cost
estimates and graphically delineated on the submitted Landscape Plan mylar for recording at the
Clerk and Recorders office. Turf grasses are acceptable plant material for these areas.
The applicant was requested to submit a preliminary cost estimate for all on-site improvements.
An Improvements Agreement has been submitted dated December 7, 2000. The landscape unit
cost for all landscaping was three thousand (3000.00)dollars. An itemized list of materials was not
included in the submittal.
The Department of Planning Services reviewed the revised Landscape Plan submitted by Mr.
Perdew and calculated the proposed project. Based on the calculations of the Landscape Architect
in this office, the difference in costs associated with the landscape materials appears to be
approximately twenty-five thousand dollars ($25,000.00). Given that in staff's conversations with
you, you indicated that Hudson Nursery will be providing the plant materials at a wholesale price
with the physical labor provided by parishioners,the Department of Planning Services shall require
a letter on letterhead from the Hudson Nursery outlining specifically what materials the Nursery will
be providing at the wholesale cost. This letter shall be provided to this office prior to scheduling
the Board of County Commissioners hearing for the acceptance of Collateral by the Board for this
case.
Presently, the Weld County Department of Public Works is reviewing the Improvements
Agreement, specifically the line item unit costs per Exhibit A on page 9 of this document. A
representative from the Department of Public Works will be visiting the property in the next few
days to evaluate the existing on-site conditions.
Several items shall be addressed and submitted prior to scheduling the Board of County
Commissioners hearing for the acceptance of collateral for this project. First, a Landscape Plan,
submitted on mylar, and approved by this office shall be ready for recording at the Clerk and
Recorder's office. Second, the letter on letterhead from the Hudson Nursery outlining specifically
what materials the Nursery will be providing at the wholesale cost, and third, a revised and signed
Improvements Agreement shall be submitted for final review and approval, if warranted. A Letter
of Credit or a form of collateral approved by the Weld County Attorney's office shall be submitted
with the Improvements Agreement.
When this required documentation is in our office, and ready for recording, Mr. Perdew may
request from the Director of Planning, a Temporary Certificate of Occupancy (TCO). Your request
for the TCO will be answered in writing.
The Department of Planning Services' is enclosing a "red lined" print for your reference.

COMMENTS: According to my client,although this agreement was signed on September 19,
2000, Faith Tabernacle has not put in the ditch. (See paragraph 4) Further,they tell me that the
current condition of the "ditch" is such that they could not get water if they wanted to, thereby
making it impossible to irrigate their field in the spring.

EASEMENT AGREEMENT

THIS AGREEMENT is entered this / day of September, 2000 between David and
Shannon Urano(hereinafter"Urania")and Faith Tabernacle Church, Inc.,a Colorado non-
profit Corporation (hereinafter`Faith').
WHEREAS Urano is the owner of real property described as:A tract of land located in the
Southwest Quarter (SW%) of Section 16, Township 5 North, Range 66 West of the 6th
P.M.,Weld County, Colorado, being more particularly described as follows: Beginning at
the Northeast Corner(NE Cor) of Lot 1, Peterson Subdivision First Filing and considering
the North line of Peterson Subdivision First Filing as bearing North 90°00'00"West,with
all other beatings contained herein relative thereto;Thence North 90°00'00"East,415.17
feet; Thence South 02°0T11" East, 53.50 feet to the True Point of Beginning. Said
described parcel of land contains 5.003 acres, more or less; and
WHEREAS Faith is the owner of real property described as Lots 1,2, 3, 4, 5, 6, 7 and 8,
Block 1,and, Lots 1, 2, 3, 5, 6 and 7, Block 2, Peterson-Alexander Subdivision, County of
Weld, State of Colorado; and
WHEREAS there is a ditch traversing the Faith Property which Urano uses to deliver
irrigation water to the Urano property; and
WHEREAS Urano asserts and Faith concedes that Urano is the owner of an historic
easement allowing Urano to use and maintain the ditch on Faith's property;
WHEREAS Faith is constructing a new facility on its property and desires to relocate the
existing ditch; and •
WHEREAS Faith and Urano wish to enter into an agreement governing the terms and
conditions upon which the ditch may be relocated:
NOW, THEREFORE in consideration of the mutual promises and other compensation
herein, the parties agree as follows:
t Urania consents to the relocation of the ditch in the manner and to the location
described and set forth in the attached Exhibit A. Urano confirms that these plans
have been reviewed and approved by an engineer of Urano's choosing.
2. Faith grants Urano an easement for the relocated ditch in the location set forth in
Exhibit"A' Such easement shall consist of the right to access, use and maintain
the new ditch for the purpose of delivering irrigation water to the Urano property
specifically described above. Access shall be limited to an area 10 feet on either
side of the centerline of the new ditch.

attached hereto as Exhibit"A• Once the ditch is installed, Urano shall have the
right to operate and maintain the ditch, and Faith shall have no further obligation
to operate or maintain the ditch.
7. It is the intent of Faith and Urano that this agreement and the for the benefit e easement

8. Faith will obtain subordination from all lienholders. if lienholders refuse or fail to

the Construction Deed of Trust for the benefit of Eaton Bank recorded December
7, 1999 at Reception No. 2737139, Weld County, Colorado.
10. Time is of the essence and the waiver by any party to this Agreement of a breach
of any term or provision of this Agreement shall not operate to be construed as a
waiver of any subsequent breach of any party.

CONTRACTS, CHECKS, DEPOSITS, AND FUNDS
SECTION 1. CONTRACTS
The Board of Directors may authorize any officer or officers, agent or agents of the Church in
addition to the officers so authorized by these Bylaws, to enter into any contract or execute and deliver
any instrument in the name of and on behalf of the Church, and such authority may be general or may
be confined to specific instances.
SECTION 2. CHECKS, DRAFTS, OR ORDERS
All checks, drafts, or orders for the payment of money, notes, or other evidences of indebtedness
issued in the name of the Church shall be signed by such officer or officers, agent or agents, of the
Church, and in such manner as shall from time to time be determined by resolution of the Board of
Directors. In the absence of such determination by the Board of Directors, such instruments may be
signed by either the Treasurer or the Pastor of the Church.
SECTION 3. DEPOSITS
All funds of the Church shall be deposited from time to time to the credit of the Church in such
banks, trust companies, or other depositories as the Board of Directors may select.
SECTION 4. GIFTS
The Board of Directors may accept on behalf of the Church any contribution, gift, bequest or devise
for any purpose of the Church. (Malachi 3:10; Luke 6:38; 1 Corinthians 16:1,2; II Corinthians 9:6-8)

BOOKS AND RECORDS
The Church shall keep correct and complete books and records of accounts and shall also keep

books and records of the Church may be inspected by any member of the Board of Directors, or his

Subject: Fire Code Requirements
This Letter confirms that the Faith Tabernacle Church now conforms to the requirements of the Milliken
Fire Protection District. These requirements are as follows.
1. Minimum fire flow of 2250 gallons per minute from two hydrants located on a separate water
main.
2. Minimum of a manual fire alarm system designed by an electrical engineer to meet the
requirements of NFPA 72,(National Fire Alarm Code).
3. Installation of an extinguishing system in the kitchen for cooking appliances.
These requirements have been completed by the Faith Tabernacle Church and have been inspected by the
Miliken Fire Irotection District It is the position of the Milliken Fire Protection District that the Faith
Tabernacle Church now meets the requirements of the District If you have any further questions or

intents and purposes as if he himself had signed said petition, it being thoroughly understood by the applicant that the Primary
considerationfor the granting of the petition is implant's covenant and promise that he will consent to the annexation of said territory

10.That the applicant agrees that if the area herein described shall become a part of another Town or City,the City of Greeley
shall have the right to terminate the water service to said area and individual or individuals.
II, That the applicant agrees to pay all costs for water extensions as may be required by the Director of Water unless
specifically exempt from certain costs by utility policies approved by the City Council,
12.That the applicant agrees to pay the regular rates now established or that may in the future be established for the class of
water servioe furnished,

be project water,Greeley-Loveland Irrigation Co.water,Lake Loveland water,Seven Lakes Reservoir water and/or direct flow river
rights.
15.That all of the terms and conditions hereof shall extend to and be binding upon the heirs,assigns and successors in interest
of the parties hereto
16.Whenever the word he,his or hire is used herein such word shall also mean and include the words,she,they,hers,theirs,or

17.That the applicant fuller agrees to swept the City water at the pressure as delivered in the distribution grid owned by the
City;and if in the delivery of water there is excessive pressure that would pause damage to the plumbing of the property owner,the
property owner agrees to furnish and install the necessary regulators;or if additional pressure is needed,the property owner agrees to
furnish his own auxiliary pumps.
IS. In the event that excavation is required for City of Greeley water main necessitated by repairs,replacement,or other
operations,the excavation will be backftlled safely,but surface restoration shall be responsibility of the property owner.

Dear Mrs Perdew:
The Department of Planning Services'wishes thank you for visiting our office on Friday August 4,
2000 to review your Site Plan for Use by Special Review (USR 1217). During the course of the
meeting, you stated your desire to modify the entry parking area immediately south of the
sanctuary entry. Your proposal consisted of the removal of four (4) parking stalls, including one
handicapped stall and replacing this parking area with a landscaped planter that may include a
water feature. Further, you stated that there is additional parking available on-site to meet the
requirements set forth in Section 41 of the Weld County Zoning Ordinance.
The Department of Planning Services' reviewed your request for this modification of USR 1217 and
have determined that this does not constitute a substantial change to your original submittal.
Therefore, our office will grant you this modification to the site plan. With this modification, a new
planting area is created, thus the Department of Planning Services requests a revised Landscape
Plan for Phase 1, of the Church property. Please submit this drawing and related information to
this office for review and approval.
On another subject, the Clerk to the Board failed to provide notice to surrounding property owners
for approval of a Minor Resubdivision, Case Number S-518 - vacation of Block 1, Lots 2, 3, 4, 5,
6, and 7 of the Peterson-Alexander Subdivision including the southern portion of 70th Avenue
Court, being part of Section 16, Township 5 North, Range 66 West of the 6th P.M., Weld County,
Colorado. Due to this circumstance, the case that was to be heard by the Board on Wednesday
August 9th at ten o'clock in the morning will be continued until proper notification may be provided
by the Clerk to the Board's office.

recording and offer the following comments:
Item 2.a Watson letter dated May 1, 2000 removed the Family Life Center from the USR. Further,
the Family Life Center is not a proposed building in Phase II.

Item 2.g Please delineate the right-of-way reservation for WCR 27. The typical cross section
reflecting the minor arterial requires 90 feet of right-of-way between intersections and 120
feet at the intersection. There is presently 60 feet of right-of-way and an additional 15 feet
shall be reserved for future build out. Further, the typical City of Greeley Cross section
shall be placed on the plat. (See notes on Plat for further direction)

Item 24 Please provide a completed Public Roads and Private Roads Improvement Agreement
according Policy Regarding Collateral for Improvements to the Department of Planning
Service' for review. The Department of Planning Services' will provide you with a copy
of this form should you not have one at your disposal.
Item 2.k There are fifty-two (52) parking stalls delineated in Phase I of the USR 1217 Site Plan.
Sixty-three (63) are required. Please amend drawing to reflect this number. Further, in
a letter dated August 4, 2000, the Department of Planning Services' approved a change
in the drawing to remove four (4) parking stalls immediately south of the main entrance
to the sanctuary. Please amend the drawing to reflect this change. Please delineate curb
cuts and handicapped ramps to the Church Sanctuary on the USR 1217 plat.
Item 2.1 Please provide evidence that the concerns of the City of Greeley have been addressed,
as outlined in their letter dated June 1, 1999.
Item 2.m The Resubdivision application is on file with the Department of Planning Services'. This
hearing has been rescheduled for August 30, 2000 at ten o'clock in the Board Hearing
Room, 915 Tenth Street, Greeley.
Item 2.n Faith Tabernacle has entered into an agreement to provide water from the Boomerang
Lateral Ditch to property owners to the east. Further, Faith Tabernacle has agreed to
guarantee water flow for two years within the enclosed pipe that is north of and adjacent
to the SH 34 Frontage Road and adjacent to the east property line of the property. The
irrigation pipe is be located within the fifteen (15) foot wide utility easement. Please
delineate the headgate location and direction of flow.
Item 2.o Please provide a detailed Landscape Plan identifying the number, size and species
(Botanical and Common Name) of landscape plant materials, and other landscape
improvements, including fences, lighting, water features, etc. to the Department of
Planning Services'for review and approval. The plan shall address maintenance of the
landscape materials and potential replacement of dead or dying materials, and shall be
delineated on the Landscape Plan plat for USR 1217. Further, provide evidence that the
City of Greeley has approved the Landscape Plan submitted to the Department of
Planning Services.
Item 2.p Faith Tabernacle has provided a written response to the buildings within Phase 1 and
Phase 2, Watson letter dated May 1, 2000.
