RE: APPROVAL OF USE BY SPECIAL REVIEW RELEASE OF BONDS
FOR WYOMING MINERAL CORPORATION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 5th day of May, 1982 , at the hour of 2 : 00 o'clock
ro
p.m. in the Chambers of the Board of County Commissioners for
the purpose of hearing the application for Wyoming Mineral
03 Corporation, c/o B. W. Conroy, Manager Licensing and Regulatory
s = Programs , 3900 S. Wadsworth Blvd, Lakewood, Colorado 80235 , for
a Use by Special Review for release of bonds, on the following
described real estate, to-wit:
A parcel of land located in part of the East
half of Section 24, Township l0North, Range 62
C.4 West of the Sixth Principal Meridian, County of

Weld, State of Colorado.
WHEREAS, the Wyoming Mineral Corporation application for

an in-situ uranium test site was made through Special Use

Permit applications 303 , 353 , and 390 . The approval of these
r Special Use Permits required the applicant to comply with twenty-
„ rr, one development standards , and
WHEREAS, these standards required specific performance
s' 4 by the applicant regarding posting bolds relating to water
restoration and site reclamation procedures , satisfactory
restoration of groundwater, facility removal surface reclamation
and requiredthe Board of County Commissioner' s satisfaction
of the groundwater restoration prior to further permits in
Weld County to conduct uranium solution mining, and
WHEREAS, Wyoming Mineral Corporation is requesting that the
County review the progress made in complying with the site closure
requirements and find satisfactory completion in order to release
the bonds and acknowledge satisfactory groundwater restoration, and
WHEREAS , the Board of County Commissioners heard all of
the testimony and statements of those present, has studied the
request of the applicant and the recommendations of the Weld

County Planning Commission and all of the exhibits and evidence
presented in this matter, and having been fully informed, finds
that:
1. On October 10 , 1980, subsequent to Water Quality Control
Commission hearings, issued a determination that ground-
water restoration had been completed according to terms
of the "Subsurface Disposal Permit" (including amendments)
issued in September of 1976 . This determination permitted
`0 holes to be plugged and surface restored.

2. A field inspection to the premises indicates that all
equipment and facilities have been removed in conformance
with the development standards except that reseeding
of the site has not yet been completed.

3 . The following referrals have reviewed the request to
abandon and have no objections ;
- Colorado Geological Survey;
- Colorado Mined Land Reclamation Board;
- Colorado Department of Health;
- Colorado Division of Water Resources;

- U. S. Bureau of Mines.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-

acknowledge satisfactory groundwater restoration be, and hereby is,
granted subject to the following condition:
The well plugging performance bond in the amount of forty-one
thousand, two hundred and fifty dollars ($41, 250 . 00) not be

received from the Colorado Department of Health, Radiation
Control Division.
BE IT FURTHER RESOLVED by the Board that the five thousand
dollar ($5 , 000 . 00) bond be, and hereby shall be, released at this
time.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 5th day of May,

The following business was transacted:
I hereby certify that pursuant to a notice dated April 19 , 1982 duly
published April 22 , 1982 in the Johnstown Breeze, a public hearing
was held on the request of Wyoming Mineral Corporation for a Use
By Special Review for the release of their bonds. The Planning
Commission recommendation for approval was conditional upon the
following:
The well plugging performance band in the amount of forty-one
thousand, two hundred and fifty dollars ($41 ,250 . 00) not be
released until a statement of satisfactory completion is
received from the Colorado Department of Health, Radiation
Control Division.
Mr. Honn stated that the Mined Land Reclamation Board issued a permit
to Wyoming Mineral Corporation regarding the vegetation. Mr. Honn
added that all the holes drilled have been filled. Mr. Bart Conroy,
was present representing Wyoming Mineral Corporation. Mr. Conroy
commented on the numerous bonds that his company has had to obtain
to satisfy all entities involved. He added that the site has been
completely reclaimed, reseeded, and now their commitment is to the
Mine Land Reclamation Board. Mr. Sierman owns the land and he will
decidewhen he is satisfied with the reclamation plan within the next
two years. Mr. Conroy stated that there is one hot spot left which
will be removed. Said spot is approximately one foot in size. Weld
County is holding two bonds one for $5, 000 and the other as addressed
above. There was no one in attendance at the hearing who was opposed
to the granting of said release of bonds . Commissioner C . Carlson
made a motion to release the $41, 250 bond and retain the $5 ,000 bond
until the said letter from the Colorado Department of Health, Radiation
Control Division, has been received. Commissioner N. Carlson seconded
the motion. Mr. Conroy stated that he believes that his firm has
met all the standards at this time. Commissioner C . Carlson amended
his motion by stating the $5 , 000 bond be released at this time and
the bond totaling $41, 250 . 00 not be released until a statement of
satisfactory completion is received from the Colorado Department of
Health, Radiation Control Division. Commissioner N. Carlson seconded
the motion and it carried unanimously.

County of Weld, upon release of the bond by the County of Weld, then this obliga-
tion shall be exonerated and discharged and become null and void; otherwise to

PROVIDED, however, the Surety shall not be liable undcrthis bond for an amount
greater in the aggregate than the sum designated in the first paragraph hereof, and
shall not be liable as respects any obligation related to Solution Mining Test
Activities performed after the effective date of a cancellation of this bond,
pursuant to the terms o the Weld County Commissioners. This bond shall remain in
force and effect as respects all obligations for all Solution Mining Test Activities
performed prior to the effective date of such cancellation unless the Principal
files a substitute bond which: 1) assumes liability for all obligations for all
solution mining test activities performed during the effective dates of this bond;
and 2) is acceptable to the Weld County Commissioners; or unless the Weld County
Commissioners otherwise releases this Surety.

The Wyoming Mineral Corporation application for an in-situ uranium test
site was made through Special Use Permit application 303, 353 and 390. The
approval of these Special Use Permits required the applicant to comply with
twenty-one (21) development standards. Standards 12, 13 and 21 are specifically
the subject of this review. These three standards required specific performance
by the applicant regarding posting bonds relating to water restoration and
site reclamation procedures, satisfactory restoration of groundwater,
facility removal surface reclamation and required the Board of County
Commissioner's satisfaction of the groundwater restoration prior to further
permits in Weld County to conduct uranium solution mining.
Wyoming Mineral Corporation is requesting that the County review the
-progress made in complying with the site closure requirements and find:

satisfactory completion in order to release the bonds; and acknowledge
satisfactory groundwater restoration.
THE WELD COUNTY PALNNING COMMISSION RECOMMENDS THAT THIS -REQUEST BE -APPROVED
FOR THE -FOLLOWING REASONS:
1. On October 10, 11980, subsequent to Water Quality Control Commission
hearings, issued a determination that groundwater restoration had been
completed according to terms of the "Subsurface Disposal Kermit"
(including amendments) issued in September of 1976. This determination
permitted holes to be -plugged and surface restored.
2. A field inspection to the premises indicates that all -equipment and
facilities have been _removed in conformance with the -development
standards except that reseeding of the site has not yet teen completed.
3. The following referrals have reviewed the request to abandon and have
no objections;
- Colorado Geologi-cal Survey;
- Colorado Mined Land Reclamation Board;
- Colorado Department of Health;
- Colorado Division of Water Resources;
- Weld County Health Department;
- U. S. Bureau of Mines.
The Planning Commission recommendation for approval is conditional upon the
following.
The well -plugging performance bond in the amount of forty-one
thousand, two hundred and fifty dollars ($41,250.00) not be
released until a statement oT satisfactory completion is received
_from the Colorado Department of Health, Radiation Control Division.

Re: Abandonment Request of Wyoming Mineral Corporation's Grover Test
Facility
Dear Mr. Dildine:
The Board of County Commissioners of Weld County, after having been informed
by the Department of Planning Services Staff, wishes to forward the Tollow-
ing comments to the Water Quality Control Commission:
The "Application to Abandon Subsurface Disposal System, Grover
Test Facility, Weld County, Colorado" submitted by Wyoming
Mineral Corporation appears to indicate that restoration of
ground water complies with terms of the Subsurface Disposal
Permit previously approved. The Special Use Permit author-
ized by Weld County relies on the Water Quality Control Com-
mission's review regarding proper restoration before the County
will vacate the permit and -release the associated bonds.
Furthermore, the Weld County Board of Commissioners has taken
a posture that it will not authorize any additional uranium
solution mining operations until ground water restoration is
proven effective to the satisfaction of the Board. It is the
-County's concern, therefore, that the Commission be fully sat-
i-sfied that the restoration is complete and permanently stabilized.
Weld County recognizes the potential advantages to allowing mineral
and energy developments. It, however, also recognizes the need
to protect the health, safety and welfare of its citizens in their
pursuits which, in this region of the County, are farming and ranch-
ing. Water resources are very essential for promoting these agri-
cultural pursuits which will continue to he the major occupational
and land use activities in the future.

Part 8 of the restoration report indicates the applicant is
willing to monitor one well over the next year. If the Com-
mission is satisfied with restoration results and mill, there-
fore, release dponds for water restoration, the Weld County
Board is of the opinion that at least one (1) well should be
left available for monitoring purposes. While the ane year
time period may show continued leveling trends, the Board of
County Commissioners feels monitoring should continue for up
to five (5) years. This additional -period of time swill allow
for a greater understanding of the long-term effects to the
ground -water. -Because of slow ground water movements and lack
of previous similar activities in the area, the longer time
period should insure a better understanding of the process and
any effects it may or may not have caused.
