RE: CHANGE OF ZONE #541 FROM A (AGRICULTURAL) ZONE DISTRICT TO PUD
(PLANNED UNIT DEVELOPMENT) ZONE DISTRICT FOR SEVEN (7) LOTS WITH
E (ESTATE) ZONE USES -JOHN AND CHARLOTTE CARLSON
A public hearing was conducted on May 16, 2001, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 23, 2000, and duly published October 26,
2000, in the South Weld Sun, a public hearing was conducted on November 15, 2000, to consider
the request of John and Charlotte Carlson for a Change of Zone from the A (Agricultural) Zone
District to the PUD(Planned Unit Development)Zone District for seven(7)lots with E(Estate)Zone
uses, at which time the Board deemed it advisable to continue said matter to March 14, 2001, to
set a new hearing date. At said hearing on March 14, 2001, the Board again deemed it advisable
to continue said matter to May 16, 2001, at 10:00 a.m. to set a new hearing date to consider the
revised application. Lee Morrison, Assistant County Attorney, made this a matter of record. Kim
Ogle, Department of Planning Services,stated staff has not received a revised application from the
applicant, and he recommended the matter be referred back to the Department of Planning
Services for review and processing once the new application is received.
Tom Honn represented the applicant and stated the rezoning was submitted for a residential
project; however, due to conflicts with the Airport the applicant withdrew the application with
intension of submitting a revised application for commercial uses. He stated the matter has been
continued from two previous hearing dates, to allow the application additional time to complete the
new application. Mr. Honn stated the applicant has received a draft version from his engineer,and
the application should be complete by the end of this week. He expressed concern with referring
the matter back to staff, which would result in redoing the Sketch Plan and additional fees. Chair
Geile commented this case was submitted in an attempt to develop the property prior to last year's
election regarding Amendment 24, and added the proposal was opposed by the Airport Authority
because the proposed residential uses were not compatible with the airport overlay district. Mr.
Ogle stated staff is recommending the case by referred back to the Change of Zone phase, a new
Sketch Plan and additional fees will not be required. He clarified a complete application was
received in February 2000, prior to the Amendment 24 election. Mr. Honn indicated he has no
objections to the referral back to staff as described by Mr. Ogle.

John Carlson, applicant, stated he did not intend for the process to take this long, and his engineer
is almost done with the project. Mr. Ogle reiterated no fee will be assessed for the revised
application, and referring the matter back to staff will place the case back in the normal procedure
for consideration. Mr. Carlson concurred, and added initially he was not aware of the airport's
opposition, nor that revising the application would take so long.
Commissioner Jerke moved to refer the request of John and Charlotte Carlson for Change of
Zone #541 from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone
District for seven (7) lots with E (Estate)Zone uses, back to the Department of Planning Services
for review and processing of the revised application. The motion was seconded by Commissioner
Masden, and it carried unanimously.
This Certification was approved on the 19th day of March 2001.
