Prior to recording the plat the Weld County Department of Public Health and Environment recommends that the applicant review the Weld County Code pertaining to septic systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system the lot may need to be enlarged. /. The plat shall delineate a Septic System Replacement Envelope on Lot A. Lot A shall comply with the one (1)acre minimum lot size required by Section 24-8-80.E of the Weld County Code. The applicant shall provide the Weld County Department of Planning Services with a certificate from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. K. The following notes shall be placed on the plat: ‘A) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from / the future right-of-way line. J4) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot A has an adequate water supply of sufficient quality, quantity and dependability. /5) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. A) Prior to the release of building permits on Lot A, the Lot owner shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sewer line. In accordance with the Weld County Code, if a sewer line exists within 400 feet of the property and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. "7) Future development on the property may necessitate a larger parcel than what is displayed on the plat in order to utilize a septic system. In addition,a larger parcel would provide additional dilution and attenuation of sewage wastes which may be beneficial to the environment. Off-site impacts that may be encountered include, but are not limited to, low flying aircraft, noise from aircraft, 24 hour aircraft operations, airfield equipment and other aviation related impacts. 9) WELD COUNTY'S RIGHT TO FARM. Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work,harvest,and gravel roads;odors from animal confinement,silage,and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. An existing water tap with the North Weld County Water District will be used for domestic water. See attached statement from North Weld County Water District. b. Irrigation water. The proposed exemption is for a single-family residence. Irrigation water for lawn, shrubs, and trees will be supplied from the water tap.No irrigation water has been or will be removed from the site. 2. Sewage disposal. Current Property use. The current property is approximately 21 acres. Approximately 17 acres of the southern part of this land is farm ground. Bounded on the west by Weld County Road 47,on the south by Weld County Road 50, on east by the Gilmore irrigation ditch, and on the north by the principal residence and outbuildings. The eastern edge of these 17 acres has the Gilmore ditch road running along it. Running along the ditch road is a small dirt irrigation ditch for distribution and regulation of water from the Gilmore ditch to the farmland. Approximately 4 acres of the northern part of this land consists of the principal residence and outbuildings including I acre of land where the proposed Recorded Exemption will be. These 4 acres are used for the principal residence, a small cellar storage building, an unattached garage, a tool shed, a storage &work shed, a green house, a grainery, another house where my son currently lives, parking for farm machinery, and two portable cold frames. The two small portable cold frames cover much of the 1 acre proposed for the recorded exemption. 4. Reason for exemption and lot use. Our current residence is very small, approximately 600 square feet, and very old. It has one bedroom and one bathroom. We need a larger, newer, residence where we can live comfortably in our golden years. A home that is secure, fully functional, and has modern amenities. We need a place where we can have our friends, 4 children an their spouses, and our grandchildren visit and stay the night. A place where we can easily have family gatherings on holidays. Adding on, or building where,the current home exists is virtually impossible because of the limited area and surround buildings and trees. The current residence, although sound, does not follow current building practice and it would not be prudent to build new structures attached to it anyway. The bank also requires a separate parcel on which to build before they will extend a loan for a new home. The larger parcel in this recorded exemption will be used, as before, for farming, sheds, and outbuildings. The plan for our current residence, located on the larger parcel, is to shut off water and utilities to it, and use it for storage of personal effects. The plan for the smaller parcel is to place a modular home on the parcel and use it for a single-family dwelling. The two existing, small, portable, cold frames on the smaller parcel will be moved to my son's farm. 5. The proposed new lot. The proposed new lot is south of our current residence. WCR 47 will border it on the west. It will be bordered on the south by farmland, and on the east and north by the current residence and outbuildings. It will be 1 acre. The proposed smaller parcel is currently used for only a few months in the spring for growing potted plants in cold frames. The cold frames, which do not have electricity or water, are going to be moved to my son's fain. 6. Unique physical characteristics of the site. On the smaller parcel,looking to the west, is a beautiful view of the Latham Reservoir with the Rocky Mountains in the background, reflecting off the reservoir. 7. Setback and offset requirement statement. All existing structures meet and all proposed structures would meet minimum set back and offset requirements for the Zone District in which the property is located. 8. Conservation easement. We are not interested in placing a conservation easement on the property. 9. Building envelope. If necessary, we would be willing to designate a building envelope. Both parcels have access to WCR47. 10.Consistent with the Weld County Comprehensive Plan. By dividing the approximately 21 acres into two lots with each lot containing a residence, we are in compliance with the plan in that it states two residences are not allowed on a single parceL The area for the recorded exemption is not prime farmland. 11.Surrounding land uses compatibility. The proposed recorded exemption will be used for a single-family dwelling,which is compatible with the existing surrounding land use. 12.Consistent with Weld County Zoning Ordinance. We are proposing a recorder exemption on approximately 1 acre from the existing 21 acres. The 1-acre parcel would be used for a new home, which would be our residence. The existing older residence would be used for storage and remain on the larger parcel. The agricultural productiveness of the 21 acres would not be affected by the recorded exemption. The 1-acre smaller lot is not used for farm ground in which to plant and harvest crops for farm production. An existing North Weld County Water District water tap will provide water for the proposed exemption location. The sewage system will be provided by an individual sewage disposal system that will be installed on the site. Electricity will be installed on the site.
