RE: APPROVAL OF RECORDED EXEMPTION NO. 528 - FRED AND NICKOLAS
SEKICH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Chater, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners at a public meeting held on the 3rd day of February,
1982 in the chambers of the Board, that the division into two
parcels of land, as shown on the plat known as Recorded Exemption
No. 528, being the property of Fred and Nickolas Sekich,
described as part of the Southwest quarter, Section 23 , Township 3
North, Range 68 West of the 6th P .M. , Weld County, Colorado, being
more particularly described as follows:
Attached exhibit "A" is incorporated herein
by reference
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners that the hereinabove described parcel of land owned by
Fred and Nickolas Sekich be, and hereby is , exempt from the
definition of the terms "subdivision" and "subdivided land" .
The above and foregoing resolution was, on motion duly made amd
seconded, adopted by the following vote on the 3rd day of February,
A.D. , 1982.

Re: Recorded Exemption 4528
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Fred and Nickolas Sekich for a recorded exemption. The
parcel of land on which this request is being made is described as
part of the SW$, Section 23, T3N, R68W of the 6th P.M. , Weld County,
Colorado. This property is located approximately two (2) miles south-
east of the town of Mead. The property contains approximately 116.4
acres of Class II irrigated soils and Class III and IV nonirrigated
soils. The request is to split the property into parcels of 9.19 acres
and 107.224 acres, more or less.
The applicants have entered into a contract for the sale of the 9.19
acres to Essex Crane Rental Corporation. Essex Crane Rental Corpora-
tion desires to purchase the property from the applicants in order to
build facilities to operate their crane rental business. Based on
submitted information and policies of the County, the Department of
Planning Services staff recommends the request be approved for the
following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations for submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:
The 9.19 acres, more or less, under consideration will
allow commercial and related uses to be the predominant
uses. The use will be compatible with the current "C-3"
(commercial) zoning of the property and the surrounding
commercial uses. These facts also support the proposal
as being consistent with the intent clause of the Commercial
"C-3" District.

- The proposal does not encroach the surrounding agricultural
uses. It will utilize existing commercial property and
therefore, is consistent with the Weld County Comprehensive
Plan.
- The proposal was reviewed by the town of Mead and was found
to be compatible with the interest of the town. It also
is in compliance with Section 1-3 of the Weld County
Subdivision Regulations; therefore, the proposed use is
not inconsistent with efficient and orderly developments.
- The proposal does not exist in an Overlay District Area.
- The proposed lots meet the minimum size requirements for
land division for the Commercial District.
- The proposed lots will have proper access to an existing
public road.
- A letter from the Little Thompson Water District indicates
the water supply is adequate.
- A letter from the Weld County Health Department indicates
an adequate means for the disposal of sewage.
- The proposed lots are not part of a recorded exemption
within the las five (5) years.

Dear Members of the Planning Commission and
Board of County Commissioners:
The applicants, Nick Sekich, Jr. and Fred Sekich, in support of their
request for a recorded exemption on a part of the above-referenced
property, submit this explanatory letter setting forth the reasons for
their request for the recorded exemption. Presently, the applicants are
the owners of all the property described in the application and
described as Lots A and B. The applicants are requesting a recorded
exemption on Lot A, as described in the application. Lot A is presently
zoned Commercial Planned Unit Development and is a vacant parcel of
ground.
The applicants have recently entered into a contract for the sale of the
property described in Lot A to Essex Crane Rental Corp. Essex Crane
Rental Corp. desires to purchase the property from the applicants in
order to build facilities to operate their crane rental business here in
Weld County. Essex Crane Rental Corp. desires to operate its crane
rental business out of Weld County, and in paticular, the property
described in Lot A because of the property's central location and its
excellent access to Interstate I-25.
The applicants have owned Lot A since its purchase in August of 1977.
Since that time, they have not requested any division or recorded exemp-
tion of the property, not have the prior owners, to the knowledge of the
applicants, requested a recorded exemption.
A portion of Lot B has been developed, and there are presently operating
on that portion of Lob B that abutts Colorado Highway 66 The Front Range
Truck Sales and American Fertilizer Company. The applicant has secured
existing water taps from Little Thompson Water District on Lot A and Lot
B and has received information from Little Thompson Water District that
they are able to supply any further requests for additional water
service. Lot A will be serviced by an approved septic system for sewage
disposal facilities. The applicants have been advised by Essex Crane

Rental Corp. that they desire to commence construction of these
facilities to operate their business as soon as approval has been
obtained from the Weld County authorities.
The applicants request that the Planning Commission and the Board of
County Commissioners approve their request for a recorded exemption in
order that they may complete their obligations for the contract of sale
to Essex Crane Rental Corp. and in order to facilitate this business to
commence its operations here and add to the economy in Weld County.
