Thank you for the opportunity to review and comment on the Saint Vrain Sanitation District
service plan and boundary change request.
On June 6, 2001 I spoke with Dick Lyons the Saint Vrain attorney regarding the proposed
change. Mr. Lyons informed me the district was not requesting any change to the existing service
area that is identified in the North Front Range Water Quality Planning Association 1999 208
plan.
The Town of Erie has no objection to their request providing the district is not asking for any
additional area in Erie current N.F.R.W.Q.P.A. approved 208-service area. In addition the town
wants to be assured that the development within the towns approved 1999 comprehensive plan
would not be affected by any changes to the Saint Vrain proposed plan.

To Whom It May Concern:
The following is the Weld County Tri-Area Sanitation Districts' (WCTASD) response to
the Weld County Referral dated May 30, 2001 as noted above. We request that Weld
County give the fully allotted response time of 21 days. We feel that it is important that
the legal concepts be followed.
• WCTASD, the St. Vrain Sanitation District, and other interested parties have been
meeting for approximately two years in formation of a regional drainage authority to
be formed by intergovernmental agreement.
The proposed modifications to St. Vrain's Service Plan describes in part the role and
function of this as yet to be formed storm water management authority/agency. The
specifics of any such cooperative effort should be negotiated and approved by all
interested parties. WCTASD believes that it is simply inappropriate and unnecessary
for St. Vrain's Service Plan modifications to attempt to describe St. Vrain's
responsibilities and/or role with regard to any such storm water management
authority/agency, except to reaffirm St. Vrain's statutory right to enter into
intergovernmental agreements for that purpose. Accordingly, WCTASD asks that the
Broad of County Commissioners in acting on the Service Plan modifications, delete
any provisions of the Service Plan modifications that would purport to predetermine
the role, function or responsibilities of any such regional drainage authority and, in
particular, that would predetermine any particular role in the management of such an
authority by the St. Vrain Sanitation District.

• The efforts of the existing proposed Regional Drainage Authority include the Tri-
Town Basin and Godding Hollow Basin. WCTASD objects to SVSD's request to
include these basins. WCTASD does not object to territories located outside Tri-
Town Basin and Godding Hollow Basin.
• To go forward with SVSD's sole authority over drainage would mean a duplication of
already expended dollars and effort. Costs which have been born by the taxpayers.
Any further duplication would not be a responsible expenditure of taxpayer dollars.
• The issues of HEALTH and SAFETY to the communities and population are too
great to delay the existing efforts and direction of the existing proposed Regional
Drainage Authority.
• WCTASD HAS ALREADY RECEIVED STATE FUNDING in the form of a low
interest loan from the Colorado water Conservation Broad (CWCB) AND A GRANT
from the Department of Local Affairs (DOLA), to be devoted to the first phase under
the Regional Drainage Authority Plan. To not quickly finalize the formation of the
proposed Regional Drainage Authority could put future funding at risk. We strongly
feel that SVSD's actions have been intentional and are jeopardizing and hindering the
progress and success of the existing proposed Regional Drainage Authority.

Dear Commissioners:
It is the City's understanding that the St. Vrain Sanitation District is requesting a service
plan amendment from Weld County. At this time a number of developments in the
District's proposed service area are working with St. Vrain San to construct a sewer
collector line which will serve the western portion of Dacono's planning area.
Unfortunately, some of these developments have been only partially annexed to the St.
Vrain Sanitation District.
The City has requested that the St. Vrain Sanitation District provide wastewater treatment
for entire projects where a majority of the project lies within the service area. Even
though St. Vrain is reluctant to take on the operation of lift stations, it seems more
practical for one sanitation district to serve an entire project rather than to construct
parallel or duplicative facilities.
We are concerned that the complexity of dealing with several sewer districts, and the cost
of redundant facilities, is impeding our ability to attract quality development. While we
support St. Vrain's request for-serviceplan-amendments,_we respectfully request that the
amendments include changes to the boundaries that eliminate duplication of sanitary
sewer services in the Dacono planning area. We request that the entire area of the
affected projects be included in the district, or that St. Vrain Sanitation District enter into
an intergovernmental agreement to treat the effluent for these projects.

Dear Monica:
The Town of Frederick has been working for the past two years with other
governmental entities to form a regional drainage authority for the Godding-Hollow
and Tri-Area Drainage Basins. It is the intent of the Town to continue with this
process as we feel that the regional drainage authority is the best solution for
addressing drainage issues in the area. The Town will not delegate its authority to
regulate drainage issues in the municipal boundaries to any agency except the
proposed regional drainage authority.
The Town has no objections to the portion of the amended plan addressing
sanitation issues.
Furthermore, per the provisions of Section 8.0 of the Baseline Standards
(Weld County Ordinance 201) this referral does not meeting the referral timeframe
of a minimum 21 days as set forth in Subsection 8.4. The Town requests that all
referrals be incompliance with this IGA.

Re: Amendment to Service Plan; Creation of Drainage Authorities Godding Hollow/Tri-Town Basins
Dear Mr. Grant:
This letter is in response to your letter of October 27, 2000, addressed to Bruce T. Barker, Weld County
Attorney, and Monica Daniels-Mika, Director,Weld County Department of Planning Services. Your
letter addresses the need for St. Vrain Sanitation District("St. Vrain")to amend it's service plan because
of a planned expansion of it's treatment plant. St. Vrain's Board of Directors intends to award at its
November 8, 2000, meeting a contract for the construction of elements at the treatment plant that will
ultimately provide 3.0 mgd capacity. The service plan currently allows for expansion to 1.5 mgd
capacity. You ask for Weld County to concur with St. Vrain's plan to physically expand to 3.0 mgd
capacity, with the understanding that St. Vrain will operate at a capacity of no greater than 1.5 mgd until
the service plan is approved by the Board of County Commissioners and the communities served. Your
letter also discusses St. Vrain's willingness to commence storm water management within it boundaries
and to cooperate with Weld County and the Towns of Frederick and Firestone in the administration of a
storm water management program in the Godding Hollow Basin.
With respect to the issue of amending St. Vrain's service plan, the Board of County Commissioners has
no objection to St. Vrain commencing construction at the treatment plant to increase physical capacity to
3.0 mgd, as long as St. Vrain receives approval of the amended service plan (reflecting the 3.0 mgd
capacity) from the Board of County Commissioners and the communities served prior to operating at
more than 1.5 mgd. Be advised, however,that the Board's lack of objection does not assure approval of
such service plan amendments and any construction allowing physical capacity in excess of 1.5 mgd will
be done at St. Vrain's risk. The lack of objection also does not absolve St. Vrain of the responsibility of
complying with the normal zoning, subdivision, and building code requirements necessary for the
expansion. Additionally, an illegal split of a twenty acre trapezoid-shaped parcel north of the treatment
plant must be rectified. Please contact Ms. Daniels-Mika to determine what needs to be done.
The Board of County Commissioners agrees that St. Vrain and Weld County representatives should
commence discussions concerning the issue of converting the Sanitation District into a metropolitan
district. Please contact Ms. Daniels-Mika to begin such discussions.

As you know,the South Weld 1-25 Corridor Master Drainage Plan Task Force has been working for over
a year on a proposed Intergovernmental Agreement Pursuant to C.R.S. § 29-1-203 for the Creation of the
Godding Hollow/Tri-Town Basins Drainage Authority. The Task Force met on Tuesday, October 24,
2000,to discuss the matter further. Specifically discussed were the contents of Weld County
Commissioner Dale Hall's letter dated October 5, 2000, and questions posed in a letter from Paul Rufien,
Attorney for the Tri-Area Sanitation District("Tri-Area"), dated October 19, 2000. The final proposal of
the meeting was to have the Tri-Area, Weld County, and the Towns of Frederick and Firestone enter into
an intergovernmental agreement("IGA")to create a drainage authority for the Tri-Town Basin; and St.
Vrain, Weld County, Frederick and Firestone enter into a second IGA to create a second drainage
authority for the Gadding Hollow Basin. To do this, St.Vrain will need to consent to the Tri-Town
Basin Drainage Authority performing the duties of drainage control in those areas within St. Vrain's
boundaries which lie within the Tri-Town Basin.
It is the Board's understanding from your letter that St. Vrain is agreeing to enter into an IGA for the
purpose of creating the Godding Hollow Basin Drainage Authority,and will consent to the Tri-Town
Basin Drainage Authority performing the duties of drainage control in those areas within St. Vrain's
boundaries which lie within the Tri-Town Basin. It is also the Board's understanding that St.Vrain will
immediately commence storm water management in the remaining areas within its district boundaries.
Please contact Mr. Barker if these understandings are incorrect.

Dear Bruce and Monica:
I would like to clarify the process,if any,which is required by state law or County regulation for the review
and approval of the District's expansion of its treatment plant
It is my understanding that Bruce mentioned to Mark Peterson,the District's General Manger,that a
modification to the District's 1985 Service Plan would be required. I have reviewed the Service Plan and it
appears that the proposed plant expansion and activation of that expanded capacity are both within the limits
established by the Service Plan.
On Page 32 of the Service Plan,the original phased concept of plant expansion was described as follows:
In this case,due to minimal current development and the expected growth during the next five to eight
year period the treatment plant is planned for a three stage development during the initial period of
20 years.
On Page 34 of the Service Plan,the exact treatment capacity was stated as follows:
...the treatment system will be constructed in three phases, each with a capacity ofabout 500,000
gpd which represents a 5,000 population equivalent. Provisions for the expansion of the system will
be incorporated in the design and construction

Thus,the original 1985 Service Plan approved by the Board of County Commissioners called for a treatment
plant which could be expanded in phases up to a maximum of 1.5 mgd which can serve a population
equivalent of approximately 15,000(5,000 per 500,000 mgd).
The proposed expansion calls for construction of some elements that will ultimately provide 3.0 mgd capacity.
These involve heavy earthmoving and concrete work that result in significant cost and efficiency benefits
through a single construction effort. Other components,primarily mechanical and electrical,provide 1.5 mgd
capacity. The net result is a treatment plant capacity of 1.5 mgd;a capacity as contemplated in the 1985
Service Plan However,as a result of an exceptional alternative bid,the Dish_ict found itself in the position of
being able to complete the 3.0 mgd plant for an additional $200,000. The engineer's estimate for this work is
$956,000 for savings of$756,000.
It is in the District's best interest to accept this savings in behalf of its rate payers,particularly in light of
development projections that indicate further expansion from 1.5 mgd to 3.0 mgd could come as early as
2002. Needless to say this growth results from other agencies' land use decisions,as tempered by the general
economy,ai id is beyond the control of this District Accordingly,the District hereby requests county
concurrence with this course of action with the understanding that the District shall proceed with a proposed
revision to its Service Plan and shall activate no greater that 1.5 mgd capacity until said plan is approved by the
County and the communities served The District intends to obtain its Board of Directors'authorization to
award the treatment plant construction contract at its November 8th Board meeting.
When the 1985 Service Plan was approved,the Commissioners required the Dish_ict to amend the Plan to
include a requirement that the District annually report its growth and population figures with the expressed
intent that the County and the District would jointly meet and discuss the feasibility of converting the District
into a metropolitan district when the population equivalency exceeded 5,000. However,this requirement to
discuss possible conversion does not affect the current plant expansion,which is dictated by the rapid growth
of municipal development in the area,namely,new developments and annexations by Firestone,Frederick,
and Dacono. The District is willing to meet with you to discuss the wisdom and feasibility of converting the
Sanitation District to a metro district and to discuss the impacts of the various municipal annexations on this
issue.
As part of a future Service Plan revision,the District hereby declares,that it is the responsible storm drainage
and surface water runoff agency within the District's approved service area(which in 1988 was formally
expanded southward to Colorado Highway 52). The District will commence activities associated with storm
water management upon receipt of County's acceptance of this proposal. Furthermore,the District will
cooperate with Frederick,Firestone,and the County in the administration of a storm water management
program in Godding Hollow. The District's Service Plan did reserve the right of the District to provide this
service and explained that it could provide service both within and without the District. The description of
services on page 4 states:
The sanitary and/or storm sewer services will be provided within the proposed boundaries of the
District(as may be amended by exclusion and/or inclusions)and without the District's boundaries
pursuant to Section 32-1-1001(k), CRS,at the discretion of the District's Board of Directors and in
compliance with the then-existing and applicable state statutes.
