HomeMy WebLinkAbout20012553.tiff HEARING CERTIFICATION DOCKET NO. 2001-67 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1349 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT AND LIVESTOCK CONFINEMENT OPERATION (EXPANSION OF AN EXISTING DAIRY TO 2,675 HEAD, WITH ONE ADDITIONAL MOBILE HOME AS AN ACCESSORY TO THE FARM) IN THE A(AGRICULTURAL) ZONE DISTRICT - ROBERT AND DIANE TATEYAMA A public hearing was conducted on September 26, 2001, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tern Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated September 7, 2001, and duly published September 12, 2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Robert and Diane Tateyama for a Site Specific Development Plan and Use by Special Review Permit #1349 for an Agricultural Service Establishment and Livestock Confinement Operation (expansion of an existing dairy to 2,675 head, with one additional mobile home as an accessory to the farm) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light gave a brief description of the location of the site and surrounding uses. She stated seven referral agencies responded with proposed conditions, and three expressed no conflicts with their interests. Ms. Light reviewed the reasons for approval as indicated in the Planning Commission Resolution. In response to Commissioner Vaad,Trevor Jiricek, Department of Public Health and Environment, stated the grade drops 17 feet from Highway 14 to the south side of the property. He further stated the proposed design has diversion berms which will direct any runoff to the lagoons. Responding to Chair Geile, Ms. Light stated there is a well on the site used for irrigation; however, the dairy will receive water service from a North Weld County Water District tap. Don Carroll, Department of Public Works, stated the facility will be accessed from Highway 14, with the Condition that they address any concerns indicated by the Colorado Department of Transportation. He further stated there will be a secondary access from Weld County Road 43. In response to Chair Geile, Mr. Jiricek stated there is a Manure Management Plan for the existing operation, and staff has not reviewed the new plan in detail. 2001-2553 Az *L /7-t,) PL0617 HEARING CERTIFICATION - ROBERT AND DIANE TATEYAMA (USR#1349) PAGE 2 Thomas Haren, AgPro Environmental Services, LLC, represented the applicant and stated there is no base flood elevation for this site. He reviewed the existing topography of the site and stated flood waters have historically backed up behind Highway 14, which is elevated, and then flows to the southwest. He stated the lagoons will be elevated to prevent backflow,and the well is not used for much. The primary source of water will come from the North Weld County Water District tap, and the evidence of availability will be provided upon approval of this matter. Mr. Haren stated the applicant currently owns 500 head of dairy cattle which are located at the dairy and other farmland owned by the applicant. He stated this expansion will allow the applicant to bring the other livestock onto the dairy site. He further stated the manure generated is used by the applicant on the fields, and this permit will increase the water management efficiency. In response to Commissioner Vaad, Mr. Haren stated the road is elevated approximately ten to eighteen inches above the cattle pens. Responding to Chair Geile, Mr. Haren stated the applicant owns land west of this site; however, it is not contiguous because it is separated by Weld County Road 43. He explained the well was used for the dairy in the past; however, in the 1980's there was a reclassification to distinguish between Livestock and Commercial wells,which changed the use of the well at the dairy. He stated the well has not been tested recently, and they prefer to use potable water for the dairy cows because they produce better milk. In response to Commissioner Masden, Mr. Haren stated the lagoons are approximately five feet deep, and the holding pond is ten feet deep, so they will remain aerobic in nature. He stated the system is designed to allow the applicant to move water to and from any portion of the site for irrigation purposes. He explained the settling ponds will be dredged and the wastes will then be land-applied on a semi-annual basis once it has dried. Mr. Haren stated the various abatement plans have been submitted and will be thoroughly reviewed by staff once this matter is approved. No public testimony was offered concerning this matter. In response to Chair Geile, Mr. Haren stated he and the applicant have reviewed and agree with the Conditions of Approval and Development Standards. Commissioner Long commented he drives past this site and it appears to be a good operation. Commissioner Long moved to approve the request of Robert and Diane Tateyama for a Site Specific Development Plan and Use by Special Review Permit#1349 for an Agricultural Service Establishment and Livestock Confinement Operation(expansion of an existing dairy to 2,675 head, with one additional mobile home as an accessory to the farm) in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.
