CODE ORDINANCE NO. 2001-8
IN THE MATTER OF REPEALING AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 2
ADMINISTRATION, CHAPTER 5 REVENUE AND FINANCE (TO INCLUDE APPENDICES 5-A
THROUGH 5-L), CHAPTER 9 INFORMATION SERVICES, CHAPTER 23 ZONING, AND
CHAPTER 29 BUILDING REGULATIONS, OF THE WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of
Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with
the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted
Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld,
including the codification of all previously adopted ordinances of a general and permanent
nature enacted on or before said date of adoption, and
WHEREAS, the Director of Finance and Administration, County Attorney, and Director
of Planning Services have recommended certain revisions be made in to the Weld County
Code, and
WHEREAS, specific changes that have been recommended are located in Chapter 2
Administration, Chapter 5 Revenue and Finance (including Exhibits 5-A through 5-L, copies of
which are attached hereto and incorporated herein by reference), Chapter 9 Information
Services, Chapter 23 Zoning, and Chapter 29 Building Regulations, and
WHEREAS, the Board of County Commissioners deems it advisable to repeal and
re-enact, with amendments, the specific Sections as listed.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld, State of Colorado, that various Sections of the Weld County Code be, and
hereby are, repealed and re-enacted, as follows.
Name Change throughout entire Code
Weld County Ambulance Services is changed to Weld County Paramedic Services.

J. Delegation of authority concerning Agreements for Sampling and Analysis of
Drinking Water and Pollutant Discharge by the Weld County Department of
Public Health and Environment. By Resolution #2001-3421, approved on
December 17, 2001, the Board of County Commissioners approved the form of
two agreements and granted standing authority to the Director of Public Health
and Environment to sign said agreements with various entities and corporations.
Delete Section 2-1-30.D.3. Intentionally deleted.
Section 2-3-10. Previously denied applications for land use matters.
A. Except in those cases to which the requirements of Subsection B below apply,
neither an applicant nor his or her successors in interest in property for which a
land use application was denied within the preceding five (5) years may submit a
land use application or request a rehearing on a previously submitted application
for any portion of the property contained in the original application unless the
Board of County Commissioners has determined that, based upon a showing by
the applicant, there has been a substantial change in the facts and
circumstances regarding the application subsequent to the original decision of
denial by the Board of County Commissioners or that there is newly discovered
evidence which would have been likely to affect the outcome of the original
decision that the applicant could not have discovered with diligent effort prior to
the original decision of denial.
B. Upon approval of Ordinance 173-C, contained in Chapter 24 of this Code, which
ordinance became effective December 5, 1995, neither an applicant nor his or
her successors in interest in property for which a Recorded Exemption
application was denied within the preceding ten (10) years may submit a
Recorded Exemption application or request a rehearing on a previously
submitted application for any portion of the property contained in the original
application unless the Board of County Commissioners has determined that,
based upon a showing by the applicant, there has been a substantial change in
the facts and circumstances regarding the application subsequent to the original
decision of denial by the Board of County Commissioners or that there is newly
discovered evidence which would have been likely to affect the outcome of the
original decision that the applicant could not have discovered with diligent effort
prior to the original decision of denial.
C. Substantial change in facts and circumstances shall mean a substantial change
in the land use application, which address the issues raised by the Board of
County Commissioners in the original decision of denial, in the surrounding land
uses, or in applicable provisions of the law.
D through J. (No Change.)
K. The applicant, once a period of one year has elapsed from the date of the initial
denial, may chose to address the requirements of this section in the form of a
preface to the land use application in which case the procedural requirements of
sections D through F would not apply. The applicant would bear the burden of
proof with respect to establishing that there has been a substantial change in the
facts and circumstances regarding the application, or that there is newly

discovered evidence that the applicant could not have discovered with diligent
effort prior to the original decision of denial, in addition to satisfying the criteria
for the new land use application. The Planning Commission (when appropriate)
and the Board of County Commissioners may, at their discretion, hear and
decide the preliminary matter separately or in conjunction with the land use
application and a failure of the applicant to demonstrate compliance with the
criteria of this section may be grounds, in and of itself, for denial of the land use
application. No fee in addition to the fee for the land use application would be
assessed but the applicant would not be entitled to any rebate if the Board's
decision is based upon a failure to demonstrate compliance with the criteria of
this section.
Addition of an entire new subparagraph § 2-4-50 (O):
Where the Board is considering the revocation or suspension of a permit or license, including
but not limited to uses by special review and permits issued under Chapter 21, but specifically
excluding liquor licenses, the Board shall consider evidence and statements in mitigation and in
aggravation of the violation prior to determining the appropriate penalty. Such evidence and
statements may relate to and include, but not be limited to, the following.
1. The compliance history of the party against whom the complaint was made with
respect to the permit at issue or other county issued permits.
2. Good faith efforts on behalf of the person against whom the complaint is made to
comply.
3. Duration of the violation.
4. Economic benefit of noncompliance to the person against whom the complaint is
made.
5. Impact on, or threat to, the public health or welfare or the environment as a result
of the violation.
6. Malfeasance.
7. Whether legal and factual theories were advanced for purposes of delay.
In addition to the factors set forth in this subsection the following circumstances shall be
considered as grounds for reducing or eliminating penalties:
8. The voluntary and complete disclosure by the person against whom the
complaint is made of such violation in a timely fashion after discovery of the
noncompliance.
9. Full and prompt cooperation by the person against whom the complaint is made
following disclosure of the violation including, when appropriate, entering into a
legally enforceable commitment to undertake compliance and remedial efforts.
10. The existence and scope of a regularized and comprehensive environmental
compliance program or an environmental audit program.

11. Substantial economic impact of a penalty on the violator.
12. Other mitigating factors.
Where a civil penalty in lieu of suspension is available, the Board shall first impose the
revocation or a term of suspension. The amount of the civil penalty shall then be determined on
the basis of imposing an economic penalty equivalent to the loss which would have occurred
had the facility not operated during the term of the suspension. A portion of the civil penalty
may be deferred on the condition that certain actions to correct the violation be taken. The
failure to pay the civil assessment will result in imposition of the suspension.
CHAPTER 5
REVENUE AND FINANCE
(Include Exhibits 5-A through 5-L,
which correspond to Appendix 5-A through 5-L)
Section 5-6-30. Inventory.
Department heads and elected officials are held responsible for the inventory assigned
to their department per Section 29-1-506, C.R.S., therefore, only minimal County
guidelines are required to ensure an accurate inventory system.
A. The Fixed Assets Inventory List shall be updated annually and shall contain a list
of all property with a useful life of at least three years and a minimum value not
to exceed $5,000.
B. All real property, other than rights-of-way, roads, or bridges shall be considered
capital items to be inventoried regardless of value.
CHAPTER 9
INFORMATION SERVICES
Article VII. Workstation Remote Control Policy.
Section 9-7-10. Need for Policy
A. To ensure appropriate use of Help Desk remote control software applications
that provide remote access to end user workstations.
Section 9-7-20. Definitions
A. Workstation (end-user computing device). Usually this device is a desktop
computer at an employee's desk. However, with advances in technology it can
also include handheld devices, e.g., Pocket PC's, Palm PC's, PDA's, and laptop
computers.
B. End User. A person utilizing a workstation to perform their daily activities. The
individual whose computing device is being serviced in some fashion.

C. Remote Control Software. Any software used that enables remote workstations
(a second workstation) to be viewed, controlled, or updated remotely, without
being physically at the second workstation. Primarily concerned with the
end-user support software tool known as Remote Control, which is one
component of a larger application called ZenWorks.
D. Support Staff. Individuals employed and trained to support computer software
and hardware.
Section 9-7-30. Statement of Policy.
A. To facilitate end-user support in the computer environment, remote control
software can be utilized to help resolve an issue or to upgrade software
configurations remotely. It is acknowledged that remote control software, when
authorized, grants complete access/control to another computing device whether
or not it is logged into the network. The software can be used to transfer files
to/from another PC, to access any file on the remote PC or the network, to view
and update those files, to update application software, to change PC
configurations, and to view what is currently displayed on the screen of the
remote PC.
B. The remote control software will be used in a professional manner and only in
direct support of Weld County business objectives. Unless authorized in writing
by a department head or elected official and approved by the Director of
Information Services, reviewing or duplicating information in any manner that is
not directly related to resolving a workstation issue is prohibited.
C. The end user does not have an expectation of personal privacy under County
personnel rules. However, the County information on the workstation is
potentially privileged and confidential and is not to be discussed or disclosed by
support staff to anyone other than the end user and their supervisor (exception
noted in 9-7-30.D.)
D. Monitoring or policing how workstations are used is not the objective of this
policy. However, if in the course of performing regular maintenance on a
workstation, information is found that indicates a crime is being planned or
committed the Director of Information Services will be notified and the matter
referred to the Weld County Director of Finance and Administration.
E. All support staff that have a need to use remote control software in support of
end users, must request security access to the application by completing a
Computer Security Request Form and have it approved by the Director of
Information Services.
F. Modifications to the setup configuration of the remote control software on either
the server or client side must be approved by the Director of Information
Services.
G. All workstations will be configured to utilize or to allow the remote control
software to be run on their workstation where technically feasible.

H. When a remote-control session is initiated to access another device,
authorization to proceed must be granted by the end user of the workstation. If
the end user does not authorize remote access at the current time, support staff
must immediately stop the current remote-control session. The end user and the
support staff should then arrange a time that the remote-control session can be
successfully implemented.
In the event there is no response (within three minutes) from an end user to a
request to proceed with a remote-control session, the support staff may proceed
with the remote control session. An assumption is made that an end user is not
currently using the work station. An attempt should be made by support staff to
save any open files on the workstation to a temporary directory before
proceeding.
J. While remote control is in session on a workstation, a pop-up window is
displayed informing the end user their workstation is under remote control. By
closing this pop-up window, the end user is terminating the remote-control
session.
K. When a remote-control session is completed, a notice should be left for the end
user briefly explaining what was done to the workstation, where any saved files
may be located, and how to contact the support staff if there are questions.
L. Besides Remote Control, other components of the ZenWorks application make it
possible to implement mass changes/fixes, e.g., to all of a department's
workstations automatically. Unless under emergency conditions where the IT
infrastructure can be corrupted or damaged, the activity will be scheduled with
the department prior to execution of the process.
M. Each occurrence where Remote-Control software is utilized to diagnose or
resolve a workstation issue will be logged using Information Services Help Desk
call tracking procedures.
N. Abuse of this policy can result in removal of authorization to use remote-control
software and/or employee disciplinary actions including termination of
employment.
Section 9-7-40. Procedure.
A. To initiate a remote-control session, support staff must first make an attempt to
get approval from the end user to take control of their workstation. Approval can
be obtained multiple ways, e.g., phone, E-mail, chat session, etc.
B. If the end user denies access, a convenient time should be scheduled to initiate
the session at a later date.
C. To avoid delays, if there is no response from the end user within three minutes, it
will be assumed the user is not at the workstation and the remote control session
will proceed.
D. When the remote control session is active (support staff have control of the end
user's workstation), a pop-up window will be displayed on the end user's

workstation at all times while the session is active.
E. If the pop-up window is closed by the end user, the remote-control session is
terminated immediately.
F. If the end user is not present when the remote-control session ends, the support
staff should leave a note indicating the date and time the session was held, give
a brief description of work performed, and whom to contact if there are
questions. The note can take the form of an E-mail, a phone message, or
notepad window may be left on the end user's screen.
Section 9-7-50. Exceptions.
The authority to approve exceptions to this Policy is delegated to the Director of
Information Services Department.
CHAPTER 23
ZONING
Section 23-1-90. Definitions
OFFSET: The horizontal distance between any BUILDING or STRUCTURE, as
measured from the farthest projection of the BUILDING or STRUCTURE except for
window wells, air conditioners, gutters, or down spouts, and a LOT line, other than a
STREET right-of-way line.
SETBACK: The horizontal distance between any BUILDING or STRUCTURE, as
measured from the farthest projection of the BUILDING of STRUCTURE except for
window wells, air conditioners, gutters, or down spouts, and the established PUBLIC or
private STREET right-of-way line.
Section 23-2-200.
A. through D. No Change.
E. If the Use by Special Review has not commenced within three years from the
date of approval or is discontinued for a period of three (3) consecutive years, it
shall be presumed inactive. The COUNTY shall initiate an administrative hearing
to consider whether to grant an extension of time to commence the use or
revoke the Use by Special Review. If the Use by Special Review is revoked, it
shall be necessary to follow the procedures and requirements of this Section in
order to reestablish any Use by Special Review.
Section 23-2-270. Development standards.
An applicant for a Special Review Permit shall demonstrate conformance with and shall
continue to meet any DEVELOPMENT STANDARDS approved and adopted by the
County. The DEVELOPMENT STANDARDS shall be placed on the Special Review
Permit Plan Map prior to recording. Noncompliance with any of the approved
DEVELOPMENT STANDARDS may be reason for revocation or suspension, of the

special review permit by the Board of County Commissioners. Civil penalties in lieu of a
suspension may also be imposed with the express prior agreement of the applicant.
The availability of these remedies in no way limits the Board of County Commissioners
from seeking or applying any other remedies which are available for noncompliance with
the development standards.
CHAPTER 29
BUILDING REGULATIONS
Section 29-2-60. Uniform Code for the Abatement of Dangerous Buildings.
The publication of the International Conference of Building Officials known as the
Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, is incorporated
by this reference as a part of this Building Code for the purpose of establishing
standards and procedures for the abatement of dangerous buildings by repair,
rehabilitation, demolition or removal, with the following amendments:
A. Amend Section 205 to state the following: "The 'Board of Appeals' referred to
throughout the Uniform Code for the Abatement of Dangerous Buildings, 1997
Edition, shall be the same as the 'Code Board of Appeals' referred to in Chapter
29, Article X of this Code."
B. through X. (No change)
Section 29-2-90. Mobile and manufactured home installation standards.
Any mobile or manufactured home located in or relocated within the County shall meet the
following installation standards. The Building Official may authorize the use of different
materials or methods which will accomplish substantially the same result. The Weld County
Building Inspection Department shall be authorized to act as the exclusive inspection agency for
Weld County pursuant to the Colorado Division of Housing Manufactured Housing Installation
Program. Any installation of a manufactured home in Weld County shall be performed in strict
accordance with the applicable manufacturer's installation instructions. Where the
manufacturer's instructions are not applicable, installation shall be in accordance with ANSI
A225.1 1994, as amended by the Colorado Division of Housing. A copy of the manufacturer's
instructions or the standards promulgated by the Colorado Division of Housing shall be
available at the time of installation and inspection.
A. Setbacks. Zoning setbacks shall meet the requirements set forth in Chapter 23
of this Code. Additionally, distances from other structures or property lines shall
be as specified in Table No. 5-A of the UBC.

BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to arrange for Colorado Code Publishing to supplement the Weld County Code with
the amendments contained herein, to coincide with chapters, articles, divisions, sections, and
sub-sections as they currently exist within said Code; and to resolve any inconsistencies
regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions,
sections, and sub-sections in said Code.
BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph,
sentence, clause, or phrase of this Ordinance is for any reason held or decided to be
unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The
Board of County Commissioners hereby declares that it would have enacted this Ordinance in
each and every section, subsection, paragraph, sentence, clause, and phrase thereof
irrespective of the fact that any one or more sections, subsections, paragraphs, sentences,
clauses, or phrases might be declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number 2001-8 was, on motion duly made and
seconded, adopted by the following vote on the 17th day of December, A. D., 2001.

RATES FOR CLERK TO THE BOARD
TRANSCRIPTS FROM TAPES:
IF TRANSCRIBED IN-HOUSE: $60.00/hour for time spent on the transcription, plus $2.50
per page. (Provides two certified copies of transcript to requestor.) Minimum charge of
$60.00, with a deposit of three times the clock time of the tape to be paid in advance, with
balance payable prior to receipt of transcript. Transcripts will be completed as staff time is
available. Fee non-refundable. No deadline will be assured.
IF TRANSCRIBED BY OTHER THAN CLERK TO BOARD STAFF: Actual cost of services
performed, including postage and delivery charges, with one paper copy of transcript and

25. An amendment to any of the above applications shall be treated as a new application and
will be charged the appropriate application fee unless otherwise noted.
26. The fee to amend an application for a Special Review Permit for Sold Waste Disposal
Sites and Facilities shall not exceed $17,114.00. The full amount shall be submitted to
the Department of Planning Services at the time a complete application is submitted. The
full amount shall be placed in escrow and charged against by the County based on the
standard hourly rate for each department administering or reviewing the permit. The
departments shall include, but not be limited to, the Weld County Departments of Planning
Services, Public Health and the Environment, Public Works, and County Attorney's Office.
The standard hourly rate shall be established by the Director of Finance and
Administration for the actual time spent on the review of the application and facility. The
applicant shall be provided copies of the billing five days prior to the cost actually being
billed against the escrow account and the applicant. The applicant's sole remedy to
appeal any billing shall be to the Board of County Commissioners. The unused portion of
the submitted application fee held in escrow, shall be returned to the applicant within 30
days of recording the amended Special Review plan map, within 30 days of recording the
amended Special Review plan map, within 30 days after denial of the application by the
Board of County Commissioners, or 30 days after the applicant submits a written request
to withdraw the application.
27. A pre-application fee will be charged by Weld County to future applicants when county
staff members are asked to assist professional consultants in the preparation of land use
applications. The fee shall be an hourly rate charged in 15 minute increments. The hourly
rate shall be calculated on a full cost recovery basis of the county's costs for the staff
positions involved in the assistance. The full cost recovery rate shall be determined by the
Director of Finance and Administration and shall include salary, fringe benefits, support
costs (services and supplies), and indirect costs calculated in accordance with the
countywide cost allocation plan per Federal OMB-87 methodologies. Pre-applicants shall
deposit an estimated amount of the costs prior to the assistance. A final settle of costs will
be determined by DPS once all the work has been completed.

When work for which a permits is required by Chapter 29 of the Weld County Code is started or
proceeded with prior to obtaining the electrical permit, an additional investigation fee shall be added
to the cost of the electrical permit. The investigation fee shall be 50% of the fee established by
separate action by the Board of County Commissioners. In no event shall the investigations fee
exceed an amount set by separate action by the Board of County Commissioners. The payment of
such investigation fee shall not relieve any person from fully complying with the requirements of
Chapter 29 of the Weld County Code in the execution of the work, nor from any other penalties
prescribed within the Weld County Code.
