RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS

REQUEST: A Site Specific Development Plan and a Special Review Permit for a business pecmittetr
as a use by right in the Industrial Zone District (Office and Storage Building)N the
Agricultural Zone District.
LEGAL DESCRIPTION: Lot A of RE-1028; being part of the SE4 of Section 18, Township 6 North,
Range 64 West of the 6th P.M., Weld County, Colorado
LOCATION: Four hundred fifteen (415) feet north of SH 392; west of and adjacent to WCR 51
be recommended favorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section 24.7 of the
Weld County Zoning Ordinance.
2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section
24.3 of the Weld County Zoning Ordinance, as follows:
a. Section 24.3.1.1 --That the proposal is consistent with the Weld County Comprehensive
Plan. A. Goal 2 allows for commercial and industrial uses to locate in the Agricultural Zone
District when the impact to surrounding properties is minimal,and where adequate services
and infrastructure are available. The Development Standards, Conditions of Approval,and
Operations Standards will effectively mitigate any adverse impacts to surrounding areas.
Water is provided by North Weld County Water District and the sewage disposal will be
permitted by a septic system.
b. Section 24.3.1.2 --That the proposal is consistent with the intent of the district in which the
office and storage building is located. Section 31.4.18 of the Weld County Zoning
Ordinance allows for uses permitted as a use by right in the Industrial Zone District as a Use
by Special Review in the Agricultural Zone District. Section 34.2.2.1 allows for storage
within enclosed buildings and Section 34.2.3.1 allows for offices for the use by operators
as a use allowed by right in the I-1, Industrial Zone District.
c. Section 24.3.1.3 -The proposal is consistent with Section 24.3.1.3 of the Weld County
Zoning Ordinance,and will be compatible with future development of the surrounding area.
The surrounding area consists of several residences and agricultural uses, mainly pasture
lands. This application is for storage for equipment and supplies used during the summer
for work camps held out of state, and office space with a maximum of fifteen (15)
employees. Conditions of Approval and Development Standards ensure that the proposal
is consistent with surrounding land uses.

d. Section 24.3.1.4 --The proposed uses will be compatible with future development of the
surrounding area as permitted by the Agricultural Zone District and with the future
development as projected by the Comprehensive Plan or Master Plan of affected
municipalities. This proposal does not lie within a three mile referral area of any town or
city. The Conditions of Approval and Development Standards will ensure the health, safety
and welfare of the citizens of Weld County.
e. Section 24.3.1.5—This proposal does not lie within any Overlay Districts.
f. Section 24.3.1.6-That if the use is proposed to be located in the Agricultural Zone District,
that the applicant has demonstrated a diligent effort has been made to conserve prime
agricultural land in the locational decision for the proposed use. The proposal is located
on prime farm ground. The Weld County Comprehensive Plan indicates in A. Goal 9 that
eighty(80)acres is considered the minimum lot size needed for a viable farming operation.
The subject property is 9.39 acres in size and is utilized as a hay field with the grazing of
one horse.
g. Section 24.3.1.7 --The Design Standards (Section 24.5 of the Weld County Zoning
Ordinance), Operation Standards (Section 24.6 of the Weld County Zoning Ordinance),
Conditions of Approval, and Development Standards ensure that there are adequate
provisions for the protection of health, safety, and welfare of the inhabitants of the
neighborhood and county.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:
1. The attached Development Standards for the Special Review Permit shall be adopted and placed
on the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the
Department of Planning Services and be ready for recording in the Weld County Clerk and
Recorder's Office within 30 days of approval by the Board of County Commissioners. (Dept. of

2. Prior to recording the plat:
A. The applicant shall submit a screening and Landscape Plan to provide buffering from
adjacent land uses. Areas to be screened are north of the Proposed Building including the
parking area, east of and adjacent to the proposed parking area and south of the gravel
parking area near the entrance drive. The Plan shall be submitted to the Department of
Planning Services, for review and approval. (Department of Planning)
B. The plat shall be amended to delineate the following:
1) Weld County Road 51 requires eighty (80) feet of right-of-way at full build out.
There is presently sixty (60) feet of right-of-way. A total of forty (40) feet from the
centerline of Weld County Road 51 shall be delineated on the plat as right-of-way
reservation for future expansion of Weld County Road 51. (Department of Public

3. ADA parking (van availability) nearest to the door and the ADA route to the
building. (Department of Public Works)
4. Overflow parking shall be indicated on the plat to accommodate full build-out
parking. (Department of Public Works)
5. The turning radius into the proposed parking lot needs to be able to accommodate
two-way traffic and shall be designed in detail and submitted to the Department of
Public Works. Further, delineate the loading zone for the truck traffic and a
hammer head for vehicular turn-a-round in the parking area. Evidence of approval
of access design shall be submitted to the Department of Planning Services'.

3. The Special Review activity shall not occur nor shall any building or electrical permits be issued on
the property until the Special Review plat is ready to be recorded in the office of the Weld County

DEVELOPMENT STANDARDS

1. The Site Specific Development Plan and a Special Review Permit for a business permitted as a use
by right in the Industrial Zone District(Office and Storage Building) in the Agricultural Zone District,
as indicated in the application materials on file in the Department of Planning Services and subject
to the Development Standards stated hereon. (Department of Planning Services)
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County
Zoning Ordinance. (Department of Planning Services)
3. No permanent disposal of wastes shall be permitted at this site. (Department of Public Health and
Environment)
4. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-
100.5,C.R.S.,as amended)shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination. (Department of Public Health and Environment)
5. The facility shall utilize the existing public water supply (North Weld County Water District).

6. Adequate toilet facilities shall be provided for employees. (Department of Public Health and
Environment)
7. An individual sewage disposal system is required for the proposed facility and shall be installed
according to the weld County Individual Sewage Disposal Regulations. The septic system is
required to be designed by a Colorado Registered Professional Engineer according to the Weld
County Individual Sewage Disposal Regulations. (Department of Public Health and Environment)
8. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions. (Department of Public Health and

9. The landscaping on site shall be maintained in accordance with the approved landscaping plan.

10. There shall be no staging or parking along WCR 51. All parking, loading and off-loading shall be
on-site. (Public Works)
11. The access drive shall be maintained by the operator to support the imposed loads of fire apparatus
and shall be provided with a surface so as to provide all-weather driving capabilities and to prevent
drainage problems. (Public Works)
12. The facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as
delineated in 25-12-103 C.R.S., as amended.
13. All construction on the property shall be in accordance with the Weld County Building Code
Ordinance. (Planning Dept.)
14. The property owner or operator shall be responsible for complying with the Design Standards of
Section 24.5 of the Weld County Zoning Ordinance.
15. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 24.6 of the Weld County Zoning Ordinance.
16. Personnel from the Weld County Department of Public Health and Environment and Weld County
Department of Planning Services shall be granted access onto the property at any reasonable time
in order to ensure the activities carried out on the property comply with the Development Standards
stated herein and all applicable Weld County Regulations.
17. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Substantial changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the
Permit by the Weld County Board of County Commissioners Planning
before such changes from the plans or Development Standards are permitted. Any other changes
shall be filed in the office of the Department of Planning Services.
18. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the Permit by the Board of County Commissioners.
