Courtney Crawford(District Wildlife Manager) and Mike Sherman(Field I labitat Biologist) have reviewed your letter sent to us and accompanied you on a tir,ld visit to the piojef'I site on June 5. 2000. We highly recommend that i we ial late] lion Lr giver to minimize the impact to all riparian vegetation and trees along the river that may be potentially by impacted by the proposed mining operation. Bald eagles use this stretch of the South Platte River and adjacent riparian areas during winter and migration seasons for hunting and roosting. VERY IMPORTANT: there is a known active bald eagle nest site adjacent to the confluence of the St. V rain Creek and South Platte River. We wish to bring to your attention that we observed an immature Bald Eagle which was flushed fiom a mature cottonwood tree while we drove on the dirt road along the river in the southwestern portion of Section 35. It is very possible that this bird came from the active nest located less than one mile upstream. We cannot stress the importance of leaving fully intact the existing riparian vegetation and trees along the South Platte River. Preble's meadow jumping mouse (Zapus husonius preblei) and the Ute Ladies' -tresses orchid (Spiranthes deluvialis), both federally listed as threatened, are found in riparian habitats, including those tributary of the South Platte River. Consequently, both have the potential to occur at the proposed project site. The U.S. Fish and Wildlife Service has established standard survey protocols for determining presence or absence of these species. Evaluations should be performed at and adjacent to the project site to ascertain the potential occurrence of these species. If suitable habitat is present, surveys conducted according to the protocols should be undertaken. Coordination for Preble's should be through Pete Plage and for the orchid through Jan McKee, both in the Lakewood office (303-275-2370). 1'he Colorado butterfly plant is also found in moist floodplain environments along the Front Range and so could occur in the project vicinity. Although no protocols have been established for this species, surveys to ensure it will not be adversely impacted should be undertaken. Questions should be directed to Ms. McKee. Trees and shrubs removed as a result of mining or construction should be replaced on a one-for-one basis. Recommended native tree and shrub species for reclamation planting include plains cottonwood, native plum, chokecherry, snowberry, bufaloberry,and willow. We recommend that all tree and shrub planting be done using weed barrier material to help control competition from weeds and help plantings to successfully establish. Recommended reclamation grass and legume species for wildlife include tall wheatgrass, intermediate wheatgrass,reed canary grass, indian rice grass,Great Basin wild rye, switch grass,Ladak alfalfa and yellow and white sweet clovers. We highly recommend that the reclamation plan include specific wording to address the control of noxious weeds which are rapidly becoming an increasing threat to wildlife and wildlife habitat across Colorado and the United States. All restoration should be monitored for at least three years following initial plantings and proper measures enforced during this time to control for establishment of noxious weed species. Constructing ponds post-mining will provide new habitat for a variety of waterfowl, shorebirds, herons, amphibians and fish species. We recommend that ponds be constructed to have irregular shorelines, and also contain one or two islands of at least 15' x 25' in size per 2 surface acres. Larger islands are good if possible. Shoreline and island slopes should be 41:1 V, with some areas of shoreline in each pond having slopes no steeper than 811:1V or 10H:I V. Such shallow areas will allow for establishment of a variety of different types of aquatic vegetation and also invertebrate prey for waterfowl. Such a shoreline coupled with planting a variety of wetland plant species will allow for a variation in wetlands to be established which will have long-term benefits to wildlife, public viewing of wildlife, and an overall increased aesthetic value to this site. Permanent pond depths of 10 feet or more in various places will provide secure year round habitat for a variety of warm water fish species. Finally, the proposed facilities may significantly impact a prairie dog town on the south side of the site. We recommend that the prairie dogs be either moved alive to another location or humanely killed before any earth- moving occurs. Since western burrowing owls use prairie dog towns and live in prairie dog holes, the following should be observed: - l f construction is In 1arch 1 and October 31,the area should be checked for the presence of burrowing owls prior to any earth-moving taking place. The owls are susceptible to being buried and killed in their holes by construction activity. Note that this species is protected by law and killing one is illegal. - If construction is done between November I and February 28, it is very unlikely that owls would be present since they migrate out of the state during the winter. Note that we do not have information on threatened/endangered plants or invertebrates. In response, CNHP has searched its Biological and Conservation Datasystem (BCD)for natural heritage resources(occurrences of significant natural communities and rare,threatened or endangered plants and animals)documented from the immediate area and the area in the vicinity of Township 2 North, Range 67W Section 24. The database search reveals a documented occurrence in the vicinity of the project area for Haliaeetus leucocephalus(Bald Eagle). The Bald eagle is federally listed as a threatened species under the ESA. Bald eagles occur seasonally in Colorado primarily in areas with ice-free rivers and reservoirs where fish and carrion are available. Bald eagles feed on a variety of fish,waterfowl and small mammals in the winter. Bald eagles are primarily winter residents in Colorado. They roost in large trees near water bodies or prairie dog towns where prey is abundant. Riparian corridors with mature cottonwoods or other large deciduous trees provide potential roosting sites for bald eagles. ft is known that Bald eagles use riparian areas along the South Platte for foraging and roosting during winter months. As noted in the attached report there is a.historical record forZcrpus hudsonius preblei(Preble's meadow jumping mouse)within close proximity to the project area. Preble's meadow jumping mouse(PMJM) is federally listed as a threatened species under the Endangered Species Act. The mouse typically inhabits areas characterized by well-developed plains riparian vegetation with relatively undisturbed grassland and a water source in close proximity(Armstrong et al. 1997). Recent studies have suggested that PMJM may have a wider ecological tolerance than previously thought,and that the requirement for diverse vegetation and well-developed cover can he met under a variety of circumstances(Meaney et al 1997). Along Colorado's Front Range,the mouse is found below 7,500 feet in elevation,generally in lowlands with medium to high moisture along permanent or intermittent streams. Also noted in the report, there is an occurrence for Phoxinus erythrogasier(Southern redbelly dace), within the general vicinity of the project area. This species is considered to be critically imperiled in the state of Colorado and is listed as endangered in the state. Some species of Darters are known to migrate to small marshy areas associated with water seeps to spawn, requiring shallow water to deposit eggs. The larvae remain in the vicinity of marshes for 4-6 weeks before returning to home streams(Williams and Dodd, 1979). There is a documented occurrence in the vicinity of the project area for a species of spleenwort (Asplenlum adianrum-nigrum). The Black spleenwort is considered to be critically imperiled in the state of Colorado. RS there are 5 or fewer known occurrences in the state. _ I . The orchid occurs at elevations below 6,500 feet in moist to wet alluvial meadows,floodplains of perennial streams,and around springs and lakes. Once thought to be fairly common in low elevation riparian areas in Colorado,there are only sixteen known populations in the state, with most of them occurring along the Front Range. ULTO is found in soils that are typically alluvial deposits of sandy, gravelly material that is saturated to within l8 inches of the surface for at least part of the growing season. Associated vegetation includes species that are considered by FWS as Facultative Wetland or Obligate Wetland species. The area under consideration for a potential extraction permit is a contiguous three mile wetland complex surrounded by agricultural land. As evidenced by the report,this area should be considered to be of high value in terms of both ecological processes and wildlife habitat. Wetland habitats are necessary for the survival of a disproportionately high percentage of endangered and threatened species,and are also utilized by waterfowl and several species of migratory birds. The enclosed report outlines the status of the known elements. We have included status according to Natural Heritage Program methodology and legal status under state and federal statutes. Natural Heritage ranks are standardized across the Heritage Program network, and are assigned for global and state levels of rarity. The systems will require a Statement of Existing and an I.S.D.S. Evaluation prior to the issuance of the required septic permits(s). The review shall consist of observation of the system and an evaluation of the systems ability to handle the proposed hydraulic load. In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current Individual Sewage Disposal System regulations. 2) The septic system that is proposed to be used at the office ranch complex shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 3) The applicant shall submit an NPDES Permit to the Water Quality Control Division of the Colorado Department of Health for proposed discharge into State Waterways. Evidence of approval shall be submitted to the Weld County Department of Planning. 4) An Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit shall be obtained from the Air Pollution Control Division, Colorado Department of Public Health and Environment for emissions from the mining operations. The site shall operate in accordance with all applicable rules and regulations of the Air Pollution Control Division. 5) A dust abatement plan shall be submitted to Environmental Health Services,Weld County Department of Public Health & Environment, for approval prior to operation. Evidence of Health Department approval shall be submitted to the Department of Planning Services. 6) The facility shall submit a written plan and engineered design of a vehicle washing area to the Weld County Department of Public Health and Environment for review and written approval. The washing area shall be designed and constructed to capture all effluent from drum washing and the washing of vehicle exteriors. The plan should address how water generated from the drum washing and vehicle exteriors will be recycled and any other information necessary to demonstrate that the facility will be adequately constructed and operated to prevent discharges of waste water. This project falls primarily under the purview of the Weld County Use by Special Review Standards. Our comments and requirements are as follows: COMMENTS: WCR 23 and WCR 36 are both identified on the Weld County Transportation Plan Map as local gravel, chemically stabilized roads. WCR 23 had an average daily traffic(ADT)count of 145 vehicles,and WCR 36 had an ADT count of 173 vehicles. Both traffic counts were taken November 1999. WCR 32.5 is the nearest paved road south of the facility, and it had an average traffic count of 982 vehicles taken in May 1999. REQUIREMENTS: The Weld County Public Works Department recommends approval of the application. Access: The intersection of WCR 23 and WCR 36 is a "T" intersection. The applicant indicated that a portion of .he proposed haul route on the east property line will be constructed on the County road right-of-way. It will be an extension of WCR 23. The applicant shall complete a Non-Exclusive Right-of-Way Agreement for the Upgrading and Maintenance of the County Rights-of-Way. Traffic Impact Study: This development will increase the traffic on WCR 23, WCR 36, and WCR 40 above the EPA guidelines. These are all gravel roads. A traffic impact study with proposed mitigation will be required. All new commercial development that exceeds the ADT of more than 200 vehicles will be required to submit a traffic study as a part of the review process. This traffic study shall include a description of the project, vehicle traffic generation, distribution, verification of adequate acceleration and deceleration, storage facility, all impacted intersections, review of bridge capability, intersection level of service, analysis for the existing and proposed conditions, recommendation for the needs, and upgrades to the transportation infrastructure to support the development. CDOT: The designated haul route will impact both U.S. Highway 85 and State Highway 66;therefore,the Colorado Department of Transportation (CDOT) shall review the traffic impact study to determine any additional needs that may be required. The port-of-entry weigh station is within the five-mile radius of the proposed facility. CDOT may require additional permits as the main designated haul route bypasses the port-of-entry. Improvements Agreement: The Weld County Public Works Department will require an Off-site Road Improvements Agreement for the designated haul routes. These types of operations are historically of little impact on public safety. However, there was a concern about the compatibility of this type of operation with the surrounding neighborhoods along the proposed haul routes described on page 2, paragraph 44.1.7.4 of the application. There are some residences adjacent to CR 23 southbound from CR 36 which is described as the southern route. This road surface is hard-packed and unlikely to generate much dust although traction may be effected when the surface is wet. The northern route, CR 23 to CR 40, has a higher density of residences and the road surface is gravel. Considerable dust was produced when I drove this route. The current volume of traffic on the roads of either route is very light. Our experience has shown a significant change in volume and/or use is likely to cause residents to respond negatively. When this occurs, we receive frequent complaints of overweight trucks and trucks failing to obey traffic control devices, speeding, and driving carelessly. We must provide service in response and this translates into resources. Because of the location, I am not able to offer suggestions in mitigation of this concern. The Sheriffs Office does not object to this USR provided resources are provided as they become necessary. We do not currently have sufficient resources to consistently police these roads. Initially and based on his past experience he recommends a set back of 200 feet to avoid potential damage. 2. The application proposes both wet and dry mining. Dry mining will necessitate pumping groundwater away from the pit and the Western ditch and the State Engineer usually requires the discharge be returned to the South Platte River. Any pumping will likely cause increased water losses in the Western Mutual Ditch which will diminish the decreed rights of the Company. Therefore the Company must request that a condition of no pumping of water be imposed on all cells adjacent to the Western Mutual Ditch. 3. Applicant cannot expose groundwater without a well permit from the State Engineer and without an augmentation plan approved by the Water Court. Applicant owns 24 shares of Western stock and 7 shares of Hewes and Cook stock both subject to the Bylaws of Western. The Western Bylaws require any applicant to come to the Board for approval of any change of use prior to seeking approval from any other F:\KIM\W ESTERN.MUT\O91e 1.wpd entity. Any Western Mutual stockholder not desiring to use for himself the water from said ditch to which he is entitled on account of his capital stock ownership in any year, shall have the right to dispose of such water for such year to another or others; but in no event shall water represented by the ownership of capital stock of the ditch company be transferred, used or utilized by any stockholder or user of said water without first going through the headgate and/or measuring weir of the Ditch Company on the South Platte river as presently constructed or as may be hereafter constructed. The company assumes no responsibility for delivery of such water and under no circumstance will the company construct new gates in the canal or obstruct the flow of water in the company's ditch by checks or otherwise. Section 2. Changes of Water Rights. A. Any stockholder ("applicant") desiring a change of water right as defined in the Water Right Determination and Administration Act of 1969, Colorado Revised Statutes §37-92-101 through 37-92-603, including, but not limited to, a change in point of diversion or place of use of any water that the applicant is entitled to receive as a result of stock ownership must first make a written application to the directors of the company. A change of water right shall include the use of water the shareholder is entitled to as a result of stock ownership as augmentation water in a plan for augmentation or exchange. The request should detail the requested change and include adequate terms and conditions to prevent injury to the company and its shareholders. If, in the reasonable opinion of the directors, such change may be approved without injury to the company and all of its stockholders, the directors shall then approve the change application subject to necessary terms and conditions. In evaluating whether the requested change of water F:\KIM\WESTERN.MUTBYLAW1.AMD 1 rights can be made without injury to the company and its shareholders, the company may obtain an engineering and legal analysis of the requested change by the applicant and the terms and conditions offered by the applicant. B. The company shall evaluate the application for change of water right within a reasonable amount of time, C. No application for approval of a change of water right or plan for augmentation as described above may be made to the District Court for Water Division No. 1, State of Colorado ("Water Court"), unless the same has been approved by the company. If an application has been approved by the company, the applicant must include terms and conditions at least a.% stringent as those approved by the company in an application to the District Court for Water Division No. 1, State of Colorado. D. An applicant for a change of water right must reimburse the company for the company's reasonable costs and fees, including a charge for time spent by the directors and company employees in analyzing the application to the company and in any judicial litigation that follows. This specifically includes a challenge to the company's denial of an application. Prior to analyzing the proposed change, the company shall obtain an estimate of the costs. The company shall make said estimate of cost within 30 days of submission of an application and the applicant shall have 30 days after receipt of the estimate from the company to make the deposit. The company shall not take final action on any application until, and unless, the applicant makes said deposit. If the estimate and deposit needs to be adjusted by further payment or reimbursement, said adjustment shall be made upon the completion of the analysis. In no event shall the company be required to finally approve or disapprove the application until all fees incurred by the company are reimbursed. E. If any portion of this Article is declared void by a court of law, the remaining portions of this by-law shall remain in full force and unaffected. On August 18, 2000 the Colorado Division of Wildlife provided comments to Environment Inc. (Steve O'brian) after a visit to the site and verbal explanation by Mr. O'brian of the proposed mining operation. Those comments are attached and we have included additional wildlife impact comments after having obtained the written proposal from your office. This project proposal lies adjacent to approximately 3 miles of the South Platte River corridor. The river bottom consists of cottonwood-willow, lowland riparian habitat, providing an abundant and diverse wildlife resource. Some of these include Morning Dove, Ducks, Canada Geese, Herons, Songbirds, Raptors (including Bald Eagle and Great Horned Owl) , Rio Grande Turkey, Fish, Reptiles, Amphibians, White-tail deer, Mule deer, Coyote, Muskrat, Beaver, Striped Skunk and raccoon. We highly recommend that the river bottom corridor remain undeveloped, retaining the concept of open space, with limited grazing by domestic livestock. Development of the lakes proposed for this property will provide additional aquatic habitat for fish, amphibians, shorebirds, waterfowl, etc. , along with the potential for recreation. Some conflicts with wildlife may occur and it is the responsibility of the developer to plan for and minimize human/wildlife conflicts . An active Bald Eagle roost exists about '4+ mile below the confluence of the South Platte and the St.Vrain rivers. The eagle roost is located just north of proposed Confluence Lake, on Public Service property. As many as 15-20 Bald Eagles have been observed at this roost as recently as January 31, 2001. I have included data from previous observations to confirm the historical status of this roost. Dense stands of cottonwood trees along with open water provide important habitat for roosting Bald Eagles. It is encouraging to note that Environment Inc. has expressed a desire to leave the river bottom, riparian habitat in its natural state. This is a good start, but we recommend additional protection of the eagle roost site. We recommend that a minimum of ',1 mile buffer around the periphery of this roost be provided during the months of November through March. Heavy vehicle traffic due to gravel mining operations or plant site activity in close proximity to the eagle roost during this time period would likely result in discontinued use of this historical roost. This buffer must be enforced to prohibit disturbance over and above normal traffic required to maintain existing ranch and oil well facilities . I have included proposal map #4, indicating the location of the roost and recommended buffer zone. The plant site proposal appears to be in a satisfactory location. However, it is recommended that the Plant site not be allowed any closer to the river bottom in order to minimize disturbance to the abundant and diverse wildlife species that depend on lowland riparian habitat for survival. In addition to the cottonwood forest along the river bottom, several, single or pairs of large cottonwood trees exist within the proposed lake development boundaries as shown on maps presented with this proposal. The Meadow Lake proposal contains several of these trees and it appears they will be removed during mining operations. A cluster of three cottonwoods exists, midway, along the east boundary of Meadow Lake. Approximately 'h mile west of these trees are 4-5 additional large cottonwoods. All provide daily hunting perches for Bald eagles and other raptors in conjunction with the surrounding prairie dog colony. In addition, raptor nesting is evident in several of these large solitary cottonwoods. With slight variation in shoreline configuration of the proposed lakes development, some of these cottonwoods could be maintained in their natural state and continue to provide roosting, perching and nesting habitat along with associated prey species for eagles and other birds of prey. Prairie dog colonies exist within the proposed gravel mining development. These colonies are important prey species for raptors and ground predators and provide habitat for a variety of wildlife including Burrowing Owls. Legal options for Prairie Dog removal include humane euthanasia or trapping and transplanting. Prairie Dog trapping and transplanting efforts must be approved by the Colorado Division of Wildlife. Bulldozing active Prairie Dog colonies is not an acceptable method of removal. Prairie dog colonies also provide habitat for Burrowing Owls. Burrowing Owls are protected in Colorado and are listed as a threatened species. Burrowing Owls migrate south during winter months but they rely heavily on Prairie Dog burrows for nesting habitat from April 1 - August 31. Construction work during this time period would require a biological survey for the presence of Burrowing Owls. Without an exhibit of proposed site it is unknown how this line will be impacted. A 44kV and 230kV Electric Transmission lines also run through this area. It is extremely critical that all safety concerns be addresses before approval should be granted since we are looking at a high potential of danger with the high voltage electrical and the high pressure gas lines. Our primary concern is in regard to the health and safety of the students of our school district. One of our school bus routes runs along the proposed ingress and egress. We believe the increase in traffic from this proposal will increase traffic on this bus route. School buses make several stops to pick-up and drop-off children. Also,we already experience a high incidence of broken windshields on our school buses due to the loose gravel on the county roads. Fortunately,as of today, no one has been seriously injured. We are concerned that the gravel pit and the projected increase in truck traffic will increase the number of broken windshields and possible injuries to staff and students. In addition, Highway 66 borders Platteville Elementary on the south side of the school's property in Platteville. Highway 66 is already very busy throughout the day without the increase of traffic from the proposed gravel pit. We are concerned about the high volume of traffic on this highway as it relates to our elementary school. Other concerns are in regard to hazards to the environment such as a possible increase in noise levels, dust levels, exhaust pollution and a possible negative impact on the water table. C� Department of Public Health and Environment COLORADO SUBJECT: USR-1306, Platte Sand & Gravel During our recent visit to the proposed site we observed that vehicle bodies and tires were being used to control erosion along the river bank. It appeared that the bodies and the tires have been in place for many years. We discussed our observations with a representative of the Army Corps of Engineers. Based upon our observations and discussions with the Corps we are of the opinion that the vehicle bodies are not an environmental concern and appear to be an effective erosion control method at this time. However, in regard to the tires, we recommend that the following condition be added as a requirement that must be completed prior to the applicant recording their plat. The applicant shall remove or anchor any tires that may be washed downstream if high water occurs in the river. The applicant shall provide written and photographic evidence to both the Weld County Departments of Planning and Health that this item has been completed. Additionally, we believe the following condition should also be added as a requirement that must be completed prior to the applicant recording their plat. The applicant shall remove and properly dispose all tires not being anchored for erosion control and any other miscellaneous debris, i.e. appliances that exist on the site. The applicant shall provide written and photographic evidence to both the Weld County Departments of Planning and Health that this item has been completed.
