Re: Probable Cause Hearing: Romance, Inc.,DBA,
Club Romance/Lucky Star
Dear Mr. Morris:
As we discussed last week,I have asked the Clerk to the Board of County Commissioners to set the
matter of a probable cause hearing regarding the renewal of the tavern liquor license for the
establishment known as "Club Romance" for Monday, January 15,2001, at 9:00 a.m. The probable
cause hearing will take place before the Board of County Commissioners of Weld County in the Board's
First Floor Meeting Room, Centennial Center Complex, 915 10th Street, Greeley, CO.
Enclosed please find copies of the following documents:
1) The Renewal Application form for Club Romance, signed by Manual Manriquez,
President,Romance, Inc.
2) A letter dated October 30, 2000, from David Sprague, Building Official for Weld
County, addressed to the "Lucky Star Bar and Grill," regarding the issue of occupancy
load.
3) A Memorandum dated December 15, 2000, from Bethany Salzman, Zoning Compliance
Officer,to Esther Gesick,Deputy Clerk to the Board, regarding the issue of zoning of
the Club Romance.
4) A five page document authored by David Sauter of the State Liquor Enforcement
Division, detailing various alleged violations of Colorado Revised Statutes and the
Colorado Code of Regulations by the Club Romance during the year 2000.

5) Reports and other documentation from the Colorado State Patrol. It appears to me that
the reports and other documentation address eight incidents in which Patrol Troopers
either were called to the tavern or responded and persons involved in the incidents had
consumed alcohol at the Club Romance.
6) A two page document from Vicky Harbert of the Weld County Sheriffs Office entitled
"Liquor/Beer Renewal Review Form," regarding the Club Romance. Attached to that
Form is a three page document entitled, "Collective agreement between the Weld County
Sheriff's Office and Romance,Inc.,DBA Club Romance/Lucky Star 33131 Highway 85,
Lucerne, Colorado 80646."
7) A document entitled, "Sample-flyer which is to be distributed to patrons."
8) A document that appears to be a statement by Ms. Harbert regarding her conversations
with neighboring business owners.
9) A thirteen page document entitled, "Club Romance Call/Incident Analysis and
Evaluation."
10) Twenty-four reports from the Weld County Sheriffs Office.
As we discussed in our conversation last week, the probable cause hearing is a time when the Board may
set a show cause hearing to consider the renewal. A copy of Weld County's standard probable cause
hearing procedures is enclosed. Finally, also enclosed is a copy of the guidelines for the refusal to renew
a liquor license in Weld County.
The Board of County Commissioners has the option of renewing the liquor license at the probable cause
hearing if it desires to do so. On Thursday, December 28, 2000, I discussed the matter of conditions for
the renewal with Mr. Sauter,Ms. Harbert, and Scott Copley of the Colorado State Patrol. Please call me

conditions.
