HomeMy WebLinkAbout20012030 RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST STEVEN AND TAMMERA LONG AND KEN ALVAREZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Steven and Tammera Long and Ken Alvarez, VI #0100219, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 30th day of July, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Steven and Tammera Long and Ken Alvarez, property owners and tenant, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until Thursday, August 2, 2001, to allow the property owners and tenant adequate time for removal of the animals and bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to further delay action upon such referral until Monday, October 1, 2001, to allow the property owners and tenant adequate time for removal of any remaining fencing material or miscellaneous debris and bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that VI #0100219 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Steven and Tammera Long and Ken Alvarez to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until Thursday, August 2, 2001, to allow the property owners and tenant adequate time for removal of the animals, as well as an additional delay in action until Monday, October 1, 2001, to allow the property owners and tenant adequate time for removal of any remaining fencing material or miscellaneous debris to bring the subject property into compliance. tn., 4,90? This letter is to inform you that after preliminary review of your fe.lid facility south of Kersey that was examined by Division of Wildlife officers on Wednesday, July 11 to 2001 , that there are significant safety and escape issues with the facility, as well as possible violations of Colorado statute and Wildlife Commission Regulations. The Division of Wildlife is continuing to investigate the importation, possession and licensing of your animals. In the meantime, we are requiring that you immediately address the foll0wine safety and escape concerns within 10 days from today. I) The gates to the individual animal pens by Wildlife Commission regulation tOCCXX must be self closing, locked gates. The gates you have on most of the cages currently are simple free-swinging gates held shut with lightweight chain and snap type latches. All of the individual gates to the cages must replaced or modified within the 10 days to be self -closing (self closing means spring loaded or some mechanism to automatically close the gate and latch itself if the gate is opened and released). Additionally, they must be positively locked with (gauge?) heavy chain and padlock. The snap latches you presently have on the cages are inadequate. The Outer perimeter gate should also be brought to these same standards 2)Flooring on the individual cages is not secure or safe. Our standards require that the walls of the cages be extended three feet below the ground, or have a one foot concrete barrier buried along the edges. If the ground is not conducive to burying, then chain mesh flooring must extend out three feet from the walls. 3) the exterior perimeter fence is help up by nylon straps and stakes on the south side. One of those stakes has pulled out of the soil and resulted in a collapsing fence. Another hard windstorm could result in that fence collapsing onto the individual cages It is currently being held up by a 2x4. By Dan England Greeley Tribune It wasn*t love at first purr when Vicki Guerrieri ran into Ken Alvarez and he asked if she wanted to see his tiger. *I thought he was giving me a line,*said the Kersey woman. Now Alvarez and Guerrieri are engaged as of last week, and they*re hoping Kersey, or maybe a part of rural Weld County, will accept their children. Alvarez owns more than 30 tigers, lions, leopards and other big cats that he houses in Oskalooska, Kan. The two hope to build a new Gatekeepers Wildlife Sanctuary in rural Weld. The two met in American Furniture Warehouse in Fort Collins. She was looking for furniture. He was shooting a commercial. *I found a boyfriend instead of a couch,* Guerrieri said. Alvarez has owned big cats for eight years after receiving a couple baby tigers as a gift. He now runs the non-profit facility where the cats are trained, not tame, Guerrieri said, and is currently in Louisiana on tour with 15 of the cats. Six of them are on display in American Fumiture with Guerrieri, where customers are getting their photos shot with them. The rest are back in Kansas. Nine of the cats were rescued by the facility. No one has been hurt by the cats. *The animals we use with the public have been raised by Ken from a bottle since they were bom,*she said. *It*s all they know.* Gatekeepers has a lot of work to do, however, before a facility is built. The organization will have to obtain permits from the county and even tougher permits from the Colorado Division of Wildlife. It will also need to undergo frequent inspections from the DOW and the United States Department of Agriculture. Pat Craig knows they have a long way to go. He*s the director of the Rocky Mountain Wildlife Conservation Center in Keensburg, a place that has operated for 21 years and currently has 26 big cats, bears and other Bethany salzman Cat place Page 2 animals he rescued from bad situations: One of his cats, Zeus, a lion,was found in a garage by the DOW. *It wasn*t easy 21 years ago,* Craig said. *It defintely isn*t easy now.* He said to build his 115-acre facility again would cost$750,000. He also spends$150,000 a year on their care. Craig said he doesn*t know their operation well enough to criticize it, but doesn*t agree with Gatekeepers*philosophy of supplying the cats for photo shoots and commercials. His place is closed to the public. Craig also said Alvarez tried to join forces with Gatekeepers, but that philosophical difference was too much to overcome. *He came here unannounced one day,*Craig said. *Raising baby tigers so people can take pictures with them isn*t something we want to be doing. We do disagree, but I can*t say good or bad about him.' But the new sancutary would give the cats some stability, Guerrieri said. She doesn*t want to leave Weld County because she has two daughters who attend Platte Valley High School and are involved. They also both play volleyball (her screen name on AOL is*volleymom*). Alvarez had to recently move his facility out of Sedgwick County in Kansas because neighbors nervous about the big cats there protested against him renewing his permit. Guerrieri said the cats are trained through love, affection, daily walks, good care and even belly rubs. 'We don*t sell our cats and we don*t get rid of them,* Guerrieri said. *We*d really like to get them settled down.* So Gatekeepers hopes to raise enough money to buy enough land in a rural location so there won't be problems with the neighbors. Kelpis, USDA Investigator Date: Monday, July 30, 2001 Subject Ken Alvarez Bethany, Enclosed are a few of Mr. Alvarez'past USDA inspection reports from when he lived in Kansas and when he was inspected on the road. He will tell you the facility belonged to Barb Stevens, whom he paid to take care of the facility while he was on the road with his cats. The facility did belong to Ms. Stevens, however, it was his responsibility to keep the facility up to USDA standards since the facility was licensed under his name. He's going to be in the same situation here in Colorado, where he's on the road with his cat's all year long and someone else will be responsible for his facility. I spoke with another USDA licensee last week and he told me two of Mr. Alvarez'lions got loose about I %years ago. There is currently a•case pending on Mr. Alvarez pertaining to exhibiting his cats without a USDA license in Colorado. I have several counts against him in this case. This case was started because Mr. Alvarez' USDA license expired on June 8, 2001. Instead of waiting to get approved for a new exhibitor's license in Colorado, he continued to exhibit his cats even AFTER our USDA Inspector told him he could not exhibit until he was approved for a license. He was sited for this once before in 1999.
