This project falls primarily under the purview of the Weld County Use by Special Review Standards. Our comments and requirements are as follows: COMMENTS: WCR 41 is designated on the Transportation Plan Map as a collector status road, which requires ✓ an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance(Ordinance 89, as amended),the required setback is measured from the future right-of- way line. Our most current average daily traffic count reflects 786 vehicles taken in a 24-hour period. REQUIREMENTS: The applicant should reserve an additional ten feet of future right-of-way for road widening at full / build out of WCR 41. This should be identified on the plat prior to recording. Off-Street Parking/Access: The off-street parking spaces including access drives shall be surfaced with gravel, asphalt, concrete or equivalent, and shall be graded to prevent drainage problems. All parking and vehicle storage shall be provided on site. Parking shall not be permitted within any 7 public rights-of-way. Parking lot area shall be provided to meet the parking needs of employees, company vehicles, visitors, and customers. Storm Water Drainage: Historically,the storm water drainage has been handled by overland flows into borrow pit ditches and has not been a problem because of the sandy conditions of the soil. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Apply for an Underground Injection Control (UIC) Class V Injection Well permit through the Environmental Protection Agency (EPA)or provideevidence that the applicant is not subject to the EPA Class V requirements. 2. The septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 3. The facility obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. !4. The facility shall submit an application as a non-community drinking water purveyor, as defined in the Colorado Primary Drinking Water Regulations,to the Water Quality Control Division of the Colorado Department of Public Health and Environment. We recommend that the following requirements be incorporated into the permit as"development standards": 1. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. EXHIBIT Hochmiller, John Page 2 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate toilet facilities shall be provided for the public. 7. The facility shall maintain compliance with its' stormwater discharge permit from the Colorado Department of Public Health& Environment, Water Quality Control Division. 8. PRIME FARMLANDS: None of the soils covered by this application are considered prime farmland. SOIL EROSION POTENTIAL: All of the soils covered by this application are considered highly erodible and should be protected. Construction should be planned so as to disturb as little soil as possible and measures should be taken to prevent soil movement offsite. Any areas that are disturbed should be stabilized with perennial vegetation, gravel, or pavement once construction is complete. Aerial photos/ 4from 1988 show an area of eroding soil on the western side of the property. We recommend that this area be stabilized as soon as possible with perennial vegetation to prevent this area from growing larger. The NRCS can be contacted for information on the best grass species to plant and methods for planting. OTHER: The applicant should contact Ron Broda, Vegetation Weed Management Specialist with the Weld County Public Works Department at(970)356-4000 X 3770 to develop a weed management plan.
