RESOLUTION
RE: APPROVAL OF SPECIAL USE PERMIT FOR AGRIBUSINESS, DISPLAY,
SALES AND CONSIGNMENT SALES OF FARM EQUIPMENT AND VEHICLES
FOR THEO RADEMACHER, ROUTE 1 , LONGMONT, COLORADO 80501
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 1st day of October, 1980
at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board
of County Commissioners for the purpose of hearing the applica-
tion of Theo Rademacher, Route 1, Longmont, Colorado 80501, for
a Special Use Permit for agribusiness , display, sales and con-
signment sales of farm equipment and vehicles on the following
described real estate, to-wit:
Part of the Northwest Quarter of Section
26 , Township 3 North, Range 68 West of
the 6th P.M. , Weld County, Colorado, being
more particularly described as follows:
Beginning at the North Quarter Corner of
said Section 26 and considering the East
line of said Northwest Quarter as bearing
South 00°13 ' 00" West, with all other
bearings contained herein relative thereto;
Thence South 00°13 ' 00" West, along said
East line, 40 . 00 feet to the True Point
of Beginning;
Thence South 89°25 ' 00" West, 742. 68 feet;
Thence South 00°13 ' 00" West, 1279 . 91 feet-
Thence North 89°25 '00" East, 742 . 68 feet;
Thence North 00°13 ' 00" East, 1280. 00 feet
to the True Point of Beginning.
Said described parcel of land contains 2.1.700
acres, more or less, including a strip of
ground 40 feet in width along the North line
and 30 feet in width along the East line of
said described parcel, reserved for County
Road right-of-way purposes and is subject
to any rights-of-way or other easements as
granted or reserved by instruments of record
or as now existing on said described parcel
of land.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the granting of
the Special Use Permit for agribusiness, display, sales and con-

signment sales of farm equipment and vehicles on the above
described real estate, and
WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu-
tion authorizes such a use in an Agricultural District upon appro-
val by the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, has studied the request of the petitioner and the recom-
mendations of the Weld County Planning Commission and all of the
exhibits and evidence presented in this matter, and having been
fully informed, is satisfied that the request for a Special Use
Permit for agribusiness, display, sales and consignment sales of
farm equipment and vehicles, on the above described real estate,
conforms to the purposes of Section 3. 3 (E) (2) of the Weld County
Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of the
petitioner for a Special Use Permit for agribusiness, display,
sales and consignment sales of farm equipment and vehicles, on
the hereinabove described tract of land be, and hereby is, granted
subject to the following:
1. The Special Use Permit plat shall be amended to
show the relocation of the proposed access to
the extreme eastern edge of the property so that
it will closely aligh with existing County Road
91/2 on the north side of Highway 66 .
2. The Development Standards contained in the Special
Use Permit.
3. No building or electrical permits shall be issued
on the Special Use Permit area until the Develop-
ment Standards for the Special Use Permit and the
Property owner ' s signature have been placed on the
Special Use Permit Plat and the Plat has been
delivered to the office of the Department of
Planning Services.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the reasons for approval contained
in the Planning Commission recommendations dated August 19, 1980
be, and hereby are, adopted as the findings of fact of the Board
of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 1st day of

1. It is the opinion of the Planning Commission that this request is in
agreement with the Weld County Comprehensive Plan in that the plan states
that the expansion and development of agribusiness and agriculturally
oriented industry will be encouraged, provided these enterprises do not
adversely affect the total economy or environment. It is the opinion of
the Planning Commission that the proposed use would not appear to have any
adverse impacts on the agricultural interests of the County, the total
economy, or the environment.
2 . It is the opinion of the Planning Commission that the proposed operation
is in compliance with the provisions of Section 3.3.E(2) of the Weld
County Zoning Resolution.
3. It is the opinion of the Planning Commission that the attached Development
Standards will minimize impacts on surrounding uses and the area to the
greatest extent possible and provide adequate protection of the health,
safety and welfare of the inhabitants of the area and the County.

These determination are based, in part, upon a review of the information submitted
by the applicant, other relevant information regarding the request and the responses
of the referral entities which have reviewed this request.
The Planning Commissions recommendation for approval is conditional upon the
following:
1. The Special Use Permit plat shall be amended to show the relocation of the
proposed access to the extreme eastern edge of the property so that it will
closely align with existing County Road 92 on the north side of Highway 66.
This was recommended by the Colorado Division of Highways in its letter of
May 27, 1980.
2. The attached Development Standards being recommended and adopted for the
Special Use Permit.
3. No building or electrical permits shall be issued on the Special Use Permit
area until the Development Standards for the Special Use Permit and the
property owners signature have been placed on the Special Use Permit Plat
and the Plat has been delivered to the office of the Department of Planning
Services .

1. The permitted use on the hereon described parcel shall be an agri-business
for the display, sales, and consignment sales of farm equipment and farm
vehicles and all uses permitted by right in the Agricultural Zone District.
The facilities shall be limited to those as shown hereon.
2. The Special Use Permit area shall be maintained in such a manner so as to
prevent soil erosion, fugitive dust, and the growth of noxious weeds.
3. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems.
4. Outdoor storage shall be limited to farm equipment and farm vehicles.
5. All signs located on the Special Use Permit area shall be in compliance
with the requirements of the Weld County Zoning Resolution.
6. All construction and electrical work shall be done in accordance with
the Weld County Building Code. Building excavations shall be examined
by qualified personnel to determine proper foundation design for structures.
7. Access to Colorado Highway 66 shall be limited to one 35 foot access
as shown on the Special Use Permit Plat. All accesses shall have the
approval of the Weld County Engineering Department and/or the Colorado
Division of Highways. All accesses shall be constructed in accordance

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS
REQUEST BE Approved FOR THE FOLLOWING REASONS :
1. It is the opinion of the Department of Planning Services' staff that this request
is in agreement with the Weld County Comprehensive Plan in that the plan states
that the expansion and development of agribusiness and agriculturally oriented
industry will be encouraged, provided these enterprises do not adversely affect the
total economy or environment. It is the opinion of the Department of Planning
Services Staff that the proposed use would not appear to have any adverse impacts
on the agricultural interests of the County, the total economy, or the environment.
2. It is the opinion of the Department of Planning Services staff that the proposed
operation is in compliance with the provisions of Section 3.3.E(2) of the Weld
County Zoning Resolution.
3. It is the opinion of the Department of Planning Services staff that the attached
Development Standards will minimize impacts on surrounding uses and the area to
the greatest extent possible and provide adequate protection of the health, safety
and welfare of the inhabitants of the area and the County.
These determinations are based, in part, upon a review of the information submitted
by the applicant, other relevant information regarding the request and the responses
of the referral entities which have reviewed this request.
The Department of Planning Services Staff recommendation for approval is conditional
upon the following:
1. The Special Use Permit plat shall be amended to show the relocation of the proposed
access to the extreme eastern edge of the property so that it will closely align
with existing County Road 91/2 on the north side of Highway 66. This was recommended
by the Colorado Division of Highways in its letter of May 27, 1980.
2. The attached Development Standards being recommended and adopted for the Special
Use Permit.
3. No building or electrical permits shall be issued on the Special Use Permit area
until the Development Standards for the Special Use Permit and the property owners
signature have been placed on the Special Use Permit Plat and the Plat has been
delivered to the office of the Department of Planning Services.
DEVELOPMENT STANDARDS

1. The permitted use on the hereon described parcel shall be an agri-business
for the display, sales, and consignment sales of farm equipment and farm
vehicles and all uses permitted by right in the Agricultural Zone District.
The facilities shall be limited to those as shown hereon.
2. The Special Use Permit area shall be maintained in such a manner so as to
prevent soil erosion, fugitive dust, and the growth of noxious weeds.
3. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems.
4. Outdoor storage shall be limited to farm equipment and farm vehicles.
5. All signs located on the Special Use Permit area shall be in compliance
with the requirements of the Weld County Zoning Resolution.
6. All construction and electrical work shall be done in accordance with
the Weld County Building Code. Building excavations shall be examined
by qualified personnel to determine proper foundation design for structures.
7. Access to Colorado Highway 66 shall be limited to one 35 foot access
as shown on the Special Use Permit Plat. All accesses shall have the
approval of the Weld County Engineering Department and/or the Colorado
Division of Highways. All accesses shall be constructed in accordance
with the recommendations and/or requirements of the Weld County Engineer-
ing Department and/or the Colorado Division of Highways.

On July 1, 1980 Mr. Rademacher withdrew his request for commercial zoning
on the subject property and subsequently met with the Department of Planning
Services staff to apply for an agribusiness for sales , display, and
consignmant sales of farm equipment and vehicles . This use requires a
Special Use Permit.
It is the opinion of the Department of Planning Services that all the
referrals received on the Commercial Zoning request are applicable
to the Special Use Pernit and therefore no referrals were sent out
on the current request.
Surrounding Property owners were notified of the new request and given
an opportunity to comment on the Special Use Permit request.

Dear Chuck:
Our staff has reviewed the above zoning change and make the
following comments:
1. The soils are classified as a Wiley-Colby complex with
small inclusions of Kim and Weld loam. This is a deep,
well drained, moderately slow permeable soil . These
soils have a moderate shrink-swell potential and moderate
restrictions on the use of septic tanks . They would be
considered as both prime agricultural irrigated and non-
irrigated soils.
2. There are no major irrigation systems affected by the
project.
3. The project is not in a defined floodplain.

Dear Mr. Cunliffe:
We have reviewed the application from Theo Rademacher for a change of zone from "A"
Agricultural to "C" Commercial , and we have the following comments.
1 . The 35-foot width along State Highway 66 which is to be reserved for future highway
right of way is consistent with our needs.
2. We do ask that consideration be given to a different access location for the
proposed 35-foot driveway at the center of the property frontage. This access
should be moved to the extreme eastern edge of the property so that it would
closely align with existing County Road 91/2 on the north side of the highway.
If the County would ever desire to extend County Road 92 to the south of S.H. 66,
access could be obtained from the county road. If possible, it would be preferable
to allow this property access to S.H. 66 from within the 60-foot county road
right of way directly across from County Road 92.
3. A Driveway Permit will be required for the construction of the new access to the
highway. Application for this permit should be made following the approval of
this zone change request to: Mr. David N. Fraser, District IV Maintenance Super-
intendent, P. 0. Box 850, Greeley, Colorado 80632. Please include three copies
of a plan showing details of the driveway construction with the completed permit.

The Weld County Planning Commission will review a request from
