Management Plan Approval Letter
Dear Mr. Dye and AgPro Environmental Services:
On July 9, 2001 Jo Peden and I met with you at the Dyelands Dairy, LLC., facility located at 7007 WCR 84 in
Weld County. The purpose of the meeting was to determine whether the complaint discussed in the
Departments letter dated May 1, 2001 had been appropriately addressed and to observe the property
described in your Manure & Process Wastewater Management Plan, dated June 22, 2001. The complaint
discussed the storm water run-off that was discharging into a pond that had been excavated into ground water.
In the letter dated May 10, 2001 from Tom Haren of AgPro Environmental,a commitment was made to fill the
pond completely or to a level where suspect groundwater would not be a concern and to direct and contain
runoff from the feedlot area within 30 days. The plan of action was acceptable to the Department.
On this day we observed that the pond was partially backfilled,water is in the pond,and runoff from the feedlot
area runs into the pond. We discussed whether run off from the feedlot area could be directed and contained
in the pond. Although you do have a USR for a 4,000 head dairy, you currently stated that you have
approximately 160 head,therefore,you are considered an AFO at this time. Assuming you are not discharging
into the groundwater any more, in accordance with the Best Management Practices for AFO's, run off from
the feedlot area can be contained in this pond.
Additionally, the Manure & Process Wastewater Management Plan (the Plan) items discussed in my letter
dated June 22, 2001, and Eric Dunkers' letter dated June 29, 2001, has been reviewed. The Plan and
response is considered complete and the Plan is approved. However, we encourage you to monitor
containment structures on site to ensure tailwater, wastewater, and stormwater runoff do not impact the
groundwater.

Hi Julie — Happy Friday
We are working to make sure that we have met all of the conditions of approval
for Dyelands Dairy. Here is a copy of WC PH&E's approval of the MMP, I'm still
waiting on Cindy's approval of the Nuisance Plan.
Eric already generated the mylar's, so I am submitting them to you for review,
changes, etc....
If you could let me know if we are on track with this, I would appreciate it. If so, I
will pick them up and have Terry sign and have notarized, and also submit the
approval letter for the Nuisance Plan.
