Subject: USR-1345 Kaye Montera & Seth Ward
Dear Ms- Lockman:
The Town of Windsor Planning Commission reviewed this referral at its regular
meeting of August 2, 2001. The subject property is located outside the Town's
Growth Management Area (GMA), but within the Town's Community Influence
Area. The property is delineated as Very Low Density Single Family Residential on
the Town's Land Use Plan map. The Windsor Comprehensive Plan states that the
Very Low Density Single Family Residential land use depiction provides for
"...single-family residential detached homes at very low densities at a maximum
density of one dwelling unit per acre." The application proposes to construct a
second dwelling to serve as a guest house on a 60.5 acre parcel. The proposed
density is consistent with the Very Low Density Single Family Residential land use
depiction.
Based upon the aforementioned information, the Town of Windsor Planning
Commission recommends approval of the Use by Special Review to the Weld
County Department of Planning Services.

Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the Use
by Special Review Standards, Weld County Code, Chapter 23,Article II, Division 4, Section 23. Our comments
and requirements are as follows:
COMMENTS:
WCR 19 is designated on the Windsor Study Area Capacity Improvement Needs as a collector status road,
which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
The average daily traffic (ADT) count for WCR 19 reflects 2,343 vehicles, taken in a 24-hour-period a this
location.
REQUIREMENTS:
Future Right-of-Way: The applicant should reserve an additional ten foot of property parallel to WCR 19 right-
of-way for future build out.
Access: The applicant shall utilize the existing residential access to this parcel, and no new accesses shall be
granted.
Access and Parking: The off-street parking spaces, including the access drive, shall be surfaced with gravel,
asphalt, concrete, or equivalent, and shall be graded to prevent drainage problems.
Storm Water Drainage: The applicant is indicating that the storm water drainage will be handled through
surface evaporation. Any drainage in excess of the surface capacity will flow into the existing ditches, which will
run north and south through the center portion of the site and disperse on their property.

Environmental Health Services has reviewed this proposal for a 1750 s.f.Cabana/guest house. We have no objections
to the proposal, however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as"development standards":
1. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface
and groundwater contamination.
2. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,blowing
debris, and other potential nuisance conditions.
3. Fugitive dust shall be controlled on this site.
4. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as
delineated in 25-12-103 C.R.S., as amended.
5. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe
manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations thereof.
6. The facility shall utilize the existing public water supply. (North Weld County Water District)
