RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 686 - ROBERT AND BEEY KAWAKAMI WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 686 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 686 was submitted by Robert and Beey Kawakami for property being located in the NE4, Section 35 , Township 3 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into par- cels of 10 acres and 150 acres, more or less, to allow the appli- cants to separate the smaller parcel from their farm. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove de- scribed parcel of land be, and hereby is, exempt from the defi- nition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The parcel of land on which this request is being made is described as NE1 Section 35, T3N, R67W of the 6th P.M. , Weld County, Colorado. The property is located 1.5 miles southwest of Platteville on WCR 211. The property contains approximately 160 acres of Class Its, IVw, VIIs irrigated and VIw, VIIs nonirrigated soils. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 10 acres and 190 acres, more or less. Mr. and Mrs. Kawakami would like to separate a ten acre parcel from their farm to provide a home site and truck farming operation for their son and daughter-in-law. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The request complies with Section 9-2E. of the Subdivision Regulations as follows: - The 160 acres, more or less, under consideration will allow uses that are consistent with the intent clause of the agricultural zone district. The uses will be compatible with existing surrounding uses. - The proposal was reviewed by the city of Platteville and was found to comply with their long-range Comprehensive Plan. .1,026 Board of County Commissioners Page 2 - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - Central Weld County Water District has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from WCR 21h. The applicants, Robert and Beey Kawakami, are presently farming this quarter section and have farmed and lived at this location since February of 1960. 2. Robert and Beey are thinking of retiring and moving to town. Their son, Douglas, and his wife, Janet, who are presently living at 1855 South Monroe, Denver, Colorado 80201, would like to buy approx- imately ten acres off of the family farm and build a home of their own. Their proposal will not be inconsistant with any efficient and orderly development. 3. Where they would like to build their home is above the Beeman Ditch and is approximately 2.7 acres. There is approximately seven acres below the ditch that is farmable and Kawakami would like to put one share of Meadow Island #1 irrigation water with this ten acre parcel. Doug and Janet would like some irrigated ground to do some truck farming and maybe keep a few animals such as a horse and some beef cows or calves. The 7 acres below the Beeman does not appear to be in flood plain. 4. The Kawakamis presently have 72 shares of capital stock of the Meadow Island Irrigation Company with their quarter section. The quarter also has two irrigation wells which were adjudicated for 900 and 1100 gallons per minute. 5. Their home would be located on WCR 212- at the south end of the quarter. The legal would read S2S2SW4NE4 Section 35, T3N, R67W being ten acres more or less in Weld County. The location would create no geological hazard and is not located in Weld County airport overlay district. 6. Central Weld County Water District has a water line in WCR 212- and a water tap is available. A study would have to be made for a tap which is $25.00 and the tap fee would be $2,900.00 for a 5'8" tap. Public Service also has a gas line in WCR 212- and a gas tap is available. A septic system would be installed to meet county health specifications. 7. There would be an easement below the Beeman Ditch at the west end of the ten acres for access to the lower irrigated ground.
