RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST ABSTAR DIENGDOH FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Abstar Diengdoh, VI #0100047, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of July, 2001, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Abstar Diengdoh was not present or represented at said hearing, although
all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until August 14, 2001, to allow adequate time for the property owner
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100047 be, and hereby is, referred to the Weld County
Attomey's Office for legal action against Abstar Diengdoh to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until August 14, 2001, to allow
adequate time for the property owner to bring the subject property into compliance.

The following inspections are taken directly out of Permits Plus for the inspection day of 06/14/01 ( and
06/27/01 is listed below):
Upon a visual inspection of the property, the following items were noted: a vehicle with the hood up and it
appeared that the tires were being inflated additionally a truck without a hood apparently derelict. Upon
driving through the back alley a camper/trailer was noted. The camper/trailer had a TV antenna, curtains,
a fan in the window and the door was open. It was apparently being utilized as a dwelling unit. See
pictures dated 06/14/01 - Disk 65#34-35 and Disk 66#1-2.
The following message is taken directly out of Permits Plus for the inspection day of 06/27/01:
Upon a visual inspection of the property, the following items were noted: Trudy Halsey(Building
Compliance) and myself met with Ms. Langley at the property. She asked me to point out specifically what
my concerns were. I pointed out the black car (currently with a flat tire). She stated that they fill the tire
with air everyday and drive it. I told her that in its current condition it was considered a derelict vehicle.
She stated that her attorney told her that Weld County could not do anything about a flat tire in the
"Agricultural" district. I informed her that her attorney was incorrect, the vehicle in its current condition was
considered a derelict vehicle and therefore was part of a Noncommercial Junkyard. I then mentioned the
camper/trailer. She said that no one lived in it. She said that she leaves a fan in there for circulation, the
antenna was for a radio and the curtains are so no one can look inside. I asked her if it had current
license plates. She stated "Yes". I asked if it was registered specifically under her name. She said "Yes".
I had her spell her name. L-A-N-G-L-E-Y M-A-R-J-O-R-I-E. I asked her how soon she would take care of
the flat tire. She said that she did not have any money to fix it. She then asked if she was going to have
to go to court over a flat tire. When I told her yes, she said that she and her attorney would just see us in
court then. See pictures dated 06/27/01 - Disk 68 #1 &2.
I later called Candy Mondragon at the DMV. She is sending me a report showing that there are not any
camper/trailers registered under Marjorie Langley.

The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting with
the Board of County Commissioners on July 10,2001,at 10:00 a.m.,to consider the violations occurring on the
property. The above mentioned property remains in violation of the following Section(s)of the Weld County
Code:
Chapter 23,Article lit, Div 1 "A(Agricultural)Zone District"
Section 23-3.20 "Uses allowed by right."
Section 23-3-20.A "One(1)single-family dwelling unit and auxiliary quarters per legal log."
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
To bring the property into compliance the following option(s) are available:
Even though several of the derelict vehicles have indeed been removed,upon a visual inspection conducted today,
2 (two) derelict vehicles remained. One is a green truck and the other was a vehicle that had the roof up and
apparently air being placed into a tire. Additionally,it appears that the camper/trailer in the back is being utilized
;as a secondary dwelling unit Weld County no longer allows camper/trailers to be utilized as dwelling units unless
at an approved camping ground. If these remaining items are brought into compliance by July 9'(at my next
inspection),you will not need to attend the already scheduled hearing.
This meeting will take place in the County Commissioners' Hearing Room, First Floor,Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the day before the Violation
Hearing (indicated above).
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation including the action necessary to correct the violation,and
that you were given sufficient time to remedy this violation. If you have any questions concerning this matter,

On May 2, 2001,written notification was sent to you stating your property is in violation of Sections
23-3-20, 23-3-30, and 23-3-30.1 of the Weld County Code and notifying you of a hearing before the
Board of County Commissioners on June 12,2001, at 10:00 a.m. Due to a scheduling conflict,the
Board cannot appear at the date and time specified; however, the violation still exists. Please
consider this letter your official notification that this matter is continued to July 10, 2001, at 10:00
a.m. A hearing on this matter will be held at the time specified above in the County Commissioners
