RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW TO EXPAND AN EGG PRO- DUCTION FACILITY - GEORGE A. STRUBLE WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 16th day of November, 1983, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of George A. Struble , 3198 Weld County Road 4, Erie, Colorado 80516, for a Use by Special Review to expand an egg production facility on the following described real estate, to-wit: Lots 3 and 4 , Block 1, Ranch Eggs Subdivision, Second Filing, being part of the NWa, Section 34, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . The applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows : a. The request is to expand the capacity of the poultry operation from eighteen thousand (18 , 000) to twenty-eight thousand (28 , 000) laying hens and replacement pullets and to expand the building that houses the chickens . This proposal is in agreement with the policies of the Weld County Comprehensive Plan. The Comprehensive Plan supports the expansion and development of agri- business and agriculturally oriented industry, provided these enterprises do not adversely affect the total economy or environment. b. The subject site is located in a large lot sub- division zoned atricultural. The subdivision was platted in 1967 , specifically to accommodate LHR 50 ' JI 3GJI� 830177 Page 2 RE: USR - STRUBLE family poultry farm operations. The proposal is consistent with the intent of the Agricultural Zone District. The use is both compatible with existing agricultural and rural residential uses. c . No overlay districts affect the site. d. Operation and design standards provide adequate protection of the health, safety and welfare of the inhabitants of the neighborhood and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application for a Use by Special Review to expand an egg production facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Operation Standards be adopted for this operation. 2 . The plat for the Use by Special Review Permit be placed on record by the Department of Planning Services staff prior to any building permits being issued on the site. Strubble 1. The permitted use shall be a poultry operation for twenty-eight thousand (28,000) laying hens, replacement pullets and facilities as described in the submitted application materials on file in the Weld County Department of Planning Services Office. 2. The proposal shall comply with the Use by Special Review Operation Standards listed in Section 24.6 et seq. , of the Weld County Zoning Ordinance. 3. The proposal shall comply with the Use by Special Review design standards listed in Section 24.5 et seq. , of the Weld County Zoning Ordinance. 4. All phases of the operation shall comply with all applicable County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 5. The North Huron Water Company will provide the water supply for the proposal. Prior to beginning the operation, a cistern shall be installed and operated according to the method for supplying water, described in the submitted application materials. 6. The Use by Special Review shall be limited to the plans shown hereon and governed by the Operation Standards stated above, and all applicable Weld County regulations. Any material deviations from the plans and/or Operations Standards, as shown or stated above, shall require the approval of an amendment of the Use by Special Review permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Operation Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Operation Standards. Noncompliance with any of the above stated Operation Standards may be reason for revocation of the Use by Special Review Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET #83-69 RE: USE BY SPECIAL REVIEW, EXPAND AN EGG PRODUCTION FACILITY, GEORGE A. STRUBLE A public hearing was conducted on November lF 1983 at 2:00 P. M. , with the following present: Chuck Carlson Chairman John Martin Pro Ten Gene Brantner Commissioner Norman Carlson Commissioner Jacqueline Johnson Commissioner Also present: Acting Clerk to the Beard, Tommie Antuna Assistant County Attorney, R. Russell Anson Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated October 24, 1983, and duly published in the La Salle Leader on November 3, 1983, a public hearing was held for the purpose of considering the request of George A. Struble to expand an egg production facility. Mr. Anson, Assistant County Attorney, read this request into the record. Mr. Allison, Planning Department representative, read the favorable recommendation from the Planning Commission into the record. He also read the conditions and said there are 7 Operation Standards associated with this request. Mr. George Struble was present and came forward to explain to the Board what his intentions are concerning the expansion of • this egg production facility. He said he intends to expand from 18,000 layers to approximately 28,000. Mr. Struble said he felt he would be able to comply with the 7 Operation Standards. Mr. Struble said that he would use proper barn management in order to help control the fly problem. He said no accumulation of manure would be allowed due to daily removal from the barn and weekly removal from the premises. He said the manure would be kept in an enclosed truck. Mr. Struble said the water spillage will be cut by 50% due to the new water system which has been installed, so there will be no increase in water consumption with this expansion. After a short discussion, Mr. Adolph Farrar, an adjoining landowner, came forward and commented on this request. Mr. Furrer said he is opposed to this operation because he feels it is a health hazard and a detriment to the community. Mr. Furrer has concerns about the problems which may occur if the manure is not properly taken care of. Mrs. Furrer also came forward and voiced her opposition to this facility. Mr. Dick Hicks came forward and explained the new water system and the con- struction of the chicken houses. He said the cistern is designed to hold a 4 day water supply. Ron Stow and Wes Potter, Health Department representatives, came forward to comment on the facility. Mr. Stow and Mr. Potter recommended that the manure be removed bi-weekly from the premises. After discussion, Commissioner Martin moved to approve, with conditions and Standards as recom- mended, this Use by Special Review request from George Struble. Commissioner N. This area, Ranch Eags iubdiv_sion, has had problerr,s for :,any years and thru your office several years ago we were able to get it reasonably cleaned up. The past two _years we have been on -a downhill slide again. Last summer the flies were al- most like a plague. Even as early as 5:n^ a.m. while working my horses in my arena the files would be all over me and the harse. I had to keep my animals locked up in the daytime because the flies were so bad. Personally, we had spent way over a hundred dollars just on fly control, plus I lost business as I am a horse trainer, breeder. My, stallion, an expensive to say the least,Trakehner horse, developed a very serious skin infection and also had sores on his hocks were the flies were eating away on him. This was occuring -even with fly repellent. Why should they, be able to increase the -size of their business and I lose business? Moving is not the answer, far how can you show your house to perspective buyers with flies hanging all over. The Weld County,.Planning Commission knows very little about health control because Mr. Struble states, as per the newspaper article, that he would dispose of manure once a week. I personally invite them to visit here after it has sat around a week in the sum- mer. If the flies wouldn't drive them aYay the stench would. Why, wasn't the health department in on this public hearing? Dr. Ralph Wooley from the Weld County Health Department was very helpful in getting them to again begin to comply with daily disposal of manure, cleaning up the maggots, etc. But the health department has to check this area out on a regular basis. Whoever these men are on the Weld County Planning Commission have no right to be in such a position if they do not know facts, or try to determine the facts. But this I will say and will {3O on record, that this coming summer, we will not tolerate another fly situation. The minute it scours, the intention is to go ahead -a get some publicity to let the world know how we keep Colorado beautiful. 1 Weld County seems to feel that since we are out here on the edge of the county,that we can be the .ion^in ; grounds. Not only do we have to live with flies from chicken ranchers but the trash site off ad. 7, makes that road aLnost as dangerous as 1-25 and since I crate to pus office, -chore has not he one police patrol out there. A Subdivision located in the NW }, section 34, TIN, R68W of the 6th P. M. Weld County, Colorado. Dear Mr. -Allison: The following information and documents are enclosed as it applies to our application for spacial review of our propoaed -expansion of an existing egg :producing facilities in Weld County, Colorado. Description of Proposed Operation: I wish to apply for special use Review for the -extension of the existing barn that has been in use for the past several years, as an egg laying operation. The -extension will be 109 feet to the existing 148 feet. This barn will house 27,500 laying hens. The rows of cages Will be automali-d for feed, water, manure removal, and egg gathering. It will be a family operation entirely with a total of fiour persons at any given time. The facility will have virtually no environmental pollution or noise in addition to the existing area operation. - 2 - C Manure removal will be weekly to designated farms for fertilizer in the area. The dead chickens will be held in an enclosed facility and de- livered to a Longmont Rendering Plant, regularly as required. Road traffic will be egg pickup bi-weekly and grain delivery bi-weekly. In addition to the barn extension there will be a separate, building for processing and cooling of the eggs. This building will be steel siding with a water storage cistern for emergency water for barn with night- time filling at low peak demand times. Question #1: Referring back to our previous conversation, as you are aware, the Ranch Egg Subdivision of which we are part of has been designated by the county, agricultural zoned. Subdivision for the purpose of egg producing farms. The majority of the existing farms in this subdivision have been or are now producing eggs. As I referred to earlier, the property has been a producing farm in the past and we are expecting to up date and expand the opera- tion to meet the currect industry standards of production and waste management. • Question #5( A. We are proposing to increase the size of the existing egg pro- duction facilities. The type of use is not to be changed. B. The Ranch Egg Subdivision has been established as family farm type Mperation. Each lot of -approximately 4 to 5 acres has s residence located on the property. (See attached vicinity map) C. This is to be a family operation with 2 family employees - approximately 2 full or part time non family employees. A total of 4 employees. D. Refer to "C" F. With the -expanded operation we are proposing -a facility to house 28,000 laying hens. G. An extension of the existing post frame and steel building is proposed to house the equipment and hens. This expansion is to be 40' wide by 109' long. We are expecting to add a 30' wide X 90' long post frame or steel building for egg -storage and packaging. H. The frequency of vehicular traffic on the site will not change from existing use as the -feed handling and manure handling equipment will increase in size with the operation. Weld County. Road #7 and 4 are to remain the access -route. Feed trick — weekly Manuer Truck - weekly Rendering truck - weekly Egg pick-up - weekly I. Any domestic sewage mill be jielivered to the existing septic system - System will be resize-d if necessary by building or health department codes. J. Waste materials to be removed from the facility , for which application for a Special Use Permit is made, would be manure and dead thickens. The new building would be of the "Barn Clean" type, in which hens are housed in the cage levels with manure accumlated on the floor. The facility would be completely enclosed with approximately b days storage capacity for manure. However, it _ planned that the manure would he removed approximately every week to coincide with the fertilizing periods of the farming community. Upon removal from the barn, the manure would be delivered to farmers for application to farm ground as fertilizer. Fanners who accept chicken manure for fertilizer are: Paul Baker - Weld County Road #6 Vernon Sioux - Weld County Rad #6 John Clelland - Weld County Road #7 Tanaka Farms - Highway #287 In addition Lloyd Rockwell 175th accepts manure for his liquid -slury system which he then provides to farmers as liquid fertilizer. in iue of the cold weather potential we have planned for a 24' X 14' stock pile bunker to expand our hold to 60 days. As the building is designed to store manure for 18 months there would be minimal outside storage of manure on the pro- perty. Disposal of dead chickens would be by delivery to the Long- mont Rendering Plant on a weekly basis -with dead birds being held in cool storage until removal. K. See "J" L. It is estimated that a 6 month construction period is required for building completion and equipment installation. M. The farm type land soaping is proposed to remain the same with a constant weed control grogram to be kept current. N. N/A 0. To remain as existing. r • METHOD FOR SUPPLYING WATER The operation on the property for which application is made for a Special Use Permit is an expansion of an Egg Laying Operation that has been an on-going operation for 11 .— 12 years. During thin period wate-r has been supplied continually to the existing facility by the North Huron Water Company with a tap and water meter to the property. The expanded facility would continue to obtain wste-r from North Huron Water Company as it has In the past. Water quality is maintained to County and Stat-e Standards for human consumption a-s it is also the sup- ply of water to the community for human consumption. The watering of the chickens -mill be made directly from a concrete cis- tern with a capacity of 3 - 4 days water supply. With direct watering out of a cistern, there would be no water taken from the Water Company system during the daytime ptak consumption periods, and the water cistern would be replenished during the night when there is no water demand from the conununity. In this manner there should be i?o noticeable effect on the _community. • • Also, as the cistern will hold 3 — -4 days: water supply , if there should be a temporary interruption of water supply due to equipment or power failure on the part of North Huron Water Company , there would be suffi- cient water to carry the chickens until repairs could be made and ser— vice resumed. A letter from North Huron -Water Company is attached verifying that the property has a water tap and meter, and will continue to be supplied in the future. Struble, please be advised we will not be able to attend, Pet would like to voice our opinion in writing. We would like to have it know that we are definitely ageinst another ego production facility in this area, for the following reasons: 1. =SETH: flies, _enure wastes, lead chickens, broken eggs disposes of on ground, etc., The Health Deeartr..ent has had to be contacted on several occasions since we have been here because (unless the area is on a regular supervised schedule) the aforementioned becomes deplorable and a health hazard. Have had veterinarian expenses due to fly related disease. Also this summer could barely train horses due to the density of the fly population. 2, WATER; The water supply has been short on several occasions. Another tap would have to be issued, making a further drain on the water. The water board several years agu stated that no further taps should be issued for that reason. Another egg production facility would be a tremendous drain on existing water supply. In general this area being on the far edge of Weld County is not serviced by the County with any, of the services, not even adequate rolice or fire protection is realized here. Cars and trash trucks are allowed to speed up and down Road 7 at 50 mph and better even though reported. Originally when we first moved out here, in order to get Health Dept. to respond, the Governor had to be contacted. In view of the above and other reasons too numerous, let the records state that we are adaeently against another egg production facility.
