HomeMy WebLinkAbout20012017.tiff HEARING CERTIFICATION DOCKET NO. 2001-47 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1333 FOR A USE PERMITTED AS A USE BY RIGHT OR ACCESSORY USE IN THE COMMERCIAL ZONE DISTRICT(TRUCK AND LANDSCAPE MATERIALS STORAGE)IN THE A(AGRICULTURAL) ZONE DISTRICT - BRETT AND MICHELLE BERNHARDT A public hearing was conducted on July 18, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Robert Anderson Health Department representative, Charlotte Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 28, 2001, and duly published July 4, 2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Brett and Michelle Bernhardt for a Site Specific Development Plan and Use by Special Review Permit #1333 for a Use permitted as a Use by Right or Accessory Use in the Commercial Zone District (truck and landscape materials storage) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Robert Anderson, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr.Anderson gave a brief description of the surrounding uses and location of the site. He stated the parcel is approximately 1.68 acres in size, there are no apparent zoning violations, and the site is neat and orderly. He stated eight referral agencies responded favorably or proposed conditions, and one agency indicated no conflict. Mr.Anderson reviewed the reasons for approval as indicated in the Planning Commission Resolution. In response to Commissioner Jerke, Mr. Anderson stated the site is located one-half mile east of Milliken, and lots shown on the map are proposed for development within the Town. Don Carroll, Department of Public Works, stated the site will be accessed from Highway 60,and there is an access permit from CDOT,and a traffic count indicated approximately 3,900 vehicles travel Highway 60 per day. In response to Chair Geile,Charlotte Davis, Department of Public Health and Environment, stated the Weld County Health Department is not requiring the applicant to apply for a Class V injection well; however, the applicant is required to contact the State and provide evidence as to whether one will be required by the State. She further stated Condition of Approval #2.A addresses this issue, and the term "if applicable" could be added for clarification. 2001-2017 Az /G7:, AtZ_ PL1540 HEARING CERTIFICATION - BRETT AND MICHELLE BERNHARDT (USR#1333) PAGE 2 In response to Chair Geile, Michelle Bernhardt, applicant, stated she and her husband have reviewed and agree with the Conditions of Approval and Development Standards. She stated they will have the floor drain into a vault,which the State has indicated will not require an injection well, and she added they are not opposed to changing the language in Condition of Approval #2.A to add "if applicable." No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Brett and Michelle Bernhardt for a Site Specific Development Plan and Use by Special Review Permit#1333 for a Use permitted as a Use by Right or Accessory Use in the Commercial Zone District(truck and landscape materials storage) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. His motion also included an amendment to Condition of Approval #2.A to add "if applicable"following the word"permit." The motion was seconded by Commissioner Masden,and it carried unanimously. This Certification was approved on the 23rd day of July 2001.
