standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been mermen This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
IIIe application and the policies of Weld County.
1. Aa Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The applicant has proposed a well as the source of adequate water for Lots A and B. Property owners
are advised that the quality of water available for usage may be limited to specific uses, i.e.,"Domestic
',:i. t Use Only," etc. Because each situation is unique, the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each
individual situation.
3. The proposed acreage for Lot A (eastern Lot) does not meet current standards established by the
Weld County Department of Public Health and Environment. The existing two(2)homes and two(2)
septic systems proposed for Lot A are not in compliance with regulations of the Weld County

Department of Public Health and Environment. The Department encourages the applicant to increase
the size of Lot A(eastern lot)to 3-1/2 acres.
4. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may
limit the area available for a new or replacement septic system. Prior to recording the plat, the Weld
County Department of Public Health and Environment recommends that the applicant review the Weld
County Code pertaining to septic systems to assure that any installed septic system will comply with
all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to
allow the installation of a septic system, the lot may need to be enlarged.
5. The soil found on this parcel of land is very limited for septic tank absorption fields and shallow
excavations. Drainage is very limited. The erosion hazard due to wind is high. If future land use will
include grass establishment and grazing, the owner shall contact the Natural Resources
Conservation Service (NRCS)for guidelines on establishing and maintaining the grass and grazing
management.
6. Prior to recording the plat:
1. The plat shall be titled: Recorded Exemption No. 1309-9-X RE 3174.
2. The applicant shall submit to the Weld County Department of Planning Services evidence that
any existing septic system meets all requirements of the Weld County Department of Public
Health and Environment. The applicant shall submit a septic system replacement envelope
for all three (3) systems. Existing septic systems and replacement envelopes must meet
setbacks from proposed property lines.
3. The applicant shall submit a joint ownership,access and/or operation maintenance agreement
for the shared well. This agreement should include an easement on all lots and access
necessary for maintenance. This agreement shall be delineated on the plat and an appropriate
certificate using the language set forth in the Weld County Code, Appendix 24-F.E shall be
included.
A. Ina referral dated August 20, 2001, the Fulton Ditch will not allow its ditch access road to be
� � used as a private drive to provide primary access to either Lots A or B.
B. The applicant shall contact the oil and gas/ditch owner to obtain written permission to utilize their
access road for residential purposes.
C. The applicant shall attempt to address the requirements (concerns) of the Fulton Ditch
Company,as stated in the referral response received August 20,2001. Evidence of such shall
be submitted in writing to the Weld County Department of Planning Services.
D. The applicant shall submit to the Weld County Department of Planning Services one of the
following:
1. A recorded copy of any agreement signed by all of the owners of the property crossed
by the access. The access shall be for ingress and egress and shall be referenced on
the plat by the Weld County Clerk and Recorders reception number.
2. Evidence that the access is dedicated as right-of-way by Weld County.
3. A 30 foot wide joint access and utility easement extending across Lot A (eastern Lot)
from Weld County Road 31,for the benefit of Lots A and B,shall be shown clearly on the
plat. The joint easement shall be dedicated for the use as shown using the language set
forth in the Weld County Code, Appendix 24-F.E. The easement shall be graded and
drained to provide all weather access.

H. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP)is Weld
County's minimum size. If the applicant chooses to place a larger culvert please cfontsct the
Weld County Department of Public Works to adequately size the culvert.
Weld County Roads 31 and 16 are designated on the Weld County Transportation Plan Map
as collector status roads,which require 80 feet of right-of-way at full build out.There is presently
60 feet of right-of-way.These roads are maintained by Weld County. Pursuant to the definition
of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required
setback is measured from the future right-of-way line.
J. The applicant shall indicate specifically on the plat the type of right-of-way/easement and
indicate whether it is dedicated, private or deeded to provide adequate access to both parcels.
K. Th'ap licant shall address the requirements of Weld County School District RE-_as
state in the referral response received . Evidence Evidence of such shall be submitted in
writ g the Weld County Department of Planning Services.
R. All vehicles located on the property must be operational with current license plates, or be
screened from all adjacent properties and public rights of way,or be removed from the property.
All other items considered to be part of a noncommercial junkyard must also be removed from
the property or screened from adjacent properties and public rights-of-way.
S. The applicant shall complete and submit the appropriate zoning and building permit applications
and pay the appropriate fees to the Weld County Department of Planning Services for the
mobile homes located on Lots A and B.
U. Both Lots A and B shall comply with the one(1)acre minimum lot size required by Section 24-8-
80.E of the Weld County Code.
X. The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
Y. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Future development on the property may necessitate a larger parcel than what is
displayed on the plat in order to utilize a septic system. In addition, a larger parcel would
provide additional dilution and attenuation of sewage wastes which may be beneficial to
the environment.
4) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
5) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lots A and B have an adequate water supply of
sufficient quality, quantity and dependability.
6) Potential purchasers should be aware that Lots A and B may not be eligible for a
domestic well permit which allows for outside irrigation and/or the watering of stock
animals. The State Division of Water Resources issues all well permits.
7) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
8) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
9) The approved configuration of Lot A (eastern Lot) does not constitute justification for
further land splits.
10) Recorded Exemptions on adjacent properties may raise the issue of compliance with the
intent of the Recorded Exemption Process.Approval of this Recorded Exemption does
not guarantee approval of future applications on adjacent properties.
11) All mobile homes as medical hardship uses are temporary. Allowance of the mobile
home shall be extended only if the use continues to be in conformance with the criteria
established in Section 23-4-170 of the Weld County Code. The mobile home shall be
removed from the property if the mobile home cannot be legally permitted for an
approved use as listed in Chapter 23, Article IV, Division 3 of the Weld County Code.
12) Potential Purc ser are hereby notified that a confined animal feeding operation
is located direct ast of the intersection of Weld County Roads_and . Off-
site impacts th ay be encountered include noise from trucks, tractors and
equipment; d t fro animal pens and odors from animal confinement, silage,
and manure.
13) Prior to the release of building permits on Lots A or B,the Lot owner shall verify with the
nearest Town/City or Sanitation District to determine the location of the nearest sanitary
sewer line. In accordance with the Weld County Code, if a sewer line exists within four
hundred (400) feet of the property line and the sewer provider is willing to serve the
proposed structure,a septic permit cannot be granted by the Weld County Department
of Public Health and Environment. Evidence of such shall be submitted in writing to the
Weld County Department of Planning Services.
14) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest,and gravel roads;odor from animal confinement,silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient that urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
7. Any proposed subdivision adjacentto or contained within this recorded exemption may be considered
to be urban scale development. Urban scale infrastructure may be required.
8. The applicant shall submit a Mylar plat and a paper copy of the Mylar plat to the Weld County
Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County
Code. The plat shall be submitted within sixty(60)days from the date of approval by the Weld County
Department of Planning Services. The applicant shall be responsible for paying the recording fee.
9. The Weld County Department of Planning Staff's approval of this Recorded Exemption Applicationis
based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable tomeet any
one of these conditions within 60 days of approval,then this case will be forwarded to theWeld County
Board of County Commissioners with a staff recommendation for denial.

Dear Mr. Glover:
The Department of Planning Services' reviewed your application, referral agency responses and related
materials for compliancy with the Weld County Code this morning in a staff meeting. The Department Staff
found that your proposed Recorded Exemption does not meet the intent of the Code. More specifically,the
referral response from Gaunt, Dirrim, Coover and Steele, P.C. dated August 20, 2001 provides concern
regarding your proposed access. In this letter, Mr. Steele states, "The Fulton cannot allow its ditch access
road to be used as a private drive to provide primary access to a home site or other property." The Weld
County Department of Public Works also expressed concern regarding access. Referral responses are
included for your use.
Without an approved access,this application should not have been accepted for processing. Please contact
the Director of the Department of Planning Services,Ms. Monica Daniels-Mika regarding a partial refund of
the application fee.
Enclosed is information regarding the difference between Home Occupation and Home Business for
Glover's Drilling business. In addition, all structures and signs must receive appropriate building permits.

you propose to own/operate can be best described with definitions from Chapter 23 of the Weld
County Code, as a "Home Business" or a "Home Occupation." Refer to the definitions for
assistance in making your determination. Please do not hesitate to call the Department of Planning
Services if you have any questions.
The Department of Planning Services requests that you write a brief letter addressed to our
department which outlines some aspects of your business. Our staff will review the letter and
determine if your business or proposed business will require a Use by Special Review (USR) or a
Certificate of Compliance (COC). Please comment on the general nature of the business and
include information about the following:
1. The number of employees of the business.
2. The hours of operation for the business.
3. The exact location of the business (for instance, is it located within a room in the home or
is it located in a garage or an outbuilding?).
4. if it is located within the home, what are the dimensions of the room in which the business
is conducted?
5. Is there outside storage of materials or equipment?
6. How many customers are expected to visit the site per day or per week?
7. What kind of advertising for the business is there at the site. including signs, the name or

The following definitions are derived from of the Weld County Code:
HOME BUSINESS: An incidental USE to the principal permitted USE for gainful employment of the
FAMILY residing on the property, where:
1. Such USE is conducted primarily Within a DWELLING UNIT or ACCESSORY
STRUCTURE and principally carried on by the FAMILY resident therein;
2. Such USE is clearly incidental and secondary to the principal permitted USE and
shall not change the character thereof.
3. Ordinarily a HOME BUSINESS shall not be interpreted to include the following:
clinic,hospital,nursing home,animal hospital,HOTEL/MOTEL,restaurant,mortuary,
and organized classes where more than six(6)persons meet together for instruction
on a regular basis. (Does not include classes sponsored by a PUBLIC SCHOOL).
HOME OCCUPATION: An incidental USE of a DWELLING UNIT for gainful employment of the resident
therein, where:
1. Such USE is conducted entirely within a DWELLING UNIT and carried on by the
residents thereof and no others.
2. Such USE is clearly incidental and secondary to the USE of the dwelling for dwelling
purposes and shall not change the character thereof.
3. The total area used for such purposes does not exceed three hundred square feet.

explosive or combustible materials.
6. There is no offensive noise, vibration, smoke, dust, odors, heat, glare or electrical
interference or other hazard or nuisance noticeable off the LOT if the occupation is
conducted in a SINGLE FAMILY DWELLING or outside the DWELLING UNIT if

Dear Ms. Johnson:
Thank you for your referral of August 13, 2001 on the above referenced case.
The Fulton claims a 85-foot prescriptive easement in the location in question for
the operation and maintenance of its irrigation ditch. The company cannot allow above
or below ground structures within its easement area.
The Fulton cannot be depended upon to provide flood routing or storage for the
surrounding property.
The Fulton cannot allow its ditch access road to be used as a private drive to
provide primary access to a home site or other property.
In addition the company would request that any party placing a septic system in
close proximity to the ditch show that such system will not endanger the quality of water
within the ditch.

Your recorded exemption application is being processed. If it is determined that the application meets the
approval criteria of Chapter 24 of the Weld County Code, you will be notified that the recorded exemption is

Commissioners. You will be notified and asked to appear before the Board of County Commissioners at a

RECORDED EXEMPTION QUESTIONNAIRE
(Applicant Statements)
1. Water Supply
a. A copy of the existing well permit has been included in this submittal.
b. There is no irrigation water on the proposed lots.
2. A copy of the septic permit will be submitted to the Department of Planning Services upon approval of
the recorded exemption.
3. The property's current use is primarily residential . There is an existing residence and a mobile home
that was approved through a medical hardship.The location of the proposed new lot is vacant land with no
improvements. There is an existing gas well on the location of the proposed new lot. Due to the location
and size of the original and the proposed lots,this area would not be considered prime farm ground,but
rather nonprime and would be consistent with other residential property in the surrounding area.
4. The proposed new lot would be for the residential use of the applicant's sister. The existing lot would
continue in its current residential usage.
5. The entire parcel would be divided almost equally(approximately 3 acres to each proposed lot). The
present use of the proposed new lot is vacant land.
6. Not applicable.
7. All proposed and existing structures will and do meet minimum set back and offset requirements.
8. Do to the size of the proposed lots,it would not be practical to make an allowance for a conservation
easement.
9. Not applicable.
10. The primary reason for this request is to allow a family member to build a residence and raise a family
in a rural environment. We understand the need to preserve agricultural land in Weld County for the same
reasons that we want to be able to continue to live and raise our families here. The proposed lot will not
interfere with the current agricultural existence of the surrounding area.
1 1. The proposed lot would be consistent with the neighboring land use, which is comprised of single
family dwellings set on lots less than,equal to and greater than the proposed lots.
12. The proposed lots are located in the Agricultural district and would be consistent with other homes and
parcels of land in the area.
13. The proposal requested will comply with Weld County Code and will be consistent with plans to
develop efficiently and orderly. The usage will be residential for a single family. This proposal would
supply the need of living in a rural area on a small"farm"to exist compatibly with the surrounding areas
while complying with the codes set forth by Weld County.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Weld County Recorded Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 31 is designated on the Transportation Plan Map as a collector status road, which requires an 80-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-
3-50, the required setback is measured from the future right-of-way line.
WCR 16 is designated on the Transportation Plan Map as a collector status road, which requires an 80-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-
3-50, the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application, with concerns on
Legend access across Lot A to access Lot B.
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is
dedicated, private, or deeded to provide adequate access to the parcel. (Lot B)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
The applicant shall contact the oil and gas or ditch owner to obtain, in writing, permission to utilize their access

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. If the two houses are proposed to share a common well, the applicant shall
submit a joint ownership and maintenance agreement. This agreement should
include an easement on all lots and access necessary for maintenance.
3. Prior to the release of building permits on the west lot, the lot owners shall verify
with the nearest Town/City or Sanitation District to determine the location of the
nearest sewer line. In accordance with the Weld County Code, if a sewer line
exists within 400 feet of the property and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld County
Department of Public Health and Environment.
Additionally, please note the following:
1) Our Department recommends the applicant to set aside an area for a septic
system replacement envelope for all 3 systems. Existing septic systems and
replacement envelopes must meet setbacks from proposed property lines.
2) This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

3) The proposed acreage for the east lot (lot A) currently does not meet current
Weld County Health Department policy, due to the existence of 2 homes, and 2
septic systems. We would encourage the applicant to increase the acreage for
the east lot to 3 '/2 acres. If the proposed west lot (lot B) acreage ends up less
than 2 A acres, then the proposed lot would not meet current Weld County
Health Department policy. However, in the event the applicant cannot or
chooses not to increase the lot size, please place the following note onto the plat.
Future development may necessitate a larger east lot (lot A) than what is
displayed on the plat. In addition, a larger lot A would provide additional dilution
and attenuation of sewage wastes, which may beneficial to the environment.
4) Topographic or physical features of the proposed lot, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicant
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may be need to be enlarged.

In consultation with the Natural Resources Conservation Service(NRCS),we have reviewed the above
referenced case and have the following comments.
SOILS/LIMITATIONS: The soil found on this parcel of land is very limited for septic tank absorption
fields and shallow excavations, It is not limited for dwellings with or without basements. Drainage is very
limited. The soil is generally well suited for windbreak and landscape plantings.
PRIME FARMLANDS: No Prime Farmlands will be taken out of production.
SOIL EROSION POTENTIAL: The potential for erosion by water is low but the erosion hazard due to
wind is high.
OTHER: If future land use will include grass establishment and grazing, we would recommend that the
new landowner contact the local NRCS office for guidelines on establishing and maintaining the grass and
grazing management. Additionally,the future landscape plan should address the reduction of water use
with the use of Xeriscape. We also recommend that Ron Broda,Weld County Vegetation Management
Specialist be contacted to assist the landowner in developing a weed management plan. Ron can be
contacted at 970-356-4000 x3770.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(c)for the relocation of an existing well, permit 32275. The old well must
be plugged and sealed according to the Water Well Construction Rules within ninety (90) days of completion of
the new well. The enclosed Well Abandonment Report form must be completed and submitted to affirm that the
old well was properly plugged and sealed.
4) The use of ground water from this well is limited to domestic use per Division 1 Water Court Decree W-1220.
5) Plain casing must be installed and properly sealed to a minimum depth of 560 feet to prevent diversion of water
above this depth. The depth of the well shall not exceed 850 feet, which corresponds to the base of the Laramie-
Fox Hills aquifer.
6) The maximum pumping rate shall not exceed 30 GPM per Division 1 Water Court Decree W-1220.ne S-i5'gft
7) This well shall be constructed not more than 200 feet from the location specified on this permit.
8) Emergency verbal approval 98-VE-105, was given on March 31, 1998, for construction of this well.
