and agree to and with the grantee, its successors and assigns, that at the time of the
ensealing and delivery of these presents, he is well seized of the premises above
conveyed, has good, sure, perfect, absolute and indefeasible estate of inheritance, in
law, in fee simple, and has good right, full power and lawful authority to grant,
bargain, sell and convey the same in manner and form as aforesaid, and that the same

The grantor shall and will WARRANT AND FOREVER DEFEND the above-bargained premises
in the quiet and peaceable possession of the grantee, its successors and assigns, against

The singular number shall include the plural, the plural the singular, and the use of any
gender shall be applicable to all genders.

portion of subject property lying within a certain drain ditch beginning at or near the
center of the South line of the NW 1/4 of said Section 25 and extending in a Northeasterly
direction to the North line of the NE 1/4 of said Section 25 at or near the Northeast
Quarter corner of said section, as retained by the said Frederick Wattenberg, also known
as Fred Wattenberg in Warranty Deed to Christian Wattenberg recorded October 19, 1897
in Book 155 at Page 37 conveying that portion of the NE 1/4 of said Section 25 lying West
of said drain ditch, and in Warranty Deed to Anna Wattenberg, Fritz Wattenberg, Julius
Wattenberg and Christian Wattenberg recorded October 19, 1897 in Book 155 at Page 38
conveying that portion of the NE 1/4 of said Section 25 lying East of said drain ditch.

Eventhough Grantor makes no warranty, Grantor shall be required to comply with the
terms of Agreement for Escrow of even date between Grantor and Grantee seeking to resolve any
