The Greeley-Weld County Airport Authority has reviewed the subject referral and offers the
following comments:
Latham View Estates consists is a Planned Unit Development consisting of four(4) Estate zoned
lots and common space. The proposed homes are located within the extreme SW boundary of
the Airport's Influence Area and underneath the 7:1 slope transitional surface area. As such the
Greeley-Weld County Airport Authority does not object to the residential estate development,
however, we recommend that a noise and overflight statement be recorded and run concurrently
on the properties.

We have reviewed the request and have the following comments:
• The site is within the boundaries of Weld County School District RE-1.
• Bus pickup location will be on W.C.R.43. The proposed driveway location is not adequate for our school buses to use as a
turn around point.
• The applicants have not contacted the school district to discuss an"agreement"regarding the development as indicated on
page three of the Specific Development Guide. We are not aware of the intent or content of said agreement.
• Weld County School District RE-1 has developed the enclosed methodology for Land Dedication and/or In Lieu Payments.
It appears that the project would best be addressed in the form of In Lieu Payments. The amount per single family unit is
$1,054.20. The proposed plan indicates the development of four single family units for a total In Lieu Payment of
$4,216.80. The amount is to be paid to the school district prior to the approval and recording of the final plat for the project.

1. Building permits shall be obtained prior to any construction. Building permits are not
required for buildings that qualify for and receive a Certificate of Compliance, but an electrical
permit will be required for all buildings if electrical service is provided to the building.
2. A plan review will be required for each building. Two complete sets of plans are required
when applying for the permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.

This (4) lot PUD will not be required to meet the fire flow requirements per a
previous agreement between Fire Marshal Gary Sandau and the developers Dave Keiser
and Mike Sigg. This agreement is exclusive with this (4) lot PUD, if in the future there
are to be more than (4) homes within this enclave of land the developers shall at that time
provide the minimum fire flow required from the 1997 UFC.
With regards to section 2.1 of the response letter prepared by Todd Hodges
Design to the Department of Planning Services it shall be noted that the Fire District
mentioned is incorrect, it shall be stated "LaSalle Fire Protection District" instead of
"Galeton Fire Protection District".
1. Current District street standards provide that streets 34' and greater can allow
parking on both sides of the street; streets 28' in width will allow parking on one
side of the street only and "NO PARKING FIRE LANE" signs shall be posted on
one side. All streets less than 28' shall be prohibiting parking on either side and
"NO PARKING FIRE LANE" signs shall be posted on both sides of the street.
2. Cul-de-sacs shall have a minimum 50' turning radius. A B-40 turning template
shall be used to determine adequate turning radius. Required vertical clearance
shall be 13'6". There shall be no grade greater than 6% on open streets and no
grade greater than 4% in intersections. Maximum depth of cul-de-sacs is 600' if
greater than 600' there shall be (2) points of access provided. Streets are to be
designed and constructed of an all weather driving surface capable of supporting
80,000 lbs of H2o loading.

3. The District allows cul-de-sacs to be a maximum of 600' in length. This cul-
De-sac is approximately 900' in length therefore it shall be provided with an
emergency access located off WCR 46 %2. Please see exact location located on
the landscaping plan that we have reviewed. This access shall be designed to
support 80,000 lbs of H2o loading; it shall be constructed of an all weather
driving surface. The developer shall provide a copy of the HOA covenants
showing that the HOA shall be responsible for the maintenance of the main street
and the emergency access.
4. The developer shall provide drawings showing the exact location of the
emergency access along with a complete detail of the barrier and signage to be
used at the entrances of the emergency accesses.
5. Fire safety during construction shall comply with section 8704 of the "97' UFC.
6. When construction of new homes starts Addresses, Street Names, and Signs shall
be posted.

Dear Mr. Ogle:
This letter is an addition to the previous referral response letter dated August 29, 2001
concerning the Latham View Estates Change of Zone application. I have spoken with the
property owners concerning conditions number 3 and 4,which pertain to the cul-de-sac
length and a requirement for an emergency access.
The District will allow a larger cul-de-sac radius of 65 feet in lieu of the emergency
access mad. The property owners have indicated that they are willing to increase the
proposed cul-de-sac radius in lieu of the emergency access roadway. The increase in the
cul-de-sac to 65 feet will eliminate the need for an emergency access, as stated in
condition number 3 and will eliminate condition number 4 in the previous letter.
Please accept this additional information to provide the property owners an option to the
emergency access road.

Dear Mr. Ogle,
At your request and in accordance with S.B. 35 (1972) this office has reviewed the materials
submitted for the proposed Sketch Plan and conducted a site inspection of the property on September
25, 2000. The property is bound by County Road 43 to the west and County Road 46 '/2 to the north.
Current usage of the land is agricultural. The property was previously irrigated but is not presently.
Topographically the site is flat. Our understanding is that the proposed residences will be served
by ISDS and water service provided by a local water district.
The soils that mantle this site are silty sands that are eolian or windblown in origin. These
soils can be moisture sensitive. We concur with the conclusions and recommendations of the
Geotechnical Engineering Report prepared by Terracon dated July 31, 2000. Proper water
management will be important so that the underlying bearing soils do not become wet. The drainage
and perimeter drainage system recommendations in the geotech report are very important for proper
long-term foundation performance. Proper slopes should be sloped away from the foundation walls
and downspouts should have splash guards or extensions to direct rainfall run-off away from
foundation walls.
Provided the recommendations of the consultant are complied with, this office finds no
geologic hazard that would preclude the development plan as intended. If you have any questions

The Weld County Department of Public Health and Environment has reviewed this proposal.
The application has satisfied Chapter 27 of the Weld County Code in regard to water service. Water is to be
provided by the Central Weld County Water District. Evidence of pre-purchased water taps from Central Weld
County Water District is provided in the application materials.
The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service.
Sewer will be provided by individual sewage disposal systems. The minimum proposed lot size of 6.248 acres
coupled with the overall density of one system per 11.25 acres meets the current Department policy.
The initial impact plan submitted in the application materials appears to address all impacts as required by
Section 27-6-40 of the Weld County Code.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the Central Weld County Water District.
2. A Weld County Septic Permit is required for each proposed septic system and shall be installed according
to the Weld County Individual Sewage Disposal System Regulations. Each septic system shall be
designed for site-specific conditions, including but not limited to maximum seasonal high groundwater,
poor soils, and shallow bedrock.
3. The applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and the Environment,if required. Silt fences shall be maintained
on the down gradient portion of the site during all parts of the construction phase of the project.
4. During development of the site,all land disturbance shall be conducted so that nuisance conditions are not
created. If dust emissions create nuisance conditions, at the request of the Weld County Health
Department, a fugitive dust control plan must be submitted.
5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that
disturbs more than 5 acres of land must incorporate all available and practical methods which are
technologically feasible and economically reasonable in order to minimize dust emissions.
6. If land development creates more than a 25 acre contiguous disturbance,or exceeds 6 months in duration,
the responsible party shall prepare a fugitive dust control plan,submit an air pollution emissions notice,
and apply for a permit from the Colorado Department of Public Health and Environment.
7. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall be placed on
any recorded plat.

The Weld County Department of Public Works has reviewed this PUD Change of Zone application.
Comments made during this phase of the process may not be all-inclusive, as other concerns or issues may
arise during the remaining application process.
COMMENTS:
External Roadways: WCR 46.5 is designated as a local roadway in the Weld County Transportation Plan.
The plat shows "Apparent 60' Road ROW'. The reference to apparent should be removed and a 60' right-
of-way dedicated with the plat. The Certificate of Dedication, Ownership, and Maintenance does speak to
rights-of-way. WCR 43 is designated as a collector in the Transportation plan and will require a minimum
80 feet of right-of-way. The dimensioning for right-of-way, reservation and open space is poorly done on
both WCR's 46.5 and 43 and shall be redrawn. If there are presently more than six access points on WCR
43 in this mile section, the subdivision road will need to line up with one of the other access points or come
off WCR 46.5.
Internal Roadways: Internal roadways require 60 feet of right-of-way. The roadway shown on the plat
does not meet the requirements of the Weld County Code which is two 12' paved lanes and two 4' gravel
shoulders. The applicant should be required to provide justification for not paving the internal road.
Storm Water: A drainage study was requested at the Sketch Plan phase to be submitted at the time of
Change of Zone. A drainage report has not submitted.
Traffic Impacts: A traffic impact report is not required.
RECOMMENDATION: Approval pending receipt and review of a drainage study.
DEVELOPMENT CONDITIONS (If Approved}:
❑ The minimum right-of-way required by the Weld County Transportation Plan shall be shown on the
plat.
❑ A stop sign and street name sign will be required at the entrance to this subdivision.
❑ The internal roadway shall be paved unless the applicant submits adequate justification.
